黨的十六屆四中全會提出 :構建社會主義和諧社會是我們黨全面建設小康杜 會, 開創中國特色社會主義事業新局面的一項重大任務。工商行政管理機關作為 市場監管和行政執法機關, 承擔著市場準人、市場交易和競爭行為監管、消費者 權益保護等重要監管職能。如何為構建社會主義和諧社會不斷發揮有效功能作 用, 有力促進社會生產力發展和社會的穩定, 正是工商行政管理機關當前巫待研 究的重要課題。

一、市場經濟快速發展與現行市場監管體系不相適應

“和諧” 作為一個重要的哲學范疇, 反映的是事物在其發展過程中表現出來 的協調、完整和合乎規律的存在狀態上, 就是各種關系和矛盾配合、協調, 使之 相生相長。當事物的矛盾和關系配合適當、勻稱、協調時, 就會達到共同發展的 境界或發生質變, 生出新的更高級的事物。隨著時代的飛速發展, 市場主體監管 理論、法律、監管體制、手段和方法等跟不上市場快速發展要求, 尚存在市場不 和諧因素。

(一 監管規則滯后。

從本質上講,法律是對現實社會生活的確認。監管規則滯后,一是市場經濟 條件下, 一些迫切需要法律法規遲遲不能出臺, 致使政府無法實施監管活動。二 是一些法律法規規定不符合市場競爭要求, 賦予政府管理部門政策制定者、企業 所有者、行業監管者多重身份, 客觀上難以保證這些行業的充分競爭。如 :煙草、鹽業、供電、信息產業等等。三是法律法規確定市場監管機構承擔的職責與其賦 予的權力不相適應,致使監管職能難以到位。如 :工商行政管理機關作為市場監 管和行政執法部門, 法律未授權其對涉嫌違法主體的人身、財產、場所等采取必 要的強制措施的權力, 致使難以及時收集當事人的違法證據, 查明違法事實, 放 縱了違法行為。

(二 監管權力分散。

我國工商、質監、衛生、農業、經貿、公安等幾乎所有政府涉及經濟管理的 部門都有市場監管的職能。這種體制具體有兩個特點 :一是職能的交叉性,即對 同一市場行為設定不同的部門進行監管,人為造成工作中有利就爭,有弊就推, 互相扯皮的現象;二是職權的層級性,即對同一違法行為根據社會危害程度設定 相關部門不同的執法權。如 :生產不合格種子違法行為輕微的,農業部門可以吊 銷其《生產經營許可證;違法行為嚴重的要提請工商行政管理部門才能吊銷其 《營業執照》;需要追究刑事責任的,要將案件移送公安機關處理。工作中往往 認識各異,難以協調,很難形成合力,實現預期的監管目的。

(三 抗干預能力弱。

盡管黨中央國務院對工商部門實行省以下垂直管理, 但由于法律法規賦予權 力不足以保證其依法獨立履行職責, 市場監管活動很大程度上必須依靠地方黨委 政府和相關部門的支持配合。這種職能上的依附性決定了市場監管活動的開展必 然受制于地方黨委、政府。因此, 對明顯損害經濟秩序, 但涉及地方經濟利益的 違法行為, 市場監管部門往往只能屈從于地方黨委、政府的意愿, 很難進行有效 的抵制。

(四 執法保障不足。

市場監管活動是一項實踐性很強的社會活動, 具有監管內容的專業性, 監管 方式的對抗性和經濟支出的不可預見性等特點。市場監管部門尚未建立起相關業 務的技術監測體系,其監管職責的履行完全依賴當事人的舉報和執法人員的經 驗、知識進行判斷。

二、建立與市場經濟相適應的市場監管機制

和諧是一種狀態, 是事物組成部分之間的有機融合, 它表現為一種良好的秩 序。社會和諧就是社會各個組成部分之間的良性互動, 是一種有序的狀態。和諧

社會要求構建和諧市場。和諧市場是全社會共同的事業。應針對市場經濟多元化, 市場主體結構復雜化, 市場行為多樣化, 監管職能交叉化等特點現狀, 探討研究 與社會發展要求相適應的理論、法律、觀念、機制等行之有效的監管體系。實現

五對關系的和諧,即 :市場主體之間關系的和諧;消費者與市場主體關系的和諧;監管機關與市場主體關系的和諧;監管機關與消費者關系和諧;經濟秩序與整個 社會關系的和諧,從而達到社會經濟發展和穩定。

(一 強化市場監管理論創新,完善法律法規

市場監管隨市場經濟發展而來,成長期短,沒有相應學科支撐,理論基礎薄 弱,缺乏完整、系統的市場監管理論體系。法律法規不夠完善,出臺滯后,實用 性不強,操作不便。必須加速理論研究創新,法律、法規修改,形成獨立學科體 系,指導實踐,完善法律法規,依法行政,促進和諧監管。法律是規范市場經濟 秩序的基礎, 法規是依法行政的依據。必須隨著形勢變化, 市場發展要求不斷完 善法律, 修改法規。在條款內容上, 注重適用性和可操作性;在時間上快捷提速, 縮短周期;在受權上,防止交叉性和重復性,為構建和諧監管,提供法律保障。

(二 強化效率優先,完善市場監管機制。

中共中央總書記胡錦濤同志在(中紀委第五次全會》 講話中強調 :執政能力問 題與效能問題密切相關, 效能高低反映執政能力高低。行政效率是行政效能的重 要方面, 也是衡量行政效能的重要尺度。市場監管運行機制思維定位, 機構設置 合理性, 部門職責劃分直接決定著市場監管效能。因此, 必須遵循市場發展的客 觀規律, 完善監管機制, 理清部門職責, 實現職能到位, 使市場監管機制更好地 得到有效發揮,提高市場和諧監管效能。

一是要以創新為動力, 大膽拋棄傳統的市場監管理念和方法。針對現行存在 職能交叉,多頭監管,重復勞動,效率低的弊端,創新市場監管理念,改革監管 體制。二是要以機構改革為先導。按照精統一和效能的原則, 將職能相同或近似 的部門進行整合重組, 實現機構、職責和人員的優化以及市場監管權力的相對集 中統一。三是要以建立相關的技術體系為依托, 增強市場監管機構工作的科技信 息含量, 提高市場監管的科學性和權威性。四是要以權力的合理配置為重點, 切

(三 強化科學監管,提高行政效率。

堅持科學發展觀就是要樹立科學發展的思維理念和行為方式,運用科技成 果,提升監管效能。以最小成本獲得最大的監管效果。
