After the probation, Party A shall provide Party B with a monthly housing allowance of RMB5,000.00.Party A shall provide the invoice of rent payment for reimbursement.The monthly date for reimbursement is on the 8th day of each month.If the 8th day of the month falls in the weekend or holiday, the payment shall be brought forward to the nearest weekday.Party A shall inform Party B and explain the detailed reason within 5 work days in case Party A fails to pay the salary due to special reasons.3.2 甲方應(yīng)于每月8號以貨幣或轉(zhuǎn)帳形式足額支付乙方上述報酬。如遇節(jié)假日或休息日，應(yīng)提前到最近的工作日支付，如因特殊原因延期支付報酬的，甲方應(yīng)在五個工作日內(nèi)向乙方說明原因。

Party A shall pay salary to Party B before the 8 day of every month in the form of cash or bank-transfer.If the 8th day of the month falls in the weekend or holiday, the payment shall be brought forward to the nearest weekday.Party A shall inform Party B and explain the detailed reason within 5 work days in case Party A fails to pay the salary due to special reasons.3.3 甲方可根據(jù)生產(chǎn)經(jīng)營的狀況或乙方任務(wù)量和工作表現(xiàn)，適時調(diào)整乙方的報酬。

Party A can adjust Party B’s salary according to its operating conditions, Party B’s workload and performance.3.4 當乙方的工作任務(wù)發(fā)生變化時，甲方可按規(guī)定調(diào)整其相應(yīng)的報酬。乙方接受新的工作任務(wù)后，即視作接受甲方按照該工作任務(wù)重新確定的報酬。

Party B’s labor remuneration will be adjusted in case Party A adjusts Party B’s job responsibilities.Accepting the new position is regarded as accepting the adjusted salary.th

3.5 乙方應(yīng)遵守國家及地方的稅法制度，自行繳納其個人收入的個人所得稅，甲方無義務(wù)為其代繳。

Party B shall pay personal income tax voluntarily according to the state’s tax law.Party A doesn’t shoulder the responsibility to withhold and remit taxes for Party B.3.6 乙方在合同期內(nèi)享受中國法律規(guī)定的節(jié)日，公休假日，另外公司每年為其提供5天的帶薪休假。

Party B is entitled with all legal holidays in accordance with the state’s regulations, In addition, Party B enjoys a paid leave of 5 days each year.四、雇傭合同的解除和終止

Ⅳ Contract Cancellation and Termination

4.1 合同期滿雙方不再續(xù)簽或者雙方約定的合同終止條件出現(xiàn)時，雇傭合同即終止。

This contract shall be terminated once it expires and both parties do not extend the contract.4.2 經(jīng)合同雙方當事人協(xié)商一致，本合同可以解除。

The contract may be canceled based on both parties’ mutual negotiation.4.3 乙方應(yīng)遵守中國政府的法律、法規(guī)及有關(guān)規(guī)定，乙方如違反上述規(guī)定，甲方有權(quán)即時解除合同；乙方因健康原因，經(jīng)醫(yī)生證明連續(xù)病休15工作日后仍不能繼續(xù)工作，甲方有權(quán)提前終止合同。

Party B should abide by China laws, decrees and related regulations and Party A’s working systems.During the duration, Party A is entitled to cancel the contract in case Party B violates China laws and decrees, and terminate the contract before expiration in case Party B cannot resume his or her work for health reasons after the medical certification of continuous sick rest for 15 working days.4.4 乙方因歸國或其他私人原因未正常出勤且超過十天且未向甲方做出書面說明的，本合同自動終止。The contract will automatically terminate in case Party B is absent for over 10 days without written explanation due to homecoming or other private reasons.4.5 乙方被證明無法完成本合同項下的工作任務(wù)，甲方有權(quán)隨時解除本合同。

In case Party B is proved to be not competent for the work under the contract, Party A is entitled to cancel the contract at any time.4.6 乙方應(yīng)嚴格遵守甲方的工作規(guī)定以及規(guī)章制度，盡職盡責，否則，甲方有權(quán)隨時解除合同并追究因此而造成的經(jīng)濟損失，并有權(quán)對所造成的經(jīng)濟損失在乙方的報酬中作相應(yīng)扣除。

Party B should abide by Party A’s working systems, rules and regulations.Otherwise, Party A is entitled to cancel the contract and claim a corresponding compensation of any economic loss from Party B’s payment.4.7 乙方有權(quán)提前30 日以書面形式通知甲方解除本合同，在試用期內(nèi)提前3日通知甲方即可解除。

