寫投訴信應(yīng)本著真實(shí)的原則,如實(shí)的反映情況,根據(jù)1991年國家旅游局頒布的《旅游投訴暫行規(guī)定》,投訴信應(yīng)包括以下幾部分:

2、審批了此類娛樂場(chǎng)所,它的噪音該如何控制?經(jīng)營(yíng)者就應(yīng)做出相應(yīng)隔音措施才對(duì),可9點(diǎn)半酒吧,不但沒有隔音措施,而且進(jìn)出開關(guān)門時(shí)會(huì)有更恐怖的噪音,本來就已經(jīng)噪音夠大,在安靜的睡眠中,還會(huì)不時(shí)傳出更大的噪音來試探居民的容忍度,實(shí)在是忍無可忍。

3、娛樂場(chǎng)所的經(jīng)營(yíng)時(shí)間是否有規(guī)定?一個(gè)噪音如此無法控制的娛樂場(chǎng)所,居然經(jīng)營(yíng)到凌晨四五點(diǎn),試問周圍居民要如何休息?

這一陣還是國慶放假期間,周遭居民大不了就是白天再補(bǔ)睡眠,但是正常上班后呢?這樣的夢(mèng)魘要什么時(shí)候才能結(jié)束?住在里間的年輕人尚且吵得無法入睡,老年人如何休息?

海口標(biāo)榜自己的最佳人居環(huán)境,這種環(huán)境如何居住?海甸島超多外來人口,時(shí)值又是老年人群超多在瓊過冬養(yǎng)老時(shí)節(jié),海口市如果沒法處理此類影響人居環(huán)境的噪音事件,何談最佳?

像香港、上海等地,都會(huì)有巡警過問此類噪音事件,為何海口卻是報(bào)而不管?請(qǐng)問海口到底把最佳人居環(huán)境的標(biāo)準(zhǔn)放在哪里??

1、我于20xx年9月24日在xx市xx國際旅行社支付了現(xiàn)金3220元,并簽訂了兩人長(zhǎng)江三峽四日游和武漢一日游的旅游合同,出發(fā)時(shí)間是20xx年xx月4日,結(jié)束時(shí)間是20xx年xx月8日。合同上注明了宜昌到武漢是乘坐大巴,武漢一晚住掛三星賓館,行程結(jié)束后送我們到武漢市新華路或漢口火車站。但一路奔波勞累下午兩點(diǎn)多到了宜昌,旅行社卻沒安排好大巴接我們,而且旅行社導(dǎo)游沿途還收了上百位到武漢旅客的車費(fèi),于是,一百多人吵鬧著等了一個(gè)多小時(shí),才等來一部小中巴,又因僧多粥少而爭(zhēng)吵打鬧半天,上演了一出“打鬧勝者有位先坐,敗者下車再等再爭(zhēng)”的鬧劇!!到武漢五環(huán)賓館已是晚上九點(diǎn)多,武漢旅行社又換了一部車把我們送到小天鵝賓館,這時(shí)候已是晚上十點(diǎn)多了,我們又累又餓,也沒精力考究小天鵝賓館是否掛三星賓館了。第二天我們?cè)谖錆h游玩,我與旅行社的導(dǎo)游和司機(jī)交涉了幾次,他們不肯送我們?nèi)セ疖囌荆€謊話連篇說漢口火車站和武昌火車站都沒有火車到廣州,讓我們?nèi)プ錆h火車站坐高鐵,又說武漢火車站很遠(yuǎn),不肯送我們?nèi)ァW詈笪覀儗?shí)在沒辦法,又人生地不熟的,只好自己租賃車子到武漢火車站乘坐高鐵。回來后我才查到,漢口火車站和武昌火車站每一天都有很多班火車從武漢到廣州,是旅行社的導(dǎo)游和司機(jī)不愿送我們到火車站。為此,我們多付了100元租車費(fèi),坐高鐵又比火車多花了500元。xx國際旅行社違反了合同規(guī)定,我要求他們賠償我們的經(jīng)濟(jì)損失。按履行社和我們所簽定的團(tuán)隊(duì)國內(nèi)旅游合同中第六章違約職責(zé)第十六條旅行社的違約職責(zé)4、旅行社違反了合同規(guī)定,中止對(duì)旅游者帶給交通服務(wù)的,應(yīng)當(dāng)負(fù)擔(dān)旅游者在被中止旅游服務(wù)期間的交通等必要費(fèi)用,并向旅游者支付旅游費(fèi)用總額30%的違約金。所以,xx國際旅行社應(yīng)賠償我們交通費(fèi)損失600元,并支付我們旅游費(fèi)用總額3220元的30%違約金966元。合計(jì)1566元。

2、我們?cè)诤炗喓贤瑫r(shí)一再說明我們中一人有軍官證,在旅游景點(diǎn)能享受優(yōu)惠或者免門票,讓他們優(yōu)惠旅游價(jià)格。但旅行社老板及其工作人員胡國宇等都說長(zhǎng)江三峽是扶貧線路,任何證件都不享受優(yōu)惠,他們承諾如果在景點(diǎn)軍官證能打折,導(dǎo)游現(xiàn)場(chǎng)退還現(xiàn)金。我問他們xx國際旅行社有導(dǎo)游在游船上負(fù)責(zé)我們旅游事宜嗎?他們說有。于是我要求他在簽訂的合同上寫明在景點(diǎn)如軍官證能打折導(dǎo)游現(xiàn)場(chǎng)退還現(xiàn)金。但在游長(zhǎng)江三峽景點(diǎn)時(shí)我了解到軍官證基本都能享受50%優(yōu)惠,三峽大壩還能免費(fèi)參觀。我要求導(dǎo)游現(xiàn)場(chǎng)退還現(xiàn)金,但導(dǎo)游一再推諉,說xx市xx國際旅行社沒交待,這時(shí)我才知導(dǎo)游不是xx國際旅行社。他們這是違反旅行社和我們所簽訂的團(tuán)隊(duì)國內(nèi)旅游合同中第六章違約職責(zé)第十六條旅行社的違約職責(zé)5、旅行社未經(jīng)旅游者同意,擅自將旅游者轉(zhuǎn)團(tuán)、拼團(tuán),旅游者在出發(fā)后得知,旅行社應(yīng)當(dāng)按旅游費(fèi)用總額的25%向旅游者支付違約金。我多次打電話給旅行社工作人員胡國宇,讓他交待導(dǎo)游退還差價(jià),可他不肯,之后還不接電話,并一看到我們電話就關(guān)機(jī)。態(tài)度惡劣!!最后,游船上的導(dǎo)游被我問煩了,退了45元給我。xx國際旅行社違反了合同規(guī)定,我要求他們按旅游費(fèi)用總額3220元的25%支付違約金805元,退還我們多支付旅游費(fèi)用總額32

