合同詐騙罪定義與認定標準

根據最高人民檢察院、公安部《關于經濟犯罪案件追訴標準的規定》的有關規定，以非法占有為目的，在簽訂、履行合同過程中，騙取對方當事人財物，涉嫌下列情形之一的，應予追訴：(1)個人詐騙公私財物，數額在5000元至2萬元以上的;(2)單位直接負責的主管人員和其他直接責任人員以單位名義實施詐騙，詐騙所得歸單位所有，數額在5萬元至20萬元以上的。

合同詐騙罪量刑標準

1.數額較大的，處3年以下有期徒刑或者拘役，并處或者單處罰金。

【三年以下有期徒刑、拘役、單處罰金法定基準刑參照點】個人合同詐騙，數額不滿5000元的，單處罰金刑;5000元以上不滿1萬元的，為拘役刑;1萬元的，為有期徒刑六個月;每增加1200元，刑期增加一個月。

2.數額巨大或者有其他嚴重情節的，處3年以上10年以下有期徒刑，并處或者單處罰金。

【三年以上十年以下有期徒刑法定基準刑參照點】個人合同詐騙數額滿3萬元，具有下列情形之一的，為有期徒刑三年。數額每增加2000元，刑期增加一個月。具有兩個以上情形的，在六個月之內酌情增加刑期：

(一)詐騙集團的首要分子或者共同詐騙犯罪中情節嚴重的主犯;

(二)慣犯或者流竄作案危害嚴重的;

(三)詐騙法人、其他組織或者個人急需的生產資料，嚴重影響生產或者造成其他嚴重損失的;

(四)詐騙救災、搶險、防汛、優撫、救濟、醫療款物，造成嚴重后果的;

(五)揮霍詐騙的財物，致使詐騙的財物無法返還的;

(六)使用詐騙的財物進行違法犯罪活動的;

(七)曾因詐騙受過刑事處罰的;

(八)導致被害人死亡、精神失?；蛘咂渌麌乐睾蠊?

(九)具有其他嚴重情節的。

個人合同詐騙，犯罪數額4萬元以上不滿20萬元的，犯罪數額4萬元，為有期徒刑三年，每增加2000元，刑期增加一個月。

3.數額特別巨大或者有其他特別嚴重情節的，處10年以上有期徒刑或者無期徒刑，并處罰金或者沒收財產。

【十年以上有期徒刑法定基準刑參照點】

(一)個人合同詐騙，數額10萬元，并具有上列情形之一的，為有期徒刑十年;每增加1萬元，刑期增加一個月;每增加情形之一，刑期增加六個月;

(二)個人合同詐騙，數額20萬元的，法定基準刑為有期徒刑十年;每增加1.6萬元，刑期增加一個月。

4.自然人犯本罪的，處三年以下有期徒刑或者拘役，并處或者單處罰金;數額巨大或者有其他嚴重情節的，處三年以上十年以下有期徒刑，并處罰金;數額特別巨大或者有其他特別嚴重情節的，處十年以上有期徒刑或者無期徒刑，并處罰金或者沒收財產。

5.單位犯合同詐騙罪的，對單位判處罰金，并對其直接負責的主管人員和其他直接責任人員依上述規定處罰。

【單位犯罪責任人員法定基準刑參照點】

(一)單位合同詐騙，數額5萬元以上不滿8萬元的，對直接負責的主管人員和其他直接責任人員處罰金刑;8萬元以上不滿10萬元的，對直接負責的主管人員和其他直接責任人員處拘役刑;10萬元，為有期徒刑六個月;每增加3300元，刑期增加一個月;

(二)單位合同詐騙，數額20萬元的，直接負責的主管人員和其他直接責任人員法定基準刑參照點為有期徒刑三年;每增加2000元，刑期增加一個月;

(三)單位合同詐騙，數額200萬元的，直接負責的主管人員和其他直接責任人員法定基準刑參照點為有期徒刑十年;每增加1萬元，刑期增加一個月。