Party B should inform Party A in written form 30 days in advance for canceling the contract, and 3 days in advance during the probation period.五、其他事項

Ⅴ Others

5.1 其他未盡事宜，雙方可參照甲方公司內(nèi)部的相關(guān)規(guī)章制度執(zhí)行。

四、雇傭合同的解除和終止

Ⅴspecial compact

5.1由于乙方為兼職人員，故甲方不需為乙方繳納社會保險。

PartyB is part-time Job, no need to pay social insurance for.5.2乙方因病或非因工負傷醫(yī)療費用自行解決，醫(yī)療期內(nèi)甲方不支付報酬。

PartyB get sick or get wounded not in the line of duty, second party should pay himself.5.3雙方解除、終止本協(xié)議，甲方無需支付乙方任何經(jīng)濟補償。

If compact was determined by two parties, partyA does not have to pay second party compensation.六、其他事項

6.1 其他未盡事宜，雙方可參照甲方公司內(nèi)部的相關(guān)規(guī)章制度執(zhí)行。

一，工作內(nèi)容和合同期限job duties and contract period

1.甲方根據(jù)工作需要安排船員乙方輪 擔任職務(wù)，合同期限為 個月，自上船之日起計算。合同期滿，雙方未辦理合同終止或者續(xù)訂手續(xù)的，視為本合同自動延續(xù)，任何一方都有權(quán)利通知對方終止合同。但合同屆滿時或延續(xù)期間，如船舶在國外或者航行中或者不方便離船的港口，則合同自動延續(xù)至船舶到達可離船的港口之日為止。A appoint BasonMV:The contract period is or renewal the contract when the contract expired, regard as the contract continue automatically, each side have the right to notice the other side to end the contract.but ,if when the contract expired, the ship or the crew or the port is inconvenient ,the contract can be continued until the convenient port.2乙方因傷，病并經(jīng)醫(yī)生證明，或者由于不可抗力原因，造成乙方不能繼續(xù)在船工作的，合同自行終止。合同期內(nèi)，如發(fā)生賣船，更換船東等，甲方可以提前終止合同，乙方的遣返費由甲方負擔。Bcan not work on board due to injury or illness(should be proofed by doctor)or majeure force, the contract end automatically.A end the contract and offer B repatriation fee when exchange ship owner or sell the ship during the crew contract period.3.乙方在合同期內(nèi)如遇配偶或者親屬舉喪之事，在征得甲方同意后可以安排下船。乙方因為個人原因，無正當理由下船的，其下船的船差費，代理費等由乙方自負。由此造成甲方損失及更換船員費用增加的，乙方負責賠償。B can get off when meet his relatives death and A agree to exchange crew during the contract period.but B get off the ship without reasonable excuse by himself ,B have to pay the agent fee and other payment.If this cause A economic loss, B should pay for the loss.二．工資福利待遇 salary and benefits

1.乙方在船工作期間，月工資標準是美元（包括基薪，固定加班費，養(yǎng)老保險，醫(yī)療保險，工傷保險，生育保險）。乙方按照甲方的規(guī)定領(lǐng)取外派工資和相關(guān)津貼，甲方按照國家規(guī)定的繳費基數(shù)即平均工資的三倍繳納養(yǎng)老保險，醫(yī)療保險。失業(yè)保險，工傷保險，生育保險。如不滿一個月，按照實際天數(shù)/當月天數(shù)*月工資計算，上下船工資結(jié)算時間為上船當日起至下船前一日止（以交接單日期為準）。B works onboard，the salary is

One month(include base salary，fixed overtime，endowment insurance，medical insurance，injury insurance，maternity insurance)，B get the salary regularly，A pay the endowment insurance，medical insurance，injury insurance，maternity insurance according to the national regulation。If shorter than one month，calculate as ：actual days/ days of the month * month salary, the date calculated from the first day onboard to the last two day get off on the pass-on sheet。

2.甲方根據(jù)乙方提供的詳細匯款賬號，每月以銀行匯款方式于15日—20日之間結(jié)清上月工資，下船工資的結(jié)算時間為收到正常下船差費，交接清單后一并結(jié)清。A pay off last month salary during the 15th---20thof the month according to the detailed bank account number which B send to the company.when crew get off the ship ,the salary of departure should be pay off when receive the normal ship sent fee invoice and pass-on sheet