20元的xx%,計(jì)322元。合計(jì)1127元。

3、按旅行社和我們所簽訂的團(tuán)隊(duì)國內(nèi)旅游合同中第六章違約職責(zé)第十六條旅行社的違約職責(zé)3、旅行社未經(jīng)旅游者簽字確認(rèn),安排本合同約定以外的另行付費(fèi)項(xiàng)目的,應(yīng)當(dāng)承擔(dān)自費(fèi)項(xiàng)目的費(fèi)用;擅自增加購物次數(shù)的,每次按旅游費(fèi)用總額的xx%向旅游者支付違約金;強(qiáng)迫或者變相強(qiáng)迫旅游者購物的,每次按旅游費(fèi)用總額的20%向旅游者支付違約金。而且,旅行社和我們所簽定的團(tuán)隊(duì)國內(nèi)旅游合同中第二章合同的簽訂第二條(8)購物安排中明文規(guī)定:旅行社安排的購物次數(shù)不超過行程日數(shù)的一半。但旅行社嚴(yán)重違反了合同規(guī)定,不僅僅有安排本合同約定以外的另行付費(fèi)項(xiàng)目,每一天還安排一次到兩次的購物,有時(shí)還強(qiáng)迫消費(fèi)!更可惡的是景點(diǎn)工作人員和導(dǎo)游利用寺廟道觀等圣潔的佛教圣地,人為地強(qiáng)迫及變相強(qiáng)迫我們給香油錢,給少了還不行,最少兩三百,想隨心給一百幾十的不讓走,還對(duì)不愿按他們意愿給的旅游者惡語中傷。這極大地破壞了xx和長(zhǎng)江三峽的形象,給我們旅游者留下了十分壞的印象,經(jīng)南來北往的旅游者一宣傳,以后誰還敢來xx和長(zhǎng)江三峽旅游和投資?xx和長(zhǎng)江三峽旅游勝地是一道對(duì)外的窗口,景點(diǎn)工作人員的言行舉止無疑代表xx和長(zhǎng)江三峽人民的形象和素質(zhì)。這是貪小利而損壞一座城市的名聲啊!!xx國際旅行

社嚴(yán)重違反了合同規(guī)定,我要求他們按旅游費(fèi)用總額3220元的20%向我們支付擅自增加購物次數(shù)的違約金644元,并按旅游費(fèi)用總額3220元的20%向我們支付強(qiáng)迫或者變相強(qiáng)迫旅游者購物的違約金644元。

自從在鐵通公司辦理寬帶業(yè)務(wù)受欺詐后,情緒一向低落,我在反思:為什么個(gè)人欺騙人民會(huì)受到嚴(yán)厲的打擊,為什么站在國家和群眾懷抱的人欺騙人民就會(huì)受到保護(hù),不但沒事,而且態(tài)度還如此囂張。

事情是這樣的,我住在和諧花園3號(hào)樓xx02室,在2015年2月26日,我在潛山路與淠河路交口光大銀行后面的鳳凰城1期6-108室的鐵通公司辦理了一筆720元的寬帶業(yè)務(wù),當(dāng)時(shí)約定返還240元移動(dòng)話費(fèi),分xx月返還,當(dāng)時(shí)很多領(lǐng)導(dǎo)都在現(xiàn)場(chǎng)開會(huì),我特意問了是每月20元的話費(fèi)還是其他什么的,我問了有7-8遍,工作人員以及裝寬帶的人員都說是話費(fèi),但直到此刻都沒返還,我一問,他們說已經(jīng)返還了,是話包,我說怎樣說好的是話費(fèi)怎樣變成話包了(期間我問了10086,我問就算是話包,也就應(yīng)返還呀,他們告知,話包要在我的套餐意外才能使用,我用的是88元全球通套餐,他們也沒任何的提示和提醒,這么幾個(gè)月我一分錢也沒使用的到),我打了很多電話投訴,他們就告知說口誤之類的話,4月30日我又打電話到鐵通網(wǎng)點(diǎn),工作人員的態(tài)度極其囂張,說有什么大不了的,不就是每月20元嗎,還蠻橫無理,說領(lǐng)導(dǎo)不處理,沒法處理,就這樣。

當(dāng)時(shí)我打了很多電話,但都不幫忙解決,一個(gè)推一個(gè),都說不在管轄范圍,最后他們說這是你們消協(xié)所管的,所以我向各位領(lǐng)導(dǎo)投訴,要求返還240元,另因其態(tài)度十分惡劣,影響十分不好,故意欺詐,需賠償我3倍的話費(fèi)以及書面道歉以作為對(duì)他們的處罰,我相信社會(huì)主義核心價(jià)值觀的好處所在,言必行,行必果,誠信無欺才是構(gòu)建和諧社會(huì)的基礎(chǔ)。

我們是xx大廈x座的租戶,xx公司。在入駐貴大樓以來,發(fā)現(xiàn)貴公司的物業(yè)管理方面存在很多的問題,也以前多次向貴公司如實(shí)反映,但至今但至今仍未得到解決。現(xiàn)今,我們?cè)俅螌?duì)物業(yè)管理方面的問題向貴公司提交書面商榷函,請(qǐng)貴公司予以認(rèn)真思考并及時(shí)解決。

一、公共區(qū)域衛(wèi)生問題

1.廁所

x層的廁所環(huán)境相當(dāng)惡劣。整個(gè)廁所經(jīng)常發(fā)出惡臭,垃圾桶里的垃圾滿了也無人清理。且常有將垃圾桶放在馬桶蓋上位置被占用的狀況發(fā)生,導(dǎo)致去廁所時(shí)常要排隊(duì)。廁所的衛(wèi)生卷紙,擦手紙更換不及時(shí)等。

2.走廊

走廊的衛(wèi)生持續(xù)也有問題。走廊上經(jīng)常會(huì)有紙屑,塑料袋等垃圾,且一個(gè)小時(shí),兩個(gè)小時(shí)也沒有人清理。曾有客戶來訪時(shí)遇到這種,極大影響了我們公司的形象。

