如何向違約離職員工索要培訓費

企業在對員工出資培訓后，通常會給員工設定一個服務期，有些員工在服務期未滿時便提前違約離職，但又不愿支付培訓費或違約金，對此很多企業都感到非常棘手。

1.法律規定違約離職員工應當支付違約金

我國《勞動合同法》規定：“用人單位為勞動者提供專項培訓費用，對其進行專業技術培訓的，可以與該勞動者訂立協議，約定服務期。勞動者違反服務期約定的，應當按照約定向用人單位支付違約金。違約金的數額不得超過用人單位提供的培訓費用。用人單位要求勞動者支付的違約金不得超過服務期尚未履行部分所應分攤的培訓費用。”

一般來說，企業會給一些優秀員工提供培訓以提高他們的技能，使其更好地為企業做貢獻。在企業這一目標實現的同時，員工也提高了個人的技能和水平及自身的市場價值。很多企業的骨干員工經過培訓后會更優秀，可能很快就被競爭對手以高薪挖走，對此企業通常會要求員工支付巨額的培訓費用，但員工往往不愿意支付，這就產生了糾紛。

案例

——企業能拿回巨額培訓費嗎？——

某企業的一位員工在國外接受了一年的公費培訓，回國后工作不到3個月就被一家競爭對手挖走了。對此，企業認為該員工應支付企業用在他身上的培訓費用共計20萬元，否則就不能離職，而員工表示自己沒錢支付，便強行離開了。

企業不甘心損失20萬元的培訓費，于是向勞動爭議仲裁委員會提起仲裁。開庭后，仲裁員先進行調解，對企業說：“這個情況我們已經調查清楚了，這位員工確實違約了，但他又確實賠不起20萬元。不如我們給他做做工作，看看他能拿出多少錢來，就拿出多少來支付

給你們，你們看行不行？”對此，企業表示不同意。這時，仲裁員又說：“如果你覺得虧，不進行調解，那就直接做裁決，讓他賠償20萬元。但企業基本上也拿不到，因為他堅持說沒錢，就只能去法院申請強制執行。但這個員工一是沒結婚，跟父母住在一起，很難界定他有什么個人財產；二是他沒有個人存款，即使有，企業沒有他的賬號，法院也無法執行。”

聽完仲裁員的解釋，企業負責人也犯了愁，到底怎樣才能拿回巨額的培訓費呢？

在這一案例中，仲裁員的這種解決方式會對企業造成很大的負面影響：一方面，企業無法獲得足夠的賠償，經濟上蒙受了損失；另一方面，企業的其他員工看到只要支付很少的賠償金就可以離職，很可能會效仿，況且企業以后還會大量培訓員工。

2.企業向違約離職員工索要違約金的有效方式

事實上，在向違約離職員工索要違約金時，企業可以采取一系列行之有效的方法進行處理：

第一步，企業可以起訴違約離職員工，要求其支付違約金，同時不接受減少違約金的調解，而是要求仲裁庭做出員工必須如數賠償培訓費的裁決。

第二步，拿到裁決后，企業可以把裁決書的內容在內部做通告，并附上一個通知，說明本公司的員工××違約以后不支付違約金，公司提起了仲裁并且勝訴了，結果是員工必須如數支付違約金。這樣，能夠讓企業的其他員工感受到企業鮮明的態度和決心。

第三步，如果員工拒不支付且無法強制執行，企業可以在申請強制執行的同時，請法院做出“中止執行”的裁定，即員工目前沒有財產可供執行，一旦企業發現他擁有財產，就可以到法院申請恢復執行。換言之，這筆違約金會成為該員工終身背負的一筆債務。

第四步，企業可以與員工約談，說明企業已經掌握了他在新單位

工作的情況和薪酬待遇，目前可以不要求對方一次性支付，而是簽署一份分期還款協議，以這種方式支付培訓費。

第五步，如果員工拒絕簽署分期還款協議，企業可以將員工新就職的單位提供給法院，從法律上講，法院可以向新單位發出協助執行通知書，責成新單位協助執行，內容大約是“該員工目前欠原單位違約金多少元，現要求你單位協助執行，每月從該員工的工資中扣除多少元交給法院，由法院轉交給原單位”等。

經過上述步驟，員工在分析利弊得失后，通常會同意簽署分期還款協議。最后企業不但能拿回全部培訓費，更讓其他員工看到企業有足夠的法律手段追回培訓費，震懾其他員工，打消其他員工跳槽的念頭。由此可見，企業對于員工違約離職行為必須進行堅決而有效的處理，拿回培訓費只是其中一個直接目的，更深層的目的是遏制其他員工的違約行為，讓員工安心履行完服務期。