3.甲方提供乙方在船生活費為每日4.0美金。提供在船期間相應(yīng)勞動保護補助及醫(yī)療補助。A offer B living cost 4.0USD one day on board，offer labor protection and medical subsidy

4.乙方正常上下船的費用由甲方承擔，但乙方必須按照甲方的規(guī)定的標準執(zhí)行，超出部分非特殊情況下甲方不予承擔，未完成合同提前下船的差費乙方承擔。A offer the normal ship sent fee for B according to the company regulation，if B don’t have reasonable excuse ,the beyond part should be paied by B himself.get off the ship before the ending of the contract ,Bpay all the bill.5.合同期內(nèi)，甲方負責為乙方提供風險保障：如死亡，受傷，生病等情況，甲方根據(jù)P&I協(xié)會條款或者保險公司條款為乙方提供保障，但以下情況除外：A offer risk guarantee for death，injury，illness etc according to P&I association，but except：

（1）并非在船上是發(fā)生的受傷，死亡 injury or death not on board

（2）受傷或者患病是由于乙方的故意行為，違章，酗酒或者不正當舉止所致 injury or illness caused by intentional action，peccancy intemperance or other incorrect action

（3）簽訂合同時故意隱瞞疾病等 hide the truth when sign the contract

6.乙方在工作期間享受甲方的各項獎勵，自修費，勞務(wù)費等地分配。

B have the right to share the reward，self-maintenance fee，labor fee ect

三，雙方的權(quán)利和義務(wù)both sides’ right and duty

1.乙方應(yīng)保證身體健康，保證持有有效的主管機關(guān)簽發(fā)的有效的船員服務(wù)薄，基本安全培訓合格證，海員證，職務(wù)證書以及公約要求的其他技術(shù)證書。根據(jù)需要乙方應(yīng)接受甲方的ISM 培訓，遵守甲方的SMS 體系文件的規(guī)定。B should be ensure not only healthy and have valid crew service book，the basic safety training certificate，seamen’s certificate，post certificate and other technical certificate required by international conventions.B should receive the ISM training and obey the SMSregulations made by the company.2.甲方負責為乙方辦理外籍證書及出境手續(xù)，正常情況下所發(fā)生的費用由乙方自負，在船工作滿個月之后所發(fā)生的費用，酌情報銷。Aarrange the foreign certificate and exit formalities for B，B pay all the bill，can apply for some refund

3.根據(jù)配員要求，乙方需要值班的，船長要求必須會操作使用船上的通導(dǎo)設(shè)備。

If discharge required，B should can operate the communication equipments on board

4.乙方在合同期內(nèi)，應(yīng)忠于職守，遵紀守法，盡職盡責，如有下列行為者，甲方有權(quán)終止合同，乙方除自行承擔后果外，對甲方造成的損失應(yīng)負賠償責任，甲方亦有權(quán)根據(jù)乙方行為后果的嚴重程度給予相應(yīng)的經(jīng)濟處罰：B should be on duty and responsible for his act onboard，if B do the following action，A have rights to end the contract at once and ask for compensation，and have rights to punish B with economic methods

（1）乙方工作失職，給船舶安全性或者正常航行造成危險或者損失的 B neglect his duty cause danger or loss

（2）乙方不遵守甲方的管理制度或者不服從公司管理的B break company rules or management regulations

（3）乙方漏船或者擅自離船的 Bget off the ship without permission

（4）乙方參與盜竊，走私，偷渡，販毒，色情等活動的 B join the following act ：steal Smuggle，stowaway，drug trade，eroticism ect

（5）乙方不遵守所在港國家法令等被追究地方責任給甲方造成損失的B break port station rules，is punished by the state，caused problems or loss

（6）乙方私自與ITF 及其他國際公會組織接觸的B contact with ITF or other international associations privately

（7）其他嚴重違法違紀情形other seriousillegal acts

四，違約責任 defaultresponsibilities

合同履行期間任何一方違約將導(dǎo)致合同終止，違約方應(yīng)向?qū)Ψ街Ц逗贤趦?nèi)月工資總額的10%的違約金。each side break the contract lead to the ending of the contract and the breaker should pay 10% salary of one month as liquidate damages

五，爭議解決dispute resolution

合同履行期間內(nèi)，雙方如有爭議，應(yīng)協(xié)商解決，如協(xié)商不成，雙方同意由甲方所在地的法院解決。If there is a dispute between A and B，should be consulted，if the argument can not be dissolved，apply for the court where A located in

