第二條 資金托管期限:如交易成功,自乙方將自有資金存入托管賬戶之日起,至甲乙雙方交易的房屋權屬轉移登記完成,自有資金劃付至甲方之日止。
如交易失敗,自乙方將自有資金存入托管賬戶之日起,至甲乙雙方注銷存量房合同,自有資金劃付至乙方之日止。
第三條 丙方的托管義務:在托管期間,丙方通過存量房交易服務平臺出具電子指令要求托管銀行進行劃轉托管賬戶內的自有資金。因丙方原因造成存量房交易當事人資金損失的,丙方承擔相應的賠償責任。
房屋權屬轉移登記完成后二日內,丙方通過存量房交易服務平臺出具電子指令,要求托管銀行將乙方存入托管賬戶內的自有資金劃轉至丙方賬戶。
發生下述情形之一時,甲、乙雙方辦理《北京市存量房屋買賣合同》注銷手續后二日內,丙方通過存量房交易服務平臺出具電子指令解除對自有資金的托管,并要求托管銀行將乙方存入托管賬戶內的自有資金劃轉至乙方賬戶。
1、甲、乙雙方一致同意解除《北京市存量房買賣合同》,辦理了合同注銷手續,并經丙方確認的。
2、甲乙雙方在辦理房屋轉移登記的過程中,經房屋權屬登記部門審核,因不符合登記條件而導致不能辦理房屋轉移登記的。
3、因有權機關限制及其他未達成交易的情形。
4、其他未達成交易的情形。
第四條 該存量房交易過程中,甲、乙雙方發生的糾紛,由甲、乙雙方自行協商解決,丙方不介入該存量房買賣糾紛。丙方不承擔本協議約定的托管資金以外的其他責任。第五條
有權機關對托管資金進行凍結和扣劃的,丙方不對該凍結或劃扣等行為以及由此給交易造成的任何結果承擔任何責任,但有義務協助托管銀行證明托管賬戶及資金的性質。
第六條
本協議在履行中如發生爭議,三方應協商解決。協商不成時,三方同意按下列第 種方式處理:
1、向丙方所在地人民法院提起訴訟;
2、提交北京仲裁委員會仲裁。
第七條

為保證存量房交易當事人的合法權益,保障存量房交易結算資金的安全,根據有關法律、法規,在遵循公平信用原則的基礎上,經甲、乙雙方協商一致,就存量房交易結算資金劃轉相關合作事宜達成如下協議:
第一條 本協議所示的交易結算資金劃轉對象為存量房買賣的房價款或首付房價款,除交易當事人在《劃轉協議》內約定由賣房人直接收取購房定金(不超過房價款的20%)的,全部房價款或首付房價款均應視為劃轉對象。
第二條 乙方為甲方開設“存量房交易結算資金專用存款賬戶”(以下簡稱“專用存款賬戶”),該“專用存款賬戶”專門用于劃轉存量房交易過程中所涉及的交易結算資金,并不得支取現金。“專用存款賬戶”應與甲方自有的結算賬戶分開,賬戶內的資金獨立于甲方的固有財產及其管理的其他財產,也不屬于甲方的負債,資金的所有權屬于交易當事人,甲方無權挪用該賬戶內的資金,不得要求乙方出具資信證明。
第三條 乙方按照國家有關規定,對甲方開立的專用存款賬戶計息。專用存款賬戶產生的利息由甲方根據與買房人簽訂的協議進行分配。
第四條 乙方詳細記錄專用存款賬戶資金劃轉情況,并根據甲方需要向甲方提供。
第五條 房屋轉移登記辦理完畢后,乙方依據甲方開具《存量房交易結算資金支取憑證》辦理交易結算資金的劃轉手續。
第六條房屋未設定抵押的,先報送銀行審批,審批通過辦理過戶,銀行在辦理抵押,銀行放款至“專用賬戶”出具放款憑證,甲方可持《存量房交易結算資金支取憑證》到乙方支取交易結算資金,劃入賣方賬戶。
房屋設定抵押的,在賣方無法自行辦理時,由甲方墊付款項用于辦理抵押注銷手續,墊入抵押權人賬戶,解除抵押,辦理過戶;銀行在辦理抵押,銀行放款至“專用賬戶”出具放款憑證,甲方可持《存量房交易結算資金支取憑證》到乙方支取交易結算資金,首付款劃入賣方賬戶,墊付款劃入甲方賬戶。
第七條 在辦理房屋轉移登記的過程中,經房屋權屬登記部門審核,因不符合產權登記條件而導致不能辦理房屋轉移登記的,甲方應與買賣雙方協商一致后,共同出具書面說明及相關資料并由甲方出具《存量房交易結算資金支取憑證》。乙方核實后向買方劃付返還交易結算資金。
第八條 買賣雙方因故終止存量房交易或由買賣雙方所簽《存量房屋買賣合同》引起的糾紛造成交易終止的,甲方應與買賣雙方協商一致后,共同出具書面說明及相關資料,并由甲方出具《存量房交易結算資金支取憑證》。乙方核實后向買方劃付返還交易結算資金。
第九條 賣方不遵守《買賣合同》、《劃轉協議》的有關約定導致存量房交易終止的,應由甲方與買方共同協商出具書面說明及相關資料,并由甲方出具《存量房交易結算資金支取憑證》。乙方核實后向買方劃付返還交易結算資金。
第十條 買方不遵守《買賣合同》、《劃轉協議》的有關約定導致存量房交易終止的,應由甲方與賣方共同協商出具書面說明及相關資料,并由甲方出具《存量房交易結算資金支取憑證》。乙方核實后向買方劃付返還交易結算資金。
第十一條 本協議約定的交易結算資金管理期間,若司法機關、行政機關等有關部門對“專用賬戶”進行凍結或扣押,甲、乙雙方均有義務出示證據以證明交易結算資金及其銀行賬戶的性質。第十二條 本協議未盡事宜由甲、乙雙方另行協商解決。
第十三條 本協議在履行中如發生爭議,雙方應協商解決。協商不成時,雙方同意按下列第種方式處理:。
