本罪侵犯的客體是雙重客體，既侵犯了銀行或者其他金融機構對貸款的所有權，還侵犯國家金融管理制度，貸款是指作為貸款人的銀行或者其他金融機構對借款人提供的并按約定的利率和期限還本付息的貨幣資金。在現代社會中、隨著國民經濟和社會發展對資金需求的愈益增大，貸款在社會經濟生活中所起的作用日益突出。銀行等金融機構不僅通過發放貸款參與企業流動資金周轉，并支持企業購置固定資產和進行技術改造，促進生產發展，同時還通過發放貸款促進商品流通，促進科技文化衛生事業等發展。與此同時，隨著我國貸款金融業務的日益發展，詐騙貸款違法犯罪活動也隨之產生并愈益嚴重。詐騙貸款行為不僅侵犯了銀行等金融機構的財產所有權、而且必然影響銀行等金融機構貸款業務和其他金融業務的正常進行，破壞我國金融秩序的穩定。因此、詐騙貸款行為同時侵犯了銀行等金融機構的貸款所有權以及國家的貸款管理制度，具有比一般詐騙行為更大的社會危害性。

客觀要件

本罪在客觀方面表現為采用虛構事實、隱瞞真相的方法詐騙銀行或者其他金融機構的貸款，數額較大的行為。

1、編造引進資金、項目等虛假理由騙取銀行或者其他金融機構的貸款。這種情形近年來屢有發生，僅在上海一地，一年就發生假引資的詐騙幾十起，案犯一般是偽造國外某財團的巨額資金或者“在美國的愛國華人”的巨額私人存款要以優惠條件存人某銀行，以騙取銀行的貸款和手續費。此外，還有許多犯罪分子編造效益好的投資項目，以騙取銀行等金融機構的貸款。

2、使用虛假的經濟合同詐騙銀行或者其他金融機構的貸款。為支持生產，鼓勵出口，使有限的資金增值，銀行或其他金融機構有時也要根據經濟合同發放貸款，有些犯罪分子偽造或使用虛假的出口合同或者其他短期內產比很好效益的經濟合同，詐騙銀行或其他金融機構的貸款。如犯罪分子張某偽造某公司的出口供貨合同，并以虛假的合同向上海某銀行申請了幾百萬元的貸款后攜款潛逃。

3、使用虛假的證明文件詐騙銀行或其他金融機構的貸款。所謂證明文件是指擔保函、存款證明等向銀行或其他金融機構申請貸款時所需

4、使用虛假的產權證明作擔保或超出抵押物價值重復擔保，騙取銀行或其他金融機構貸款的。這里的產權證明，是指能夠證明行為人對房屋等不動產或者汽車、貨幣、可隨時兌付的票據等動產具有所有權的一切文件。如罪犯張某以偽造的某房屋開發公司房產證明為抵押，騙取某銀行貸款一百余萬元。

本罪的主體是一般主體，任何達到刑事責任年齡、具有刑事責任能力的自然人均可構成，單位不能成為本罪的主體。銀行或其他金融機構的工作人員與詐騙貸款的犯罪分子串通并為之提供詐騙貸款幫助的，應以貸款詐騙罪的共犯論處。所謂串通，在本罪是指銀行或者其他金融機構的工作人員與詐騙貸款的犯罪分子在實施詐騙前或在詐騙的過程中，相互暗中勾結，共同商量或進行策劃，與詐騙犯罪分子予以

本罪在主觀上由故意構成，且以非法占有為目的。至于行為人非法占有貸款的動機是為了揮霍享受，還是為了轉移隱匿，都不影響本罪的構成。反之，如果行為人不具有非法占有的目的，雖然其在申請貸款時使用了欺騙手段，也不能按犯罪處理，可由銀行根據有關規定給予停止發放貸款、提前收回貸款或者加收貸款利息等辦法處理。

1.數額較大的，處3年以下有期徒刑或者拘役，并處或者單處罰金。

(七)曾因詐騙受過刑事處罰的;

(八)導致被害人死亡、精神失常或者其他嚴重后果的;

(九)具有其他嚴重情節的。

個人合同詐騙，犯罪數額4萬元以上不滿20萬元的，犯罪數額4萬元，為有期徒刑三年，每增加2000元，刑期增加一個月。

3.數額特別巨大或者有其他特別嚴重情節的，處10年以上有期徒刑或者無期徒刑，并處罰金或者沒收財產。

【十年以上有期徒刑法定基準刑參照點】

(一)個人合同詐騙，數額10萬元，并具有上列情形之一的，為有期徒刑十年;每增加1萬元，刑期增加一個月;每增加情形之一，刑期增加六個月;

4.自然人犯本罪的，處三年以下有期徒刑或者拘役，并處或者單處罰金;數額巨大或者有其他嚴重情節的，處三年以上十年以下有期徒刑，并處罰金;數額特別巨大或者有其他特別嚴重情節的，處十年以上有期徒刑或者無期徒刑，并處罰金或者沒收財產。

5.單位犯合同詐騙罪的，對單位判處罰金，并對其直接負責的主管人員和其他直接責任人員依上述規定處罰。

2、情節較輕的犯故意殺人罪

(2)義憤殺人，即被害人惡貫滿盈，其行為已達到讓人難以忍受的程度而其私自處死，一般是父母對于不義的兒子實施這種行為;

(3)激情殺人，即本無任何殺人故意，但在被害人的刺激、挑逗下而失去理智，失控而將他人殺死，其必須具備以下條件：

其一，必須是因被害人嚴重過錯而引起行為人的情緒強烈波動;

其二，行為人在精神上受到強烈刺激，一時失去理智，喪失或減弱了自己的辨認能力和自我控制能力;

其三，必須是在激憤的精神狀態下當場實施。

(4)受囑托殺人，即基于被害人的請求、自愿而幫助其自殺;

(5)幫助他人自殺的殺人;

(6)生母溺嬰，即出于無力撫養、顧及臉面等不太惡劣的主觀動機而將親生嬰兒殺死。如果是因為重男輕女的思想作怪，發現所生的是女兒而加以溺殺的，其主觀動機極為卑劣，則不能以故意殺人罪的情節較輕情況論處。