二、設(shè)備維修不及時(shí)的問題

對(duì)于租戶內(nèi)的報(bào)修,回應(yīng)遲緩的問題相當(dāng)嚴(yán)重。以以下狀況為例:

1.空調(diào)

今年4月中旬的時(shí)候,天氣炎熱,室內(nèi)溫度高達(dá)30以上,我們租區(qū)內(nèi)的部分空調(diào)不出風(fēng),導(dǎo)致部分同事炎熱難忍。我們多次與物業(yè)管理處保修,要求對(duì)空調(diào)進(jìn)行檢查,但你們以冷氣未開為理由,一向推諉派人檢查。

2.白熾燈

我們租區(qū)內(nèi)的白熾燈維修存在很嚴(yán)重的問題。當(dāng)我們發(fā)現(xiàn)少數(shù)白熾燈出現(xiàn)問題進(jìn)行報(bào)修時(shí),貴公司物業(yè)管理處的回應(yīng)相當(dāng)遲緩,甚至有時(shí)石沉大海得不到回應(yīng)。而等到我們需要維修更換的白熾燈累積到必須數(shù)量時(shí),得到的回應(yīng)卻是你們沒有庫存不能進(jìn)行更換。且在之后的數(shù)月中得到答復(fù)都是同樣的沒有庫存。

3.玻璃

我們租區(qū)內(nèi)有一塊外墻玻璃產(chǎn)生了裂縫,存在嚴(yán)重的安全隱患。但在報(bào)修后,直至這天,一個(gè)月過去了,仍然沒有得到任何維修,檢查時(shí)承諾的保護(hù)措施也沒有得到落實(shí)。

由于對(duì)貴公司物業(yè)服務(wù)水平,服務(wù)質(zhì)量存在相當(dāng)?shù)牟粷M意,我們將采取據(jù)交物業(yè)費(fèi)的行為,以促使貴公司對(duì)以上急需解決的問題給我們一個(gè)滿意的交待。

20xx年x月x日,本人在黃州八一路赤兔馬電動(dòng)車經(jīng)銷店,購買了一輛赤兔馬牌登山王型電動(dòng)自行車。此車經(jīng)過一段時(shí)間的使用,發(fā)現(xiàn)存在很多質(zhì)量問題;

首先、在買車時(shí)經(jīng)銷商承諾是20ah電池,保證能夠跑到80-120公里,可實(shí)際車?yán)镅b的是17ah電池,最多只能跑到20-30多公里,三個(gè)月就不行了。一般電池要用一年以上,可這種電池一年我內(nèi)換了三次。更換電池的手續(xù)也保留著。

第二、此車的電機(jī)有質(zhì)量問題,這種赤兔馬牌登山王型電動(dòng)自行車的電機(jī)老是出故障,經(jīng)過多次維修,總是修不好,于是他們就將我的車改裝了,把原先的登山王電機(jī)和后平差及減震器一齊換成普通款式的輪轂式電機(jī)和平差及摩托車的減震器,看看改裝后的車子和原先模樣大變,(當(dāng)時(shí)心中很不樂意,因?yàn)檫@款電機(jī)要比我原先的那種電機(jī)便宜200多元,他們也不退還差價(jià))此后車子的龍頭就晃的很厲害了,經(jīng)過多次維修都沒有修好。電機(jī)還是老是出問題,先后也換過三次電機(jī)(電機(jī)承諾是保修5年)。

第三、此車的后剎車?yán)鲜浅龉收希苿?dòng)經(jīng)常失靈。此車后剎車經(jīng)常制動(dòng)不良,返修多次都沒有解決根本性問題,每次去修都是敷衍一下。更為嚴(yán)重的是在20xx年x月xx日星期x的下午,我老婆騎著此車經(jīng)過金橋商場(chǎng)門口時(shí),由于剎車突然失控造成我老婆的車和另一輛電動(dòng)車相撞,造成對(duì)方受傷嚴(yán)重而住院。當(dāng)天下午4點(diǎn)多鐘,我將車送到赤兔馬售后檢修,說好讓我第二天下午去取車,第二天一早我就去了,結(jié)果他們連夜就將車子已經(jīng)修好了,并將此車的前后剎車鼓都換新的了。換下來的壞件我要回后,經(jīng)過仔細(xì)研究,發(fā)現(xiàn)此后剎車鼓的確是有質(zhì)量問題,請(qǐng)有關(guān)部門領(lǐng)導(dǎo)鑒定。由于黃州八一路赤兔馬電動(dòng)車經(jīng)銷店銷售車和售后維修都存在嚴(yán)重的質(zhì)量問題,他們非法改裝,使用劣質(zhì)產(chǎn)品,不顧消費(fèi)者的安全隱患,才造成了這次事故,作為受害者我想為自己討回公道,同時(shí)也是為醫(yī)院的傷者籌集醫(yī)藥費(fèi),更是為廣大的消費(fèi)者群體敲一個(gè)警鐘。期望赤兔馬公司和經(jīng)銷商能賠償我的經(jīng)濟(jì)損失共計(jì)5000元

我是你們公司產(chǎn)品的新用戶,但我認(rèn)識(shí)德生已有很長(zhǎng)一段時(shí)間,能夠說是自從你們的廣告第一次登在雜志上之日起就開始注意你們了。

我從小就很愛收聽廣播,如今已有二十年的光景。前前后后也買過不少品牌和型號(hào)的收音機(jī)。但自認(rèn)識(shí)德生后,我就有一種感覺,你們的產(chǎn)品必須很棒!我必須要買!(或許你們的廣告很成功吧!)

所以,今年早些時(shí)候,我就向我的母親推薦你們的產(chǎn)品,她也贊同,于是就于八月先后郵購了一臺(tái)R9700型收音機(jī)、一對(duì)SP18音箱和一個(gè)外接電源DC05A。

但是,產(chǎn)品郵寄來后,用了不到一個(gè)月吧,使我和母親對(duì)你們的產(chǎn)品質(zhì)量產(chǎn)生了想法。首先,收音機(jī)的輕觸式電子開關(guān)失靈,出現(xiàn)了打不開或自動(dòng)關(guān)機(jī)的現(xiàn)象;二是一對(duì)小音箱中的一只(帶電源開關(guān)的)莫名其妙地不工作了,而且音源輸入、輸出線插頭接觸不良。這些現(xiàn)象是在我們按產(chǎn)品使用說明書的操作時(shí)產(chǎn)生的!

