《法官庭審行為規范、行政訴訟》觀后感

這周思修課學習的是與法律有關的內容，在老師的安排下，我們觀看庭審現場的視頻，可以說給我們提供了一個機會去接觸真正的司法實踐。通過觀看，我了解了一般的司法訴訟程序，也領略了法官，檢察官，辯護律師的風采，增長了許多法律知識。

第一個庭審案例講述的是：兩個從事文化管理相關工作的職員，甲方在相關文化部門工作，擁有一定職權。乙方在廣告公司工作，熟悉營銷制作。甲在工作單位有參與決策權，當他看到邀請相關企業參加學術交流性的會議可以收取許多費用時，就心生貪念，想通過自己的虛假策劃來騙取錢財。于是，他就找到了有策劃經驗的乙方，二人假借國家某些協會的名義發布邀請函，偽造印章，詐騙錢財。

這個案例的兩人犯了偽造、變造、買賣國家機關公文、證件、印章罪。指非法制造、變造、買賣國家機關公文、證件、印章的行為。本罪在客觀方面表現為偽造、變造、買賣國家機關公文、證件、印章的行為。所謂偽造，是指無權制作者制作假的公文、證件或印章，既包括根本不存在某一公文、證件或印章而非法制作出一種假的公文、證件和印章，又包括在存在某一公文、證件或印章的情況下而模仿其特征而復印、偽造另一假的公文、證件或印章。既包括非國家機關工作人員的偽造或制作，又包括國家機關工作人員未經批準而擅自制造。另外，模仿有權簽發公文、證件的負責人的手跡簽發公文、證件的，亦應以偽造論處。所謂變造，則是對真實的公文、證件或印章利用涂改、擦消、拼接等方法進行加工、改制，以改變其真實內容。所謂買賣，即對國家機關公文、證件或者印章實行有償轉讓，包括購買和銷售兩種行為。至于買賣的公文、證件或印章，既可以是真實的，也可以是偽造或者變造的。根據相關法律條款，偽造、變造、買賣或者盜竊、搶奪、毀滅國家機關的公文、證件、印章的，處三年以下有期徒刑、拘役、管制或者剝奪政治權利；情節嚴重的，處三年以上十年以下有期徒刑。

第二個庭審案例：春節聯歡晚會中劇本、音樂等作品侵犯他人著作權的問題，在現實生活中出現了較多案例，如李麗霞訴李剛、陳紅、蔡國慶侵犯鄰接權、錄音制作合同糾紛案，李麗霞認為她作為那一年春晚作品《常來常往》伴奏錄音制品的共有人，對該伴奏錄音制品的編曲享有相應的著作權和鄰接權，曲作者李剛未經同意，將該伴奏錄音制品轉讓給他人使用并從中牟利，陳紅、蔡國慶明知該歌曲伴奏錄音制品存在權利瑕疵，但仍使用和播放，侵犯了她的著作權和鄰接權。法院最終認定李麗霞所主張的編曲權即是著作權法中的錄音制作者權，雖然李麗霞確曾為伴奏帶的制作投入資金，但該出資并不是獲得制作者權利的對價，而是合作參選、分擔投資的方式，法院最后判決李剛退還李麗霞制作費4千元，駁回了李麗霞的其他訴訟請求。

這個案例與著作權有關。著作權也稱版權，是指作者及其他權利人對文學、藝術和科學作品享有的人身權和財產權的總稱。著作權要保障的是思想的表達形式，而不是保護思想本身，在保障私人之財產權利益的同時，須兼顧文明之累積與知識之傳播，算法、數學方法、技術或機器的設計均不屬著作權所要保障的對象。實質條件是指法律對作品的要求，大體有兩種標準。一種標準是只要特定的思想或情感被賦予一定的文學藝術形式，這種形式無論是作品的全部還是其中的局部，也不問該作品是否已經采取了一定物質形式被固定下來，都可以依法被認為是受保護的作品。另一種標準是，除了具備作為作品的一般條件，即表現為某種文學藝術形式外，還要求這種形式通過物質載體被固定下來，才可以獲得著作權法保護。按照這種標準，口述作品以及一些即興創作的舞蹈、音樂、曲藝作品，就可能被排除在著作權法保護之外。我國著作權法采用第一種標準。口述作品等均可以成為著作權法的保護對象。著作人身權是指作者通過創作表現個人風格的作品而依法享有獲得名譽、聲望和維護作品完整性的權利。該權利由作者終身享有，不可轉讓、剝奪和限制。作者死后，一般由其繼承人或者法定機構予以保護。根據中國《著作權法》的規定，著作人身權包括：發表權，即決定作品是否公布于眾的權利；署名權，即表明作者身份，在作品上署名的權利；修改權，即修改或者授權他人修改作品的權利；保護作品完整權，即保護作品不受歪曲、篡改的權利。

