Fellow-Citizens of the Senate and of the House of Representatives:

Among the vicissitudes incident to life no event could have filled me with greater anxieties than that of which the notification was transmitted by your order, and received on the 14th day of the present month.On the one hand, I was summoned by my Country, whose voice I can never hear but with veneration and love, from a retreat which I had chosen with the fondest predilection, and, in my flattering hopes, with an immutable decision, as the asylum of my declining years--a retreat which was rendered every day more necessary as well as more dear to me by the addition of habit to inclination, and of frequent interruptions in my health to the gradual waste committed on it by time.On the other hand, the magnitude and difficulty of the trust to which the voice of my country called me, being sufficient to awaken in the wisest and most experienced of her citizens a distrustful scrutiny into his qualifications, could not but overwhelm with despondence one who(inheriting 保險公司代理制營銷員管理規定

各保險公司、各保險中介機構：

為促進保險營銷業務健康發展，根據《中華人民共和國保險法》、《中華人民共和國合同法》、《保險營銷員管理規定》等有關法律、規章，現就進一步規范代理制保險營銷員管理制度有關問題通知如下：

一、嚴格遵守從業資格要求

保險公司和保險中介機構不得與未取得《保險代理從業人員資格證書》或《農村保險營銷員資格證書》的人員簽訂個人保險代理合同;不得委托未取得《保險代理從業人員資格證書》或《農村保險營銷員資格證書》的人員從事保險營銷活動。

二、規范增員制度

(一)保險公司和保險中介機構招募代理制保險營銷員時，在廣告、宣傳手冊及口頭宣傳和解釋中應當明確說明招募的是代理制保險營銷員而非公司員工。

(二)保險公司和保險中介機構招募代理制保險營銷員的活動應當與公司員工招聘活動分開進行。

(三)保險營銷員自行聘用他人協助其管理，或者自行將客戶管理等相關工作委托或者外包給他人時，應當明示不屬于公司招聘行為。

三、規范個人保險代理合同管理制度

(一)保險公司和保險中介機構應當在個人保險代理合同顯著位置明示不屬于勞動合同，并經保險營銷員確認。

(二)個人保險代理合同應當明確規定合同雙方的主要權利義務，包括合同訂立、合同變更、合同期限、委托授權范圍、手續費(傭金)支付制度、違約責任及違約金、合同解除等。

保險公司和保險中介機構應當將手續費(傭金)的支付標準及其調整情況及時告知保險營銷員。

(三)個人保險代理合同的條款和用語中不得出現員工、工資、薪酬、底薪、工號等誤導性條款或者用語。

(四)個人保險代理合同應當至少給保險營銷員一份原件。

個人保險代理合同丟失或者損毀的，應保險營銷員的要求，保險公司和保險中介機構應當提供合同文本。

四、規范日常管理制度

(一)保險公司和保險中介機構不得要求代理制保險營銷員實行公司員工考勤制度。

(二)保險公司和保險中介機構不得要求代理制保險營銷員適用公司員工管理制度。

(三)除依照法律和行政法規規定，或者依據個人保險代理合同追究違約責任外，保險公司和保險中介機構不得對代理制保險營銷員實施罰款、處分、開除等處罰。

(四)除法律、行政法規另有規定，或者存在利益沖突外，保險公司和保險中介機構不得禁止或限制保險營銷員兼職從事其他職業或其他工作。

因法律、行政法規另有規定，或者存在利益沖突限制禁止保險營銷員兼職的，應當經保險營銷員確認并在個人保險代理合同中明示。

(五)保險公司和保險中介機構應當嚴格按照個人保險代理合同約定及時履行手續費(傭金)支付義務，不得因個人保險代理合同約定以外的理由扣減手續費(傭金)。

(六)保險公司和保險中介機構應當關心保險營銷員的社會保障事宜，主動協助、指導保險營銷員參加社會保險，獲得社會保障。