以上狀況,是我為你們的產(chǎn)品質(zhì)量深感遺憾!

我母親的收音機(jī)出現(xiàn)問題后,恰巧逢她去蘭州出差,所以就帶著收音機(jī)去蘭州的維修點(diǎn),那里的人說這種問題他們第一次碰到,隨后就換了一臺(tái)新的,也未做任何說明(指問題的原因)。

由于音箱是買給我用的,而且問題的出現(xiàn)也比收音機(jī)較晚,加之我工作繁忙,直到這天才有機(jī)會(huì)撥了個(gè)用戶熱線電話給你們。接電話的是位女士,她也說此問題是你們頭一次聽說,并回答說能夠換一對(duì)音箱給我。

總經(jīng)理,我覺得你們公司的售后服務(wù)做得的確不錯(cuò),首先是態(tài)度好,但產(chǎn)品質(zhì)量是企業(yè)的生命,我也是一名企業(yè)員工,對(duì)此我深有體會(huì):售后服務(wù)做得再好,產(chǎn)品質(zhì)量但是硬,試問,你們換得起退得起賠得起嗎

事件起因:20xx年10月30上午八點(diǎn)大大小小2人抵達(dá)海口,入住濱海大道凱風(fēng)酒店1118號(hào)房間.一本地朋友帶來一張旅游宣傳單張,并幫我們聯(lián)系了宣傳單張上的業(yè)務(wù)人員安x(聯(lián)系電話:1397600****)。10:30左右我們與安x在凱風(fēng)酒店1118號(hào)房簽定了一份旅游協(xié)議,并交款400元2人,報(bào)名參加海口-三亞三天兩晚的純玩旅行團(tuán)。簽定協(xié)議時(shí),安x先生不愿寫明詳細(xì)行程,以防萬一,大大小小還是請(qǐng)其簡(jiǎn)明扼要的寫一下。因?qū)ε笥训男湃渭扒懊娴男谐探Y(jié)束后我們還想在海口多玩幾天,仍需參團(tuán),所以當(dāng)時(shí)沒有索取發(fā)票。誰知,旅行途中發(fā)生了極不愉快的事情,致使我們務(wù)必向貴部門投訴以下幾點(diǎn):

一、導(dǎo)游素質(zhì)低下、態(tài)度惡劣。

10月31日7:30我們至新港碼頭上了一輛車牌號(hào)為“瓊b03***”的旅行大巴,9:30左右車開動(dòng)后見到我們此行的導(dǎo)游王x(聯(lián)系電話:1397608****)。

1、無導(dǎo)游證。

途中發(fā)生不愉快后,旅行團(tuán)團(tuán)員要求王x導(dǎo)游出示導(dǎo)游證,從始至終其未出示導(dǎo)游證,只是左顧而言他。

2、講解稀少,不主動(dòng)。

一路上王x導(dǎo)游的講解極其稀少,應(yīng)旅游團(tuán)員的請(qǐng)求,王x導(dǎo)游才開口說:下一站是**地,某地如何,請(qǐng)大家耐心等待。并在向大家介紹海口市區(qū)狀況時(shí),街道名報(bào)錯(cuò)。一些只能在車上觀賞的景點(diǎn),在即將到達(dá)時(shí)應(yīng)事先提醒游客,王x導(dǎo)游卻未予提醒,3、帶“親屬”同行。

同行之人中有王x導(dǎo)游的“妻子”。大大不能確定其身份,因剛上車時(shí)那女子說她與王x導(dǎo)游是剛認(rèn)識(shí)的;在同行一段時(shí)間后因需調(diào)解王x導(dǎo)游與團(tuán)友之間的沖突,該女子出面聲稱其是王的朋友;而在第三天,王x導(dǎo)游曾向大家說該女子是其“老婆”,讓人難辨真假。途中王x導(dǎo)游講解甚少其聲稱是嗓子問題(似乎有些沙啞,但與團(tuán)員爭(zhēng)吵時(shí),卻也中氣十足),而一路均與此女子說說笑笑。另我們團(tuán)成員27人,不含此女子。該女子吃飯住宿均與導(dǎo)游王x一齊。

4、無端增加收費(fèi)。

10月31日晚入住興隆“金新山莊”時(shí),導(dǎo)游王x要求旅游團(tuán)員每人交納120元的旅游基金,不交錢的人不給安排住宿。晚上19:00已到達(dá)金新山莊,20:30之后有團(tuán)員忍受不了旅途的勞累,交了錢才開始入住。大大小小2人還有浙江溫州來的6位老人在一再提出抗議后,王x導(dǎo)游同意降價(jià),于是21:40,大大小小交了120元,6位老人交了240元之后才安排住宿。(每人每一天20元,大大小小參的是3天兩晚的團(tuán),交20*3*2=120元;6位老人參的是2天一晚的團(tuán),交20*2*6=240元。不知這20元的標(biāo)準(zhǔn)源自何處)

5、拋開游客,提前下車。

王x導(dǎo)游與其夫人在尚距海口約半個(gè)多小時(shí)路程的路途中下車,并沒有盡其義務(wù)陪游客走完全程。

除以上主要問題外,另一些小問題一并提出。

1、轉(zhuǎn)團(tuán)未通知游客。途中與團(tuán)友交談時(shí)才得知有報(bào)名參加“中國青年旅行社”,有參加“中國旅行社”,還有其他一些旅行社。而承接此次行程的旅行社我到最后未得到答案;

2、時(shí)間安排不到位。安x通知我們10月30日早7:30在酒店門口等車即可。而事實(shí)是7:30我們?cè)诰频觊T口等車不至,由安x帶我們走到新港碼頭上車,并等到9:30左右才開始此次游程;11月1日在大東海約定集合時(shí)間12:00,車不至,等至12:30分;

存在的問題如下:

一、不能出示《竣工驗(yàn)收備案表》

我們的購房合同上明明規(guī)定:該商品房經(jīng)綜合驗(yàn)收合格后才能交付使用,根據(jù)鄭州市政府的有關(guān)規(guī)定該商品房經(jīng)五大主體驗(yàn)收后報(bào)市建委,市建委發(fā)放竣工驗(yàn)收備案文件才算綜合驗(yàn)收合格。根據(jù)建設(shè)部《房屋建筑工程和市政基礎(chǔ)設(shè)施工程竣工驗(yàn)收備案管理暫行辦法》的規(guī)定,開發(fā)商應(yīng)當(dāng)自竣工驗(yàn)收合格之日起15日內(nèi),向工程所在地的縣級(jí)以上地方人民政府建設(shè)行政主管部門(以下簡(jiǎn)稱備案機(jī)關(guān))備案。備案機(jī)關(guān)收到開發(fā)商報(bào)送的齊全的竣工驗(yàn)收備案文件后,向其發(fā)放該商品房的《建設(shè)工程竣工驗(yàn)收備案表》。而且相關(guān)法規(guī)還規(guī)定建設(shè)工程經(jīng)驗(yàn)收合格的,方可交付使用。但是在不具備交房條件的情況下自8月xx開始開發(fā)商已經(jīng)陸陸續(xù)續(xù)交付了20多戶,而且還在偷偷交付那些不知情的業(yè)主,記者多次去采訪,追問他們?yōu)槭裁丛跊]有備案表的情況下交了房子,他們總把責(zé)任推到業(yè)主身上,說是業(yè)主強(qiáng)力要求交房的,事實(shí)上是大部分業(yè)主都不太懂交房的手續(xù),當(dāng)聽到他們電話通知說房子好了,就過去把房子收了,有些懂點(diǎn)法律知識(shí)的就沒有接他們的房子而是開始投訴,8月xx開始通知業(yè)主收房,當(dāng)時(shí)連五大主體驗(yàn)收的材料也沒有,而且當(dāng)時(shí)樓盤被施工方包圍(聽施工方說是開發(fā)商欠他們的工錢)我們業(yè)主根本進(jìn)不了房子,直到9月xx號(hào)我們才在售樓部看見一份復(fù)印的五大主體驗(yàn)收資料,但誰也沒有見到過《竣工驗(yàn)收備案表》。沒有《竣工驗(yàn)收備案表》,我們難免懷疑房屋質(zhì)量有問題,而且很擔(dān)心房產(chǎn)證辦不下來

“xx公寓”5號(hào)樓自2003年開工至今已經(jīng)建了整整四年,一樓六層小樓能建4年都沒有完工,我們大部分業(yè)主早在2003年就購買了“xx公寓”5號(hào)樓的房子,而且當(dāng)時(shí)沒有看見他們的任何預(yù)售證件,后來他們才補(bǔ)了幾個(gè)證件,我們當(dāng)時(shí)簽的草購房合同上規(guī)定的交房日期是2005年12月31號(hào),到簽正式的合同時(shí)開發(fā)商卻單方面修改了交房合同到20xx年6月30號(hào)。中間不知何故停工了好幾次,而且每次都停好長(zhǎng)時(shí)間。然而即便是這樣,到了20xx年6月30號(hào),開發(fā)商還是沒能交房,電話通知說到20xx年7月30號(hào),到了20xx年7月30號(hào),他們電話通知讓8月xx號(hào)以后過去交房,到8月17號(hào)我們?cè)俅稳r(shí),發(fā)現(xiàn)樓盤被施工房包圍,我們連房門都進(jìn)不了,后來我們跟施工房協(xié)商他們讓我們進(jìn)去一個(gè)人看房,發(fā)現(xiàn)水電不通、地漏沒做、弱電沒走、房間內(nèi)是大窟窿小眼睛的、墻壁是凸凹不平,紗窗沒按,窗戶傾斜嚴(yán)重,外面的路面沒有硬化,更沒有綠化。到交房處找他們工作人員,他們出具不了任何有關(guān)房屋質(zhì)量的文件,甚至連五大主體的自驗(yàn)報(bào)告都沒有。他們解釋說五大主體已經(jīng)驗(yàn)收過了,但五大主體并沒有蓋章,自那天開始我們開始投訴和交涉。他們又說推遲到9月15號(hào)全部整好,到了9月15號(hào),我們發(fā)現(xiàn)這中間雖然他們做了一定的工作但還存在很多問題,雖然五大主體驗(yàn)收?qǐng)?bào)告下來了,但沒有市建委的任何書面的材料,我們?nèi)ナ薪ㄎ稍儯薪ㄎ饛?fù)說根本不知道有“xx公寓”5號(hào)樓的事,而他們的五大主體驗(yàn)收?qǐng)?bào)告上簽名時(shí)間卻是20xx年7月6號(hào),他們并沒有向市建委遞任何資料。不知我們還要等多長(zhǎng)時(shí)間才能看到市建委的備案表下來,眼看最佳裝修季節(jié)就要過去,等到了12月份或者明年1月份再接房,因天冷無法裝修我們還要再拖一年才能住進(jìn)我們的新房,而這些業(yè)主大部分是在外租房,每家都有不同程度的困難。

三、不能出示《面積實(shí)測(cè)表》

根據(jù)建設(shè)部《商品房銷售管理辦法》第三十四條規(guī)定:房地產(chǎn)開發(fā)企業(yè)應(yīng)當(dāng)在商品房交付使用前按項(xiàng)目委托具有房產(chǎn)測(cè)繪資格的單位實(shí)施測(cè)繪,測(cè)繪成果報(bào)房地產(chǎn)行政主管部門審核后用于房屋權(quán)屬登記。沒有《面積實(shí)測(cè)表》,我們難免懷疑房屋面積有問題。

四、前期物業(yè)管理公司選聘和管理問題

xx公寓的前期物業(yè)管理是由開發(fā)商(鄭州宇泰置業(yè)有限公司)自己組建的物業(yè)管理有限公司承擔(dān)的。根據(jù)國務(wù)院《物業(yè)管理?xiàng)l例》第二十四條規(guī)定:住宅物業(yè)的`建設(shè)單位,應(yīng)當(dāng)通過招投標(biāo)的方式選聘具有相應(yīng)資質(zhì)的物業(yè)管理企業(yè);投標(biāo)人少于3個(gè)或者住宅規(guī)模較小的,經(jīng)物業(yè)所在地的區(qū)、縣人民政府房地產(chǎn)行政主管部門批準(zhǔn),可以采用協(xié)議方式選聘具有相應(yīng)資質(zhì)的物業(yè)管理企業(yè)。不知xx公寓是否按照上述法定程序選聘前期物業(yè)管理公司。但我們對(duì)現(xiàn)在的物業(yè)管理公司很不滿意,現(xiàn)在物業(yè)公司把房子大門鎖上,不收鑰匙不讓業(yè)主看房子,嚴(yán)重侵犯了業(yè)主的探視權(quán),難道說我們掏了幾十萬買房子連看房的權(quán)利都沒有嗎?