當然，通過觀看我也了解庭審的程序：首先，審判長詢問被告人的基本情況，告知其有申請回避權、辯護權、最后陳述權等權利和如實陳述事實，遵守法庭紀律等義務。其次，進入法庭調查階段，公訴人宣讀起訴書，詢問被告人是否認可。公訴人、辯護人、法官依次向被告人發問，對起訴書的內容逐項核實。再次，由公訴人出示證據，包括公安機關的抓獲經過，證人證言，由被告人及律師逐一確認。被告人及律師出示證據，然后由公訴人確認證據。法庭辯論階段，公訴人發表公訴意見，指出犯罪事實應當承擔刑事處罰，說明被告人主客觀都有犯罪事實，構成犯罪要件，罪名成立。被告人及律師發表辯論意見，開脫罪責，力爭無罪或降低懲罰。最后，由被告人做最后的陳述，審判長宣布休庭，擇日宣判審判結果。

經過這次觀看，我學到了不管是法官還是當事人應當注意的問題。語言表達能力十分重要，要有嚴謹的邏輯，抓住關鍵點。同時我增長了相關法律知識，清楚了庭審的基本過程。我想這對增強個人的法律意識是大有益處的。

今天上思想道德修養與法律課基礎課，老師帶領我們觀看了法官庭審過程的視頻，這些視頻給我印象很深刻，我第一次了解到法官是如何執法、評判的。

一打開視頻呈現的場面就給人一種嚴肅而莊重的感覺。一上來是法官上場，然后就是法庭審判，首先法官讓罪犯自我介紹，接著問了罪犯有關案件的具體過程，當罪犯回答問題模棱兩可時法官會及時提醒，讓他們說關鍵問題，當一切問題詢問清楚，各項證據齊全，經過公訴人與法官的商討，最后依據我國法律對罪犯進行定罪。這一切說起來輕巧，但實施起來卻不容易。

法官的高效辦案，科學合理進行詢問，在法定期限內及時履行職責，不無故拖延時間、浪費資源，這種辦事認真的態度值得我們學習。他們對工作一絲不茍，認認真真，清正廉潔，遵守各項廉政規定，沒有利用法官職務和身份謀取不正當利益，他們一心為民，落實司法為民的各項規定和要求，做到了聽民聲、察民情、知民意，堅持能動司法，樹立服務意識，做好訴訟指導，風險提示，法律釋明等便民服務，避免了“冷硬橫推”等不良作風。他們嚴守紀律，遵守各項紀律規定，不泄露個人隱私，他們敬業奉獻，熱愛人們司法事業，增強職業使命感和榮譽感，加強業務學習，提高司法能力，無私奉獻，他們遵守司法禮儀，執行著裝規定，言語文明，舉止得體等等，他們身上這些優點都值得我們學習。

在我們今后無論是學習還是生活中，我們都應該像法官一樣，對待自己份內的事認認真真，一絲不茍，并且也要學會奉獻，不要斤斤計較，并且也要有職業節操，不能利用自己的職位做一些損害集體利益的事，一定要嚴于律己，秉公辦事。

在庭審過程中，罪犯主動交代了自己犯罪行為，這件事情的起因是因為罪犯想要多賺一些錢使得自己的生活過的好一些，因此才動起了歪腦筋，他找到了一個同鄉，說是有一個發財的好機會，那個人聽了之后也心花怒放的，因此兩個人決定獲取不義之財。主犯利用自己的職位多次用低價采購商品，然后和同鄉一起以高價賣出，以此來賺取差價來獲得利潤。兩人一見錢來的如此容易，便一次又一次利用職位之便來獲取更多錢財，不料，事情敗漏了，兩人相繼被抓。

在法官審判過程中，兩人如實的交代了自己的犯罪過程，在最后的陳述中懺悔到：他們自己已經意識到自己的錯誤，他們會努力改正，希望法官給他們這個機會，爭取給他們寬大處理。雖然罪犯已經認識到自己的罪行是多么的大，但這也于事無補，他們將要接受的是法律的審判，他們要為自己的罪行負責。雖然法官很同情他們，但是，國有國法，家有家規，只要你犯錯，你就要為自己的過錯承擔應有的懲罰，因此，經過商議，法官按照國家憲法給他們定罪。

法官在審判過程里，一直嚴格遵守憲法紀律，將個人感情埋藏在心中，秉承著一顆忠于職守、秉公辦事的心，對罪犯、對案件進行嚴格審理，不摻雜一點私人情感，最終做出了公正的審理，給罪犯，同時也是給受害人，更是給社會大眾還原一個真實的真相，讓大家了解事情的原委。