六，簽約生效 contract come into force

第五篇：員工雇傭合同

員工雇傭合同

甲方因經(jīng)營管理需要，經(jīng)過考核，聘請乙方為公司管理人員，遵照國家有關(guān)勞動法律法規(guī)，經(jīng)雙方友好協(xié) 商，達成以下聘用協(xié)議：

一、甲方聘請乙方為公司重慶項目的臨時員工。

二、聘用合同期限從乙方到甲方工作時起至項目結(jié)束 止。

三、乙方的工資待遇。

月薪：4500元，生活費：300元

四、乙方的職權(quán)范圍。

重慶機場快速路橋梁的：簡易腳手架搭設(shè)、玩扣式腳手架搭設(shè)、鋼管、蓓蕾片搭設(shè)和領(lǐng)導(dǎo)交辦的其他工作。

五、甲方的基本權(quán)利與義務(wù)：

㈠根據(jù)生產(chǎn)經(jīng)營管理的需要和本公司的規(guī)章制度及 本合同的各項條款對乙方進行管理。

㈡保護乙方的合法權(quán)益，按合同規(guī)定付給乙方工資、津貼及工傷意外保險和其他約定的補貼。

㈢做好乙方工作前的培訓并提供符合國家安全標準 的工作衛(wèi)生條件。

㈣依照國家及公司管理規(guī)定對乙方進行獎懲；在乙 方違法亂紀、不認真履行職責的情況下，甲方可以終止 與乙方的聘用合同關(guān)系；在乙方不能勝任工作的情況下，甲方有權(quán)對乙方的工作進行調(diào)整，乙方必須服從安排。

㈤其他法律法規(guī)和公司規(guī)章制度規(guī)定及合同約定的 權(quán)利義務(wù)。

六、乙方的基本權(quán)利和義務(wù)：

㈠享受法律法規(guī)和合同規(guī)定的待遇，在職權(quán)范圍內(nèi) 充分行使權(quán)利，不受任何非法和無理的干擾。

㈡遵守國家法律法規(guī)和甲方的規(guī)章制度，在工作職 能范圍內(nèi)，服從甲方的工作分配、安排。按時、按質(zhì)、按量的完成甲方下達的工作任務(wù)或經(jīng)濟指標。

㈢保守甲方的商業(yè)秘密，如乙方泄露秘密，給甲方 造成損失的，除承擔法律責任外，還要賠償甲方的經(jīng)濟 損失。

?㈣乙方不得自營或者為他人經(jīng)營與甲方同類的營業(yè) 或從事?lián)p害甲方利益的活動。如乙方從事上述營業(yè)活動 的，所得收入應(yīng)當歸甲方所有。

㈤乙方執(zhí)行甲方交給任務(wù)時，違反法律法規(guī)或者甲 方規(guī)章制度，給甲方造成損失的，應(yīng)當承擔賠償責任。

㈥乙方不得利用在甲方的地位和職權(quán)為自己謀取私 利；不得利用職權(quán)收受賄賂或者其他非法收入，不得侵 占甲方的財產(chǎn)。

㈦乙方不得挪用甲方的資金或者將甲方資金借貸給 他人，不得以甲方資產(chǎn)為他人提供債務(wù)擔保；不得將甲 方資金以其個人名義或者其他個人名義開立帳戶存儲。

㈧乙方如有上述㈣－㈦四種情況時，甲方有權(quán)利與 乙方解除本合同。

㈨其他法律法規(guī)和甲方規(guī)章制度規(guī)定及本合同約定 的權(quán)利義務(wù)。

七、合同的變更和解除：

本合同生效后，甲乙雙方 無正當理由不得變更合同或提前解除合同；如現(xiàn)實情況 發(fā)生變化，雙方可以協(xié)商變更合同或解除合同；任何一 方解除合同，須提前10 天通知對方，方能解除合同，并辦理有關(guān)手續(xù)，如一方違反以上規(guī)定應(yīng)給予另一方相 應(yīng)經(jīng)濟賠償。

八、違約責任：

如合同一方違反以上合同之規(guī)定，應(yīng)賠償另一方的直接經(jīng)濟損失。

九、如本合同發(fā)生糾紛，提交市勞動仲裁委員 會解決。

十、未盡事宜，雙方根據(jù)相關(guān)勞動法律法規(guī)和省市的相關(guān)政策規(guī)定，協(xié)商予以補充解決。

十一、本合同一式三份，甲乙雙方各執(zhí)一份，報鑒 證機關(guān)存留一份。本合同自雙方簽字之日起生效。
