泛瑞翻譯

公證是公證機構根據自然人、法人或者其他組織的申請，依照法定程序對民事法律行為、有法律意義的事實和文書的真實性、合法性予以證明的活動。公證書是指國家公證機關依法對當事人申請公證的法律行為、有法律意義的文書和事實審查后，進而確認其真實性、合法性而出具的證明文書，如“學歷公證書”、“成績單公證書”、“婚姻公證書”、“收養公證書”、“親屬關系公證書”、“未受刑事處分公證書”、“合同公證書”等。隨著我國公民涉外交往(比如移民、留學、旅游等)的頻繁，對公證的需求也大量增加。在此背景下，做好公證文書的翻譯工作，并保證翻譯質量，具有重要的現實意義。

公證文書的特點

與其他法律文本一樣，在文體風格、詞語運用、語法手段等方面，公證文書具有用語嚴謹、規范等特點。高度格式化是公證書最為突出的特點。具體說明如下：

(一）語言的準確嚴密

語言的準確嚴密是對公證文書的最基本要求。公證文書必須忠實原文，這就要求譯者必須在準確透徹地理解原文實質的基礎上，忠實地表達原文的內容。以實踐中常用的學歷公證的正文為例：

例1:學生李明，性別男，一九八五年六月三十日生。于二〇〇四年九月至二〇〇八年七月在本校法律專業四年制本科學習，修完教學計劃規定的全部課程，成績合格，準予畢業。英文譯文為：

Having studied the four-year legal undergraduate program in our university from September 2004 to July 2008，Li Ming(male，born on 22 December 1985)has successfully completed all the courses stipulated in our teaching plan, and thus being permitted to leave with this graduation certificate.在譯文中，用一句英文完成了對漢語的翻譯。在譯文中，通過對分詞的使用:1.Having studied the four-year legal undergraduate.2.being permitted to leave with this graduation certificate 使漢語意思得到了簡明的表達,同時，整個句子的邏輯結構也非常嚴謹。

例2:茲證明李明(男，1980年6月30日出生）于2000年9月人北京大學化學系學習，學制4年,于2004年7月畢業，并獲得學士學位。

英文譯文為：

This is to certify that Li Ming(male，born on May 30, 1980)was enrolled in the Chemistry Department of Peking University(4-year course)in September 2000 and graduated with Bachelor’s degree in July 2004.在上述譯文中，“入學”被翻譯為“be enrolled in”，這是一個較為規范的表達方法。如果使用“to start school”則不太規范，該表達主要表示開始進人小學或者中學學習。

例3:茲證明北京大學畢業文憑上的學校印簽和校長張偉的簽字屬實。英文譯文為：

This is to certify that both the signature of President Zhang Wei and the seal affixed hereto are found to be authentic.在上述譯文中，“屬實”被翻譯成“authentic”，這種翻譯要優于“genuine”。Authentic 一詞在法律英語中比較常用。比如：“作準證書”是“Authentic Instrument”，“作準文件”是 “Authentic Document”。在《布萊克法律辭典》中有例句：the signature is authentic(署名屬實)由此可見，用“authentic”一詞翻譯“屬實”要更準確一些。

例4:茲證明李明（男，1980年5月1日出生）和王芳(女，1980年6月1日出生)于2005年5月1日在北京朝陽區民政局登記辦公室登記結婚。

有譯者將其翻譯為：

This is to certify that Li Ming，who is male and was born on May 1，1980，and Wang Fang, who is female and was born on June 1，1980，registered marriage on May 1, 2010 at the registration office of Civil Affairs Department, Chaoyang District，Beijing.這篇譯文的主要缺陷之一在于時態。“registered”一詞為動詞的過去式，表明的是在過去登記結婚，并不能證明現在的婚姻狀況是離異（divorced)、喪偶（widowed)還是分居(separate)。這種翻譯方法并不能滿足公證文書的準確嚴密的要求。因此，可以將時態改為現在完成時態，以表達“一直持續到現在的狀態”。此外，上述譯文不夠簡潔。可以修改為：

This is to certify that Li Ming(male, born on May 1，1980)and Wang Fang(female，born on June 1, 1980)have been married since May 1，2010 at the registration office of Civil Affairs Department, Chaoyang District, Beijing.(二）高度格式化

在實踐中，公證文書有固定的結構。公證文書在使用過程中，被不斷地完善,一般都已形成某種固定的格式。這在一定程度上給譯者帶來了便利，譯者可以按照相對固定的句式和詞語翻譯即可。例如上述兩個學歷公證的正文的表達就是相對格式化的。再如，例1：“未受刑事處分公證書”的表達通常是:茲證明李明(性別男，1985年6月30日出 生〉至2010年12月20日在中國居住期間沒有受過刑事處分。

該句可以翻譯為：

This is to certify that Li Ming(male，born on June 30，1985)has not had any record of committing offences against the criminal laws during the period of his residence in China until December 20，2010.對于“未受刑事處分公證書”的譯文可以形成這樣的“模板”：

This is to certify that name(male /female，born on month/day，year)has not had any record of committing offences against the criminal laws during the period of his residence in place until month/day, year.例2:“委托公證書”的表達通常是:茲證明李明和張偉于2010年5月1日來到我處,在 我面前，在前面的委托書上簽名(或蓋章)。該句可以翻譯為：

This to certify that Li Ming and Zhang Wei came to my office on May l3t，2010，and affixed their signature(or their seal)in my presence，on the Power of Attorney attached hereto.除了上述內容外，為了表示公證員的“見證”，一般還會加上下述固定的“套話”:In wit-ness whereof, I have hereunto set my hand and official seal on the day and year first writ-ten above.(公證員于上述日期簽署以上文書并加蓋印章，特此證明。）