通過視頻讓我見識到法官的重要性。法官是評判一個片案件的關鍵人，如果法官不能做出正確的決定，會給使得受害人得到不公平的待遇，因此，法官一定要秉公辦事，收起自己的同情心，嚴格按照司法程序給大家一個交代。

法律是公正的，是嚴明的，同時也是不可侵犯的。我們的任何社會行為都受著法律的約束，試想一下，如果沒有法律，那么這個世界是怎樣的一鍋粥？搶劫，殺人，綁架，防火……不過是家常便飯而已。

我們作為一名大學生，應該努力學習，遵紀守法，做一個講道德，守法律的好公民，將來成為一個對國家、對社會有幫助的人。

法律電影觀后感

在看了《法外情》 《一級恐懼》 《一級重罪》 《沉默的羔羊》···等幾部精彩的電影之后，我收獲的不僅僅是視覺和情感上的沖擊、以及對人性和理性的思考，還了解到一些法律上的知識，通過中國與美國的法律電影認識到它們法律制度的區別。

在這幾部電影中，最令人感動的莫過于《法外情》了，影片情節曲折感人，部分片段有令人泫然而泣的效果。主要講述老妓劉惠蘭因自衛殺死了出身名門的嫖客曾某，僅在倫敦大學法學院剛畢業的劉志鵬出于正義愿為她出庭作證。在種種的壓力下，憑著他的不屈不撓，與著名的主控官展開一番舌戰唇槍，幾經艱苦，終于得到勝利，使被告得以無罪釋放。這部影片提出當時低下階層對社會貧賤富貴的控訴及法與情之間的矛盾，讓觀眾產生極大震撼與共鳴。它講述的這個故事讓人們認識到原來在理性的法律制度下，還是有著真情存在的。都說“法不容情”，可是若是心懷真情和正義，便終將會贏得勝利！法律只是一種保護權益的手段，它最終還是為了人們的權益而存在，為了正義而存在。總之，堅持正義必勝！

《一級恐懼》是一部美國電影，電影講述芝加哥發生了一樁震驚全城的恐怖血案。德高望重的老主教羅森被人謀殺，身上共被刺了78刀。警察在現場抓到了滿手鮮血的少年艾倫。著名律師馬丁·威爾決定經辦此案。他在拘留所看到了面色蒼白，稚氣未脫的艾倫，通過交談他認為艾倫是無辜的，并決定免費為他辯護。其中，有這樣一句臺詞，威爾對艾倫說：“我來說，你不必說。你要做的就是看起來很無辜的坐在那。”為什么要表現的很無辜呢？因為要獲取陪審團的支持，陪審團對一個案件的判決非常重要。在美國，審判中都會有陪審團出現。在英美法系中，陪審團制度是十分重要的一項制度，它對案件的判決起著十分重要的作用。因為陪審團來自社會各個階層，一個案件的判決能夠說服陪審團，意味著能夠符合社會廣大階層的正義觀和價值觀。在我國，顯然是沒有陪審團這一制度的，這也是中國和美國司法制度的最大不同之處。

這部影片劇情很精彩，讓我們對人性有了更深層的認識與反思，影片最后威爾勝利了，成功為艾倫脫罪，他去向艾倫告別，大家都以為高潮已過全局終，正義戰勝邪惡。在受壓迫的弱者得以沉冤昭雪時，人性的秘密卻再一次被泄露出來——嚴重的不公經歷是會對心理造成扭曲的，再純潔的靈魂也不會幸免遇難。或許的確存在過羅伊與艾倫同時并存的時候，也許是在主教剛收留他，也許是很小的時候，被變態父親凌辱時，兩種面孔同時占據著他的身體。但最終，為了改變現狀，結束這令靈魂顫栗恥辱的一

切，懦弱的艾倫最終完全消失了，沒有等來任何及時救贖的純潔良知泯滅了，取而代之的，是憤怒，殘忍，暴力的羅伊，他更殘酷更強大，所以更適應這個世界。就像影片最后羅伊向威爾喊的那樣，“你會感激我的，你總會變得心狠手辣。”片尾威爾定定地站在那里，沒人知道他在想什么。是否仍然相信人性本善呢，是否依舊如往日為他感興趣的殺人犯辯護，探究為何善良的人也會殺人。他是否仍然對自己的信仰堅信不疑，還是僅僅將之歸結到自己洞察人性的能力不足呢。一切無從知曉，如同最后那首嘹亮澎湃的葡萄牙小曲一樣，鬼魅一樣的曲調，久久地盤旋在觀眾心中，亮麗而妖異如同夜幕下大海中折射著月光的美麗魚鱗，剔透晶瑩地隱現在暗潮洶涌的浪濤之間。法律雖然無法代表人性，但我們卻可以在這個過程中探索人性，思考和反思自身。

