一、從個人角度出發，網絡購物讓個

二、從社會和國家出發。網絡商店無

調查：

在我們的調查中，不少被訪者認為網上購物既方便又齊全，但也有被訪者反映了網上購物的商品信息不齊全，很多商品都是拿官方雜志的圖片混淆消費者等問題。個案一：小方，女，28歲，江門臺山人，自由職業者 “我覺得網上購物弊大于利。大部分網店都是標榜韓國等海外的官方圖片，以漂亮的效果圖混淆消費者，而商品卻是仿制品，這就讓我們消費者買得不安心，很多理性消費者都會選擇小額消費。” 個案二:黃先生，男，40歲，江門人，某服裝店老板

“網上購物不能看到實物，衣物等物品也不能試穿，黑心賣家還會以次充好，把瑕疵品賣給買家。一方面，交易不安全，在實體店買賣都是現金交易，而在網上購物卻要款到發貨，根本不確定賣方是否能誠信交易；另一方面，維修困難。當你在網上購買了數碼產品，使用出現故障了，你是否能得到聯保的保修服務。”

個案三：小陳，男，22歲，江門人，五邑大學學生

“我曾在網上購買50元充值卡，買回來后發現卻是30元充值卡，一直也聯系不上賣家，所以在網上購物存在很大風險，經營者多用虛擬網名注冊，經營者的真實身份、住所等信息無法予以確認，很多網上交易又是跨省市的異地交易，給受理和查處帶來困難，使消費者的損失難以被追回。”

網絡購物的弊端分析

我們在看到網上購物優點的同時更要認清它在現階段存在的問題，以便盡早地找到解決方案以促進網上購物的良性發展。可以說，現階段我國消費者對網上購物狀況的評價是“痛并快樂著”，而這其中痛的指數要高于快樂指數。

第一、交易對象認定的模糊性。明確交易對象對于消費者來說是非常重要的事情，這關系到法律責任的承擔問題。在傳統購物環境下交易對象非常明確，商店里掛的營業執照就表明了經營者的身份。一旦出了問題可以直接到原購物地點追討責任。但是在網絡環境下，消費者只有通過經營者網站中提供的信息了解對方，但是至于信息是否真實、對方到底是誰根本不清楚。

第二、知情權難以保證。知情權是消費者享有的一項基本權利也是一項重要權利。然而上網購物時，消費者獲取信息的范圍是有限的，它并不像傳統購物時能看到、摸到真實立體的商品，并向售貨員詳細打聽有關商品的基本情況。此時的消費者只能從網上提供的內容中獲取有關商品的部分信息，看到的充其量也就是一張或幾張關于商品的平面照片。因此，網上購物的消費者一般對商品信息的了解都是缺失的。

第三、格式合同的制約。由于網上購物的特殊性，格式合同不可避免地成了消費者和經營者達成合意的必要環節。現在的問題是經營者往往利用特權制定一些又長又復雜甚至危害消費者權利的條款，有時為逃避責任還會使用一些模棱兩可的語言，一旦出了問題會以此為自己辯解。消費者有時為了圖省事不會仔細閱讀每一條款，有時就算讀了也很有可能領會不到其中的微妙之處，有時即便發現有什么可疑的地方但為了及時買到所需商品也無所顧忌，因此，有時一個“我同意”的點擊會給消費者帶來了購物后一系列的麻煩。

第四、交貨延遲。付款后不能按期收到貨物的事屢見不鮮，有時付款后收不到貨物的情況也會出現。第五、退貨困難。網上購得的貨物想要退掉并不是件容易的事，經營者往往找種種理由拒絕退貨。有時甚至直接在格式合同中明文規定某些商品不得退貨。對于在退貨范圍內的商品，通過經營者的規定看也根本無法退換。

第六、網上欺詐與虛假廣告。互聯網技術使得某些商家可通過匿名的方式躲避調查，利用監管難度大、隱蔽性強、傳播快的特點大行虛假廣告和欺詐之道，它們往往打著“跳樓價”“超值大獎等你拿”一類的旗號吸引消費者的眼球，借機侵犯消費者的權益而為自己牟利。

第七、無人問津的售后服務。許多網民表示，網上購物的售后服務較差，有時商品出了問題經營者能推則推，就算有售后服務也只是表面應付一下，許多問題根本得不到實質解決。

第八、處于危機中的隱私權。這個問題是現在大家廣泛關注的問題，也是挑戰網絡安全的主要大敵。一些商家為了擴大銷售額，不惜將以前消費者的信息建立數據庫，根據其經濟狀況、上網習慣等不停轟炸消費者的郵箱以推銷自己的產品；更有甚者，為了眼前的經濟利益將消費者的信息賣給他人。此外，消費者的信用卡賬號、密碼被篡改、被盜也是常有的事。所有這些問題如果不能及時有效地解決，肯定會制約未來網上購物的進一步發展。

