排污收費是對于向環境排放污染物或超過國家排放污染物標準排放污染物的排污者，按照污染物的種類、數量和濃度，根據規定征收一定的費用。也是刺激排污單位治理污染的積極性、籌集污染治理資金的有效環境經濟手段和法律制度。《排污費征收使用管理條例》的頒布實施，表明現行排污費在征收、使用和管理等方面已邁上法制化、規范化的軌道。兩年來的實踐證明，我市在排污收費工作中取得了顯著成效，但如何切實有效地開展好排污收費工作，實現依法、全面、足額的目標，仍成為擺在我們面前的一個重要課題，也請關心我市環保工作的網友們多提寶貴意見，共同促進我市的環境保護工作。

一、存在問題及原因

（一）排污申報登記工作不到位，企業謊報、瞞報現象時有發生。

排污申報登記是一項法定的環境行政管理制度，也是各排污者應盡的法律義務。申報登記的內容是測算排污費的唯一依據，具有基礎性、先導性作用。但我市目前排污申報登記工作不盡如人意，主要表現為：一是申報面不廣，精力集中于少數重污染源而放松了面廣量大的一般污染行業、第三產業和小型企業的申報登記。二是申報核定不到位，質量是申報登記的靈魂所在，只有通過認真審核，才能確保申報數據的真實有效。三是申報未能實現動態化，個別區縣把排污申報混淆為環境統計，只實行一年一度的年審，忽視了老污染源的變更申報，從而直接造成排污數據呆板而失去動態。

（二）由于對排污收費的稽查力度不夠，造成排污費征收金額流失。

建立健全的收費制度是順利開展該項工作的重要保證。目前，一些排污者在經濟利益的驅動下，故意瞞報或謊報其實際排污量和排污種類，從而達到排污費能少則少，能不繳則不繳的目的，而沒有認識到排污收費同稅收一樣是企業必須履行的法律義務。有的企業還利用發展經濟為借口，向區縣政府申報少繳或緩繳，從而造成排污費源的流失。同時，環保部門內部稽查力度相對偏軟、監督檢查不到位，導致在排污申報、核定、收繳等環節中存在一些問題。

（三）我市可開征排污費源數量較大，收費隊伍人員相對不足，造成排污費開征面不全。

收費隊伍人員不足的問題在我市環保系統是具有普遍性的問題。目前，環保系統收費人員數量不足其他稅務、工商等部門收費人員的1/3-1/4，尤其是在我市地域面積廣闊的郊區、縣，由于工業布局較為分散，收費人員因受編制等因素所限明顯不足，直接影響全市范圍內的費源調查和監察、稽查工作，導致我市排污費開征面不足，沒有做到應征盡征。這也是制約影響全市排污費征收的最主要因素，必須加以改進。

二、改進問題的幾點建議

（一）轉變觀念，嚴格落實《排污費征收使用管理條例》

《排污費征收使用管理條例》的頒布是國家排污收費制度的一次重大改革，環保部門應轉變思想觀念，改進工作方式。首先，應把握收費的合法性，實現四個轉變，即由超標收費向排污收費轉變；由單因子收費向多因子收費轉變；由單一濃度 收費向濃度與總量相結合的收費轉變；由靜態收費向動態收費轉變。其次，應把握收費的全面性。征收對象方面：由企、事業單位擴大到直接向環境排放污染物的所有單位和個體工商戶。征收內容方面：除征收廢水、廢氣排污費外，應加大噪聲超標排污費和固體廢物排污費的征收。第三，應把握收費的足額性。充分利用各污染源的申報數據，按照現行前三項污染物的當量數之和進行測算，確保征收按月或按季的征收額。最后，應把握收費的時效性。對逾期未繳納的排污者，應及時發出催繳通知書，并按規定征收滯納金，直至給予相關的行政處罰。

（二）加強宣傳，營造排污收費的良好輿論氛圍

排污收費制度是國家管理環境的重要手段，是充分利用經濟杠桿來促進污染防治的重大舉措。收費工作涉及到社會的方方面面，需要全社會的支持和參與，環保部門務必高度重視，精心組織。應結合我市實際，有計劃、有步驟地展開多層次、多形式的宣傳、鼓勵公眾參與。一要積極向市委、市政府領導和相關部門宣傳，取得理解、支持；二要利用報紙、電臺等新聞媒體主動向社會宣傳，擴大社會知曉度；三要定期召開會議和舉辦培訓班等形式，及時向排污者宣傳環保法律法規和上級文件精神。同時，更要抓住違法典型來觸動感化其它排污者。只有這樣，才能為排污收費營造良好的輿論氛圍。

（三）注重排污申報，奠定排污收費的法定基礎

排污申報的基礎性、先導性，決定了其在排污收費中的重要性。一方面通過排污申報登記，可全面掌握轄區內所有排污者的現狀，為各項環境管理制度的落實提供第一手資料；另一方面也為排污收費的測算、核定提供法律依據。為此，應在以下幾方面下功夫：首先，擴大申報面。在抓住重污染源的同時，加大對一般污染源、第三產業和個體工商戶的申報登記。其次，擴大申報種類。既要抓好廢水、廢氣的 定量申報，還要開展噪聲、固廢和電磁波污染的申報，力爭實現全面申報。第三，強化申報核定。通過采用物料衡算、典型抽樣及財務審核等辦法，把好申報質量關，減少謊報、瞞報現象的發生。

（四）加大稽查職能，增強排污收費的威懾力

切實開展收費效能稽查是實現“依法、全面、足額”排污收費的根本保證。實施效能稽查能極大程度地推進收費工作進程。一是開展對廣大排污單位現場稽查，能及時糾正排污申報中不實現象；二是開展上級對下級環境監察機構的稽查，極大多數重污染源往往是當地的“經濟支撐”，時常打著發展經濟的借口向政府申請少繳或免繳排污費，通過適量稽查，能減少地方保護主義；三是開展環境監察內部稽查，糾正監察人員在收費工作中存在的違規行為。