提到《一級重罪》，不得不提到案中的軍事法庭，軍事法庭與一般的法庭有所不同，因為可能會涉及到國家機密，不能公開審理，其中的一些制度、規則、稱呼都有一些不同。查理說：“如果軍歌可以算作音樂，那么軍法可以算作司法”“軍法體制以否決為基礎，挑戰體制？NO，照體制內的游戲規則，挑戰必輸無疑”，由此可見一斑。這部影片主要講述的是舊金山女律師克萊爾與成功商人湯姆一直過著令人羨慕的婚姻生活。然而這種平靜瞬息之間就被打破了，就在兩人在街巷中散步時，卻有不知何處來的大批軍警忽然把兩人圍住，把湯姆強行帶走。幾經查問，克萊爾終于被告知，丈夫曾是秘密軍人，而軍方現正指控他在巴西的薩爾瓦多犯下了“屠殺罪”！涉及國家機密，丈夫的案件不能公開審理。軍事法庭又是軍隊高層說了算，錄音帶不被采證，醫療保險單不被采證，甚至克萊爾有可能被剝奪辯護資格。于是克萊爾找到了陸戰隊律師查理一同來調查這場詭異的官司。

看這部電影的時候感觸很大，為了國家的利益，為了上級的命令，海軍陸戰隊的官兵被國家洗腦，一件件罪惡滔天、任意殺伐的事出自他們的手下，事情敗露后總得有人頂雷，這個人要么是死去的人，要么是其中一名部下。

最后在克萊爾的努力下，國防部撤訴了，原因是涉及到了國家機密，可是這中間又有多少不為人知的事情呢？真相面前沒有真愛，克萊爾費了九牛二虎之力查了個翻天覆地，把丈夫變成無罪釋放，到頭來卻是一場連環欺騙？丈夫追殺戰友，后來追殺丈夫的人也來了，到底誰有罪，誰是罪惡的源頭？ 臨死的丈夫說：“我不希望這樣做，對不起”，是誰逼他這樣做，是誰讓他離開愛的軌道越來越遠，是誰將他視為秘密的一環，讓他把環前環后清除，再清除他？到底還有多少掩飾的罪行比我們的想象還要大？到底還有多少無辜的生命，將倒在他們黑色堂皇的槍口下？這恐怕又要引發

我們新的反思了。

最具有懸念最驚悚的影片當屬這部《沉默的羔羊》，影片中的克拉麗絲是聯邦調查局的見習特工。她所在的城市發生了一系列的命案，兇手是一名專剝女性的皮的變態殺人犯“野牛比爾”，迄今為止，受害的女性已達5人。克拉麗絲的任務是去一所戒備森嚴的監獄訪問精神病專家漢尼拔博士，同他進行面對面的交談，以此獲取罪犯的心理行為資料來幫助破案。漢尼拔被關在地牢里，他是一位智商極高、思維敏捷但高度變態的中年男子，并且是個食人狂魔，他要求克拉麗絲說出個人經歷供自己分析以換取他的協助。他是一位造詣很深的精神病專家，然而具有諷刺意味的是，他自己就是一名精神病人，更確切他說是一名心理變態者，“明知自己在犯罪卻毫不在乎的精神變態者，純粹同社會作對”。影片通過探索人物心理疾患，試圖探尋當代美國社會恐怖的根源，這使得影片的主題得以深化。在影片中，那種精神上的對抗、那種“天使和魔鬼”的鮮明對比、那種建立在較緩慢節奏上的內在哲理性給人的印象是深刻的，廣泛地引起了公眾對社會犯罪、恐怖以及邪惡勢力的憎惡和譴責。

看完這幾部電影，真的獲益匪淺，欽佩那些電影主角的勇氣，智慧，堅持和正義；感慨軍事法庭的特殊化；贊嘆陪審團制度的人性化。總之，學到了很多。如今，隨著時代的進步，無論政治，經濟，文化，還是法律都逐漸呈現一體化，各國的聯系也越來越緊密。我相信我國對外來事物“取其精華，去其糟粕”的方針終將進一步完善我們的各方面體制，依法治國在不久的將來肯定會得到最大化的貫徹和實施。讓我們共同期待明天完善的法治社會！

When i first watch this movie,i find one great problem which is the real name to this movie.I get two name for movie.One is The devil wear the pARADA,the other name is the queen wear the pARADA.these names have so many same place,but they have only one place diffierent whether is devil or queen.In my sight ,this perspective out a problem which relate to the values.Some people think the person who like Miranda priestly version of a workaholic is the devil which can't be understand by normal citizen who have not ambitions and ideal.Those people don't have to work enthsiasm.In these eyes,enjoy life is the kingly way.No more easliy than the freedom of anythingof value.Maybe this is the true meaning of American.But by my side,i think this situation is not only in America but in whole world!NOTHING SEEK WITHOUT MOTIVE!