當今信息產業高速發展，商品借助網絡產生了一種新的交易方式——網絡購物，今天很高興和對方辯友共同探討網絡購物利弊的問題，我方觀點是網絡購物弊大于利，首先，我們明確這樣的概念 ：網絡購物指的是通過互聯網檢索信息，并通過訂購者發出請求，通過第三方支付工具或銀行付款，通過郵寄方式或快遞公司配送的購物方式。今天我們研究利弊的對象，是看網絡購物對個人，對社會，乃至對國家是利是弊。

我們知道網絡購物需要大量的個人信息，而現在的網絡上個人信息外泄的現象越來越嚴重，甚至有人倒賣個人信息。再者，通過網絡進行購物，消費者難以知悉其商品和接受的服務的真實情況，由于網絡具有虛擬性，看得見卻摸不著，網絡消費者僅能憑著自己的感官或經驗去判定產品質量和性能。眾多消費者對網絡產品質量，性能了解是局部的，片面的。因此，包括因產品存在的瑕疵等質量問題而引發的糾紛時常發生。由于網絡購物無確定的發生地，交易地而導致消費者難以享有應有的售后服務，甚至國家三包政策都難以實現。當消費者的權益受到侵害時，由于網絡身份信息核實難，證據真偽辨別難，權利義務認定難的三大特點而導致消費者權益無法得到正當的維護。無論是網購的過程還是網購的結果無一不在告訴我們，網絡購物弊大于利。

第二、從社會層面上看，網絡購物引發了信譽，道德危機。

我們看到教我們開網店的書籍，毫不避諱地告訴我們如何將產品圖片修飾到美觀甚至夸張的程度；如何編寫能夠吸引甚至忽悠消費者的文字；如何將商家的信譽刷到一定的高度；如何刪除對商家不良的評論。當這些東西成了開網店的必修課時，我們的擔心還是多余的嗎？我們還看到，在網絡這一平臺上，走私水貨，販賣盜版等行為更加猖獗，他們瘋狂地擠占正牌商家的市場，使消費者想買真貨卻不敢買，當正牌商家想賣真貨卻賣不出，使合法商家的利益受到了沖擊。水貨，盜版等不良風氣的盛行，擾亂了市場的同時也必將對社會道德，社會秩序產生很大的不利影響。

第三、從國家的角度上看，對于網絡購物國家監管難度很大。

如今，我們看到了網絡購物不單單使消費者個人安全受到了威脅，還使社會出現危機，而國家卻又難以控制，所以，我方認為網絡購物弊大于利。對方辯友大家好！首先請允許我重申我方觀點：網絡弊大于利。首先，網絡中有相當多的色情和暴力信息與資源，這些信息與資源會使大學生的心理發生一定的變化，甚至影響他們的世界觀、人生觀、價值觀。其次，學生的自身特點之一是他們的自制能力不夠強，這就使他們沉迷于網絡，荒廢了學業，以后根本無法為祖國的建設貢獻出自己的力量。第三，上網需要一定的資金，會給家庭帶來不必要的開銷，而且很少有人能夠擁有屬于自己的電腦，那么他們上網的地點有一半以上都是在網吧，而網吧環境惡劣，也不利于他們的安全和身心發展。第四，由于網絡提供的信息和資源大部分是直接給出的，不利于大學生思考，不利于他們創新能力和思維的形成，導致他們沒有自己的主見和觀點。第五，很多人因為迷戀網絡而患有網絡依賴癥 依賴網絡，即使在網絡上沒有意思也要呆著 這對學生的身心健康都有危害。第六由于電腦一些的網絡軟件 使其產生依賴 最顯而易見的是QQ強迫癥 既然是強迫癥 就是不管怎樣都要掛著QQ 或者在里面消遣時間有甚者沉迷聊天搞起了網戀。，綜上所述，網絡對于學生弊大于利。謝謝大家！

尊敬的各位評委老師、各位同學以及對方辯友：

大家下午好，今天我方的觀點是：三峽大壩的弊端遠大于其利處。

眾所周知，我國三峽大壩于1994年正式動工，壩體高達185米，它的建造目的集中在防洪、發電和航運等方面。作為目前世界最大的水利發電工程，它的修建，引發了上至政府高官下至普通百姓，甚至國外人士的廣泛關注。所謂仁者見仁、智者見智，各方人士對于三峽大壩的修建從來都是針砭不一。對方一辯已經闡述了諸多好處，而我方從不否認這些利端，但是其弊端遠大于其利處。

首先，我想提醒對方辯友的是三峽大壩的防洪功能并沒有想象中那么如意，如果上游發水，三峽可以蓄水，但是中下游強降雨的話，這種直接的作用就不明顯。而且上游蓄水庫區泥沙淤積，三峽庫區的高漲水位將是懸在兩湖人民頭上的一顆定時炸彈。