五、移交房鑰匙時(shí)的收費(fèi)

移交鑰匙時(shí)開發(fā)商讓交了如下費(fèi)用:垃圾清運(yùn)費(fèi):300元;裝修押金:xx00元;一年的物業(yè)管理費(fèi)(按每平方0.2元收的);單元房門的對(duì)講機(jī)費(fèi)用:180元;電話初裝費(fèi):58元;有線電視初裝費(fèi):265元。當(dāng)時(shí)開發(fā)商沒有主動(dòng)出示市物價(jià)局的收費(fèi)許可證,所以我們也不知道他們有沒有收垃圾清運(yùn)費(fèi)和屋業(yè)管理費(fèi)等的權(quán)利。另外垃圾清運(yùn)費(fèi)和裝修押金的收據(jù)都開成裝修押金只是口頭說1300元中有300的垃圾清運(yùn)費(fèi),將來不再退回。

六、購房合同中的霸王條款和模糊條款

通觀整個(gè)合同內(nèi)容,存在嚴(yán)重的不平等現(xiàn)象。模糊條款和霸王條款都存在,業(yè)主違約要交付總房款萬分之一的違約金,而在同等條件下開發(fā)商違約卻只付總房款萬分之0.5的違約金;關(guān)于收房時(shí)房屋達(dá)到的標(biāo)準(zhǔn)規(guī)定過于模糊,地下室安裝門和單元房門的對(duì)講機(jī)都沒有在合同中規(guī)定,開發(fā)商解釋說既然合同沒有規(guī)定那他們理解就是沒有,但我們業(yè)主理解附件對(duì)于主體工程來說就象上衣和扣子的關(guān)系,我們不可能買一件沒有口子的上衣。

七、挪用我們的維修基金和天然氣費(fèi)用

開發(fā)商在我們交房款的時(shí)候,就收取了契稅、維修基金和天然氣初裝費(fèi)以及其他雜費(fèi),且都存入了開發(fā)商自己的帳戶,這樣他們提前2—4年收去這些費(fèi)用,但維修基金和天然氣費(fèi)用卻在我們投訴后才在近期交了上去,這些費(fèi)用都被他們挪用了,國家相關(guān)法律規(guī)定禁止任何單位代收和挪用房屋維修基金,如果帶收的,必須在收上后30個(gè)工作日交到房管局。但他們直到20xx年9月份才在我們的投訴下交了這筆費(fèi)用。

以上幾個(gè)方面的問題涉及到土地、建設(shè)、物價(jià)等多個(gè)行政主管部門,敬請(qǐng)政府能夠從替群眾排憂解難的角度出發(fā),協(xié)調(diào)上述行政主管部門對(duì)我們所反映的諸多問題進(jìn)行調(diào)查、了解,如確情況屬實(shí),希望各主管部門行使監(jiān)督職能,督促開發(fā)商盡快做好以下工作:

1、盡快上報(bào)驗(yàn)收資料,并給我們一個(gè)確切的《建設(shè)工程竣工驗(yàn)收備案表》下達(dá)時(shí)間。

2、對(duì)于遲遲不能交房的違約金給予支付,盡可能的化解廣大業(yè)主的怨氣。

3、請(qǐng)求政府及各相關(guān)職能部門出面對(duì)于鄭州宇泰置業(yè)有限公司違規(guī)交房進(jìn)行嚴(yán)厲的警告和處罰。

4、請(qǐng)求政府及各相關(guān)職能部門出面警告開發(fā)商以后不要再欺騙老百姓,不要再空手套白狼、不要再挖東墻補(bǔ)西墻。

畢竟買房對(duì)于大部分人來說都是掏空了所有的積蓄和心血甚至舉債才辦的大事,涉及到老百姓很千千萬萬的家庭能否安居樂業(yè)的大事,這些家庭又是我們這個(gè)和諧社會(huì)的基石!

20xx年10月17日一汽-大眾汽車有限公司宣布召回563,605輛一汽-大眾新速騰,召回方案為在受影響的車輛后懸架縱臂上安裝金屬襯板。從召回公告中對(duì)加裝金屬襯板的作用來分析,“在車輛后軸縱臂上安裝金屬襯板”這一相當(dāng)于給汽車“打補(bǔ)丁”的召回措施,并不能根本解決后懸架斷裂問題,不能徹底消除后懸架斷裂所帶來的不安全風(fēng)險(xiǎn)。

20xx年10月24日大眾在媒體溝通會(huì)上又明確表示為新速騰后懸架縱臂加裝金屬襯板是目前最理想的解決方式,并不建議更換懸掛,因?yàn)榭赡軒砀嗟牟淮_定因素。如果加裝金屬襯板不能徹底消除安全隱患且又不能更換***懸掛,大眾又沒有其他解決辦法有效消除后懸架斷裂風(fēng)險(xiǎn),就應(yīng)當(dāng)根據(jù)《缺陷汽車產(chǎn)品召回管理?xiàng)l例》第十九條之規(guī)定采取退車的方式徹底消除風(fēng)險(xiǎn)。

《中華人民共和國消費(fèi)者權(quán)益保護(hù)法》第四十七條之規(guī)定,“對(duì)侵害眾多消費(fèi)者合法權(quán)益的行為,中國消費(fèi)者協(xié)會(huì)以及在省、自治區(qū)、直轄市設(shè)立的消費(fèi)者協(xié)會(huì),可以向人民法院提起訴訟”。據(jù)大眾官方統(tǒng)計(jì)搭載耦合桿式后懸架的新速騰車共計(jì)563,605臺(tái),受侵害的消費(fèi)者人數(shù)眾多,符合該條規(guī)定的由消費(fèi)者協(xié)會(huì)提起訴訟的條件,因此,特請(qǐng)求貴協(xié)會(huì)向被投訴人提起訴訟。