進而是它引以為傲的蓄水通航。雖然從理論上說，河道深了，通航條件好了，會增加通航能力，但由于長時間大霧彌漫，實際通航能力，并不像我們當初想得那樣如意。三峽水庫蓄水后，三峽大壩阻礙長江航運的暢通。三峽水庫蓄水后，三峽兩線五級船閘的通過能力馬上得到飽和，運行的實踐證明，三峽兩線五級船閘的單向通過能力不可能達到每年五千萬噸，最多只能保證單向通過能力每年三千萬噸左右。目前長江貨運需要用機械翻壩來協助完成。原計劃在1997年完工的升船機至今未見蹤影，客輪過船閘的平均時間為七小時，乘客難以接受，造成長江客運和三峽旅游事業的萎縮。

三峽庫區很多地區的地層主要是土層，結構松散，在持續的暴雨影響下，土層會因為吸水而發脹，容易發生山體滑坡。近幾年，三峽庫區發生過一些較為嚴重的地質災害問題，如2007年夏季湖北巴東縣清太坪鎮的山體滑坡，2007年冬季湖北巴東縣野山關鎮的巖崩，2009年夏季湖北省興山縣高陽鎮的山體滑坡，這三起事件都造成嚴重的人員傷亡，給國家和人民的生命財產造成了很大的損失。

泥沙淤積也是一個令人頭疼的問題。長江每年要攜帶5億立方米的泥沙進入三峽，但其中大部分都無法排出去，水庫因此將出現淤塞，三峽大壩進而有可能垮塌。工程師在大壩底部設計了23道閘門用于在汛期沖走泥沙。但事實是泥沙淤積的速度高過了蓄水；大壩兩側山體嚴重滑坡，大量泥沙淤積于大壩內，大壩的蓄水能力與日劇減，抗洪能力也變成了笑話，下游數千萬人危如累卵。第三．水污染方面

由于江水被大壩阻攔，農業殘留物、生活及工業污染物無法順流而下排入大海，而是倒灌回水庫，使得庫區水體的污染不斷加重，并導致庫區的長江支流出現“水華”現象。這與政府所說的二類水質要求甚遠。第四．文化遺產和移民方面

在三峽地區，在這塊土地上曾存在燦爛的文化，留下了許多寶貴的遺產。三峽庫區蓄水后，長江沿岸的千年古鎮人文遺失，如涪陵白鶴梁、忠縣石寶寨、云陽張飛廟、奉節白帝。尤其是那些方言和地方戲曲無法再發展傳承，如川江號子幾乎絕跡。而且還迫使庫區500w農民搬遷到人口更加密集的沿江坡地上，他們一方面要靠著比以前更少的土地勉強維生，一方面還要面臨日益加重的土地侵蝕和塌方事故的致命威脅。

綜上所訴，我們可以明晰得出結論，也就是今天我方堅持的觀點：三峽大壩的修建功在當代，但利不在千秋，我方認為三峽項目的社會和生態成本過高。從長遠來看，他的影響甚至超過了它的益處，不符合當今可持續發展觀的主流觀點，三峽工程的其弊遠大于其利。

很高興在此與大家進行“在校大學生創業是利大還是弊大“的討論。我方的觀點是”利大于弊“。在校大學生，即在高等院校存在學籍的學生。創業，即創辦事業，它不只是個結果，更是一個過程。在校大學生創業，是指那些有奮斗理想，適合創業的大學生，通過創業來實現自己夢想的過程。時代的變遷賦予了當代大學生不一樣的涵義，也給予了當代大學生不一樣的生活、思想和追求，創業的可能向廣大在校學生提供了一條可行的發展道路，雖然大學生由于自身條件的缺陷，在這個過程中會遇到許多困難，但總的來說它是利大于弊的。

我將從幾個方面來論證我方的觀點。

第一，從學生自身來看，創業過程本身就是一個學習的過程，“紙上得來終覺淺，絕知此事要躬行“，專業知識學習與課外實踐相互結合，是知識經濟時代大學生充實自我的必由之路。創業不僅能提高大學生對專業知識的應用能力、實踐能力，更能提高大學生的創新意識和創新能力。加入到創業團體中，還可以培養他們的團隊精神和改善人際關系。因為年輕，大學生做事更投入，更有激情，更善于糾錯和學習，他們中的很多人就是在創業過程中積累經驗，健全心智的。

第三，上升到民族國家層面，最有競爭力的民族是最具有創新精神的民族。而在校大學生是最具探索精神和創新精神的人群之一，他們對新發明新創造具有最旺盛的活力，對高新科技具有最敏銳的觸覺，以及具有強烈的開拓進取意識。在校大學生嘗試創業，對民族創新能力的提升，對經濟發展新道路的開辟和產業模式的轉換都將產生重要的影響。