本人向聯(lián)通公司提出,在12月12日出國前,本人向聯(lián)通公司提出開通短期國際漫游服務(wù),其客服人員還特意提醒,替本人關(guān)閉轉(zhuǎn)移呼叫、上網(wǎng)等相關(guān)容易發(fā)生高額國際漫游費(fèi)用的項(xiàng)目功能,待回國后再開通恢復(fù)這些功能,本人為其為消費(fèi)者著想的服務(wù)態(tài)度表示感謝;到達(dá)國外后,多次收到聯(lián)通公司的短信提醒,告知本人在所處地區(qū)的通話及短信資費(fèi)標(biāo)準(zhǔn),正因?yàn)檫@些周到的提醒服務(wù),使本人在使用國際長(zhǎng)途漫游功能時(shí),心中有數(shù)。但本人此次旅行是乘坐皇家加勒比游輪公司的“海洋神化號(hào)”豪華游輪的海上旅行,在海上的通話資費(fèi)變化并未得到任何的提醒,以致短短的幾個(gè)通話,居然要發(fā)生兩千七百多元的費(fèi)用!本人表示對(duì)這種對(duì)消費(fèi)者不進(jìn)行明示告知的消費(fèi),聯(lián)通公司應(yīng)該承擔(dān)相應(yīng)的責(zé)任。

基于聯(lián)通公司表示此項(xiàng)海上衛(wèi)星通訊收費(fèi)是代收代付的,本人表示愿意支付此次高額話費(fèi),但希望聯(lián)通公司用贈(zèng)送通話時(shí)間的方式,來補(bǔ)償此次不愉快的事件,并希望聯(lián)通公司今后能預(yù)先告知此項(xiàng)高額收費(fèi),或通過公眾傳媒的方式來溫馨提醒,以避免先今流行的海上豪華游輪旅游,消費(fèi)者很容易因不知情而發(fā)生此類高額海上通訊費(fèi)用。

但經(jīng)過兩次與其客服人員的投訴建議,昨天本人接到聯(lián)通公司客服的最后告知,聯(lián)通公司對(duì)此事件不承擔(dān)任何責(zé)任,要求本人限期繳納此高額話費(fèi),并表示不會(huì)以任何方式向社會(huì)公眾溫馨告示。

寫投訴信應(yīng)本著真實(shí)的原則,如實(shí)的反映情況,根據(jù)1991年國家旅游局頒布的《旅游投訴暫行規(guī)定》,投訴信應(yīng)包括以下幾部分:

旅游投訴信(一)

事件起因:20xx年10月30上午八點(diǎn)大大小小2人抵達(dá)海口,入住濱海大道凱風(fēng)酒店1118號(hào)房間。一本地朋友帶來一張旅游宣傳單張,并幫我們聯(lián)系了宣傳單張上的業(yè)務(wù)人員安剛(聯(lián)系電話:********、*******)。10:30左右我們與安剛在凱風(fēng)酒店1118號(hào)房簽定了一份旅游協(xié)議,并交款400元/2人,報(bào)名參加海口-三亞三天兩晚的純玩旅行團(tuán)。簽定協(xié)議時(shí),安剛先生不愿寫明詳細(xì)行程,以防萬一,大大小小還是請(qǐng)其簡(jiǎn)明扼要的寫一下。因?qū)ε笥训男湃渭扒懊娴男谐探Y(jié)束后我們還想在海口多玩幾天,仍需參團(tuán),所以當(dāng)時(shí)沒有索取發(fā)票。誰知,旅行途中發(fā)生了極不愉快的事情,致使我們必須向貴部門投訴以下幾點(diǎn):

一、導(dǎo)游素質(zhì)低下、態(tài)度惡劣。

10月31日7:30我們至新港碼頭上了一輛車牌號(hào)為“瓊B03760”的旅行大巴,9:30左右車開動(dòng)后見到我們此行的導(dǎo)游王洋(聯(lián)系電話:*******)。

1、無導(dǎo)游證。

途中發(fā)生不愉快后,旅行團(tuán)團(tuán)員要求王洋導(dǎo)游出示導(dǎo)游證,從始至終其未出示導(dǎo)游證,只是左顧而言他。

2、講解稀少,不主動(dòng)。

一路上王洋導(dǎo)游的講解極其稀少,應(yīng)旅游團(tuán)員的請(qǐng)求,王洋導(dǎo)游才開口說:下一站是**地,某地如何,請(qǐng)大家耐心等待。并在向大家介紹海口市區(qū)情況時(shí),街道名報(bào)錯(cuò)。一些只能在車上觀賞的景點(diǎn),在即將到達(dá)時(shí)應(yīng)事先提醒游客,王洋導(dǎo)游卻未予提醒。

3、帶“親屬”同行。

同行之人中有王洋導(dǎo)游的“妻子”。大大不能確定其身份,因剛上車時(shí)那女子說她與王洋導(dǎo)游是剛認(rèn)識(shí)的;在同行一段時(shí)間后因需調(diào)解王洋導(dǎo)游與團(tuán)友之間的沖突,該女子出面聲稱其是王的朋友;而在第三天,王洋導(dǎo)游曾向大家說該女子是其“老婆”,讓人難辨真假。途中王洋導(dǎo)游講解甚少其聲稱是嗓子問題(似乎有些沙啞,但與團(tuán)員爭(zhēng)吵時(shí),卻也中氣十足),而一路均與此女子說說笑笑。另我們團(tuán)成員27人,不含此女子。該女子吃飯住宿均與導(dǎo)游王洋一起。

4、無端增加收費(fèi)。

10月31日晚入住興隆“金新山莊”時(shí),導(dǎo)游王洋要求旅游團(tuán)員每人交納120元的旅游基金,不交錢的人不給安排住宿。晚上19:00已到達(dá)金新山莊,20:30之后有團(tuán)員忍受不了旅途的勞累,交了錢才開始入住。大大小小2人還有浙江溫州來的6位老人在一再提出抗議后,王洋導(dǎo)游同意降價(jià),于是21:40,大大小小交了120元,6位老人交了240元之后才安排住宿。(每人每天20元,大大小小參的是3天兩晚的團(tuán),交20*3*2=120元;6位老人參的是2天一晚的團(tuán),交20*2*6=240元。不知這20元的標(biāo)準(zhǔn)源自何處)

5、拋開游客,提前下車。

王洋導(dǎo)游與其夫人在尚距海口約半個(gè)多小時(shí)路程的路途中下車,并沒有盡其義務(wù)陪游客走完全程。

除以上主要問題外,另一些小問題一并提出。

1、轉(zhuǎn)團(tuán)未通知游客。途中與團(tuán)友交談時(shí)才得知有報(bào)名參加“中國青年旅行社”,有參加“中國旅行社”,還有其他一些旅行社。而承接此次行程的旅行社我到最后未得到答案;

2、時(shí)間安排不到位。安剛通知我們10月30日早7:30在酒店門口等車即可。而事實(shí)是7:30我們?cè)诰频觊T口等車不至,由安剛帶我們走到新港碼頭上車,并等到9:30左右才開始此次游程;11月1日在大東海約定集合時(shí)間12:00,車不至,等至12:30分;

3、降低住宿酒店的星級(jí)。簽定協(xié)議時(shí),業(yè)務(wù)安剛注明了是三星級(jí)賓館。而11月1日在三亞入住的賓館“南方海韻酒店”根本沒有所謂的星。

1、旅游參團(tuán)協(xié)議書;

2、宣傳單張正面;

3、宣傳單張反面;

4、10月31日住金新山莊發(fā)生糾紛時(shí)大大手寫的經(jīng)過和團(tuán)友的簽名及本次旅行團(tuán)各團(tuán)員的聯(lián)系電話;

上海悅途旅行社:

我們是貴社組織的20**年9月18日至20**年9月21日,“上海世博,蘇州+烏鎮(zhèn),杭州雙動(dòng)四日游”旅行團(tuán)的成員。由于貴社梁巖峰導(dǎo)游不負(fù)責(zé)的行為,給我們的此次旅游留下了無限的遺憾,因此,我們決定投訴,維護(hù)我們的權(quán)益。我們投訴的內(nèi)容及理由如下:

1、合同上標(biāo)明世博游滿8個(gè)小時(shí),但是20**年9月19日早上我們11點(diǎn)下車的,16點(diǎn)30分集合出園,整個(gè)過程(包括排隊(duì)等候安檢)才5個(gè)半小時(shí),導(dǎo)致我們沒有充分的時(shí)間游覽許多場(chǎng)館。

2、合同上沒有標(biāo)明夜游七里山塘,但是導(dǎo)游卻極力慫恿我們于20**年9月19日晚去游玩,去的人,每人交門票費(fèi)100元;“不去的人呆車上等著,門關(guān)著,空調(diào)不開,車就停路邊”(如此威脅我們)。炎炎夏日,緊閉車門,不開空調(diào),誰受得了,于是很多人沒辦法只好交錢進(jìn)行所謂的“夜游七里山塘”。

3、對(duì)所游覽的景點(diǎn)進(jìn)行講解是導(dǎo)游的`基本責(zé)任,但是貴社的梁導(dǎo)幾乎沒有對(duì)景點(diǎn)進(jìn)行講解。特別是游烏鎮(zhèn)的時(shí)候,他沒有請(qǐng)副導(dǎo),自己帶隊(duì),也不帶麥克風(fēng)。所有的景點(diǎn)都沒有講解。給我印象最深的就是,到達(dá)百床館時(shí),他就說了一句:“這是百床館,要進(jìn)去的人進(jìn)去看,不進(jìn)去的就接著走。”很多人都進(jìn)去了,他自己就呆在外頭等我們。其他所有的景點(diǎn)都跟這差不多,都是我們自己進(jìn)去瞎看,他在外頭等。為了對(duì)烏鎮(zhèn)的文化有點(diǎn)了解,我們團(tuán)中很多人都跟著其他有講解的旅游團(tuán)走了,這導(dǎo)致了整個(gè)團(tuán)三十幾個(gè)人七零八落,到處散落,你等我,我等你,沒有一點(diǎn)組織性。最后,我們只走了東柵就回去了,西柵一點(diǎn)也沒游。烏鎮(zhèn)是一個(gè)文化氣息很濃的地方,只走馬觀花般的看了一半,而且沒有講解,除了幾張照片,給我們留下的只是無限的遺憾。

4、20**年9月21日的西湖一游,我們從11點(diǎn)40分下車到達(dá)西湖,12點(diǎn)50分出西湖,整個(gè)行程才1個(gè)小時(shí)10分鐘,除去坐船30多分鐘,只有不到40分鐘的時(shí)間在岸上,如此短暫的時(shí)間,西湖我們能游多少?!事實(shí)上,我們從上岸后只到了花港觀魚下面一點(diǎn)點(diǎn)就回去了。

綜上所述,貴社導(dǎo)游不負(fù)責(zé)任的行為使我們這趟旅游留下了無限的遺憾,在此,我們要求全額退款。旅游本來是一件很享受的事情,可是貴社梁巖峰導(dǎo)游的惡劣行徑使我們憋了一肚子的氣,更別說享受旅途的樂趣了。因此,我們決定在向工商局、旅游質(zhì)量監(jiān)督管理所等部門投訴之前先向貴社反映情況。希望貴社能夠給我們一個(gè)滿意的答復(fù)。

如果消費(fèi)者在遇到商品質(zhì)量問題,向生產(chǎn),經(jīng)銷企業(yè)反映問題解決不了的情況下,可能就會(huì)想到告狀,打官司。無論是到商店的主管部門,技術(shù)監(jiān)督部門,消費(fèi)者協(xié)會(huì),工商行政管理部門投訴,還是到人民法院投訴,一般都要遞交書面投訴書,或起訴狀,這樣能更好清楚表達(dá)自己的意愿和要求,便于受理機(jī)關(guān)審理案件。也可以向有管轄權(quán)部門的接待人員口頭提出投訴要求,由有關(guān)工作人員做好筆錄,原告人簽字或蓋章以后就完成了口頭投訴的手續(xù)。

題頭應(yīng)寫:起訴狀,訴狀或投訴書。

在題頭下面應(yīng)寫明自己所投訴的問題性質(zhì)和種類。如:“假冒名牌”,“摻假是假”等。

接著寫明投訴的`內(nèi)容,反映的問題。這部分要實(shí)事求是,一目了然,不能含糊不清,不要因?yàn)闅鈶嵒驊延胁徽?dāng)目的,隨便夸大事實(shí)或縮小事實(shí),給解決問題帶來困難。

最后寫明投訴者的意見,這部分內(nèi)容要合情合理,不可無理取鬧,刁難別人;引用有關(guān)規(guī)定要準(zhǔn)確,不要斷章取義,同時(shí)要提出準(zhǔn)確的證據(jù),投訴書還要寫明:a

投訴人的姓名,性別,單位,民族,職業(yè),住址;b 被投訴人的姓名,單位;c 證據(jù)材料,證人姓名,投訴時(shí)間。
