房屋租賃相關法律問題

許多人也許會有這樣的誤解：房屋租賃相比買賣要簡單很多，基本上沒有太多需要關注的問題，甚至有不少人認為租賃合同都可有可無。

實際情況卻恰恰相反，由于房屋租賃中承租人并非房屋所有權人，他僅從所有權人處取得有限的使用權，因此在租賃期限內，承租人的房屋使用范圍、相關設施的使用及費用承擔均應有明確約定。而對于房東而言，畢竟租賃期限內房屋已脫離自己的實際掌控，如何確保自己的租金收益，同時又保護房屋不被人為損壞，避免租客違約提前退租后“人去樓空”的被動情形，這些問題都需要租賃雙方事先達成共識并制定相應措施。筆者根據實踐中的有關實例，對房屋租賃中可能涉及到的典型法律問題作一概括，希望對讀者有所幫助。

一、確定租賃雙方當事人身份首先，需要確定當事人是個人還是公司。若以公司身份作為出租人或承租人，租賃合同必須體現該租賃行為是公司行為，否則一旦出現問題，就很難向個人追究原本應由公司承擔的法律責任。其次，承租人應當依據產權證上記載的權利人，或與該房屋產權證上記載的權利人簽訂租賃合同的合法承租人，來確定與其簽訂租賃合同的相對人是否確有出租該房屋的權利。若承租人與實際上并無出租權的人簽訂租賃合同，則該合同須經有權出租人的認可，在此之前該租賃合同的效力尚未確定。若未經認可，承租人則可能面臨缺乏有效合同的不利處境。

二、確定房屋類型房屋類型基本分為居住用房和非居住用房兩種。承租人應根據需要選擇相應類型的房屋承租。特別需要提醒的是，如果該承租房屋需用于辦公，則必須選擇非居住用房。因為如果涉及辦理營業執照，只有房屋類型為非居住用房的，工商行政管理部門才會核發營業執照。具體房屋類型需根據產權證上的記載確定。另外，確定房屋類型并選擇相適應類型房屋租賃后，在租賃期間內承租人不得擅自改變該房屋用途，否則將視作違約行為。例如，居住用房不得擅自改變為非居住，除雙方同意外還需取得有關部門的批準。

三、租金的支付時間及方式通常大多數人認為，就租金數額達成一致后就萬事大吉了。其實租金的支付時間及支付方式，同樣具有舉足輕重的地位。出現承租人拖欠租金的情形時，事先約定有支付時間就顯得尤為重要。這樣，出租人就有權自該支付時間起向承租人加收滯納金。(對于滯納金數額若有約定，則依據雙方約定；若雙方未有約定，根據《上海市房屋租賃條例》第23條規定，以拖欠租金額的日萬分之四計收)另外，法律規定承租人無正當理由未支付或者延期支付租金達一定期限的，出租人有權解除租賃合同。法律允許雙方當事人自行約定該期限，若無約定，《上海市房屋租賃條例》第23條規定為累計超過6個月。至于租金的支付方式，包括現金、支票或銀行轉賬等，承租人應依照雙方約定的支付方式支付租金。

四、租賃保證金為確保承租人能夠合理、善意地使用房屋，并按時支付租賃期間應承擔的各項費用，雙方可于租金之外另行約定租賃保證金，即俗稱的押金。押金通常為一到三個月的租金。租賃關系終止時，租賃保證金可用于抵沖依合同約定由承租人承擔的各項費用，剩

余部分應返還承租人。在出現承租人提前退租、拖欠相關費用等情形時，允許出租人先行以租賃保證金抵沖相關費用，這對于出租人較為公平。

五、租賃登記的重要性租賃合同經雙方簽字蓋章后即行生效，但承租人應于之后要求將該租賃合同至房屋所在地的區(縣)房地產交易中心做備案登記，至此該租賃關系才能產生對抗第三人的效力。簽訂租賃合同后，該合同于雙方當事人之間固然有效，但如果此前于該房屋上已實際存在租賃關系或此后房東另行與他人設定租賃關系，且若該租賃關系經過備案登記，則承租人無法對抗已經過備案登記的租賃關系承租人，即實際由經過備案登記的承租人取得承租權。

六、轉租關系中承租人應注意的問題房屋的合法承租人在一定條件下有權全部或部分出租該房屋，此種出租行為即為轉租。但轉租在租賃范圍、時間等方面在很大程度上受到所有之前租賃合同的限制，即轉租的租賃條件不得大于作為本次出租人即上手承租人于上手租賃合同中取得的租賃條件，主要指租賃范圍、時間等，超出部分無效。另外在轉租房屋時，需要取得所有上手同意本次轉租關系的證明，該同意證明可以采用兩種形式：上手租賃合同中已約定承租人有轉租權或者所有上手直接對本次轉租提供同意證明。若未取得所有上手對此次轉租的上述任何一種同意證明，未同意轉租的上手隨時有權解除與其存在租賃關系的承租人之間的租賃合同，則此后所有轉租關系均將被相應解除。

最后，對于租賃期限內相關附屬設施、設備的使用，房屋的維修責任及相關費用的承擔，承租人是否有權對房屋進行裝修，及待租期屆滿時增添的設施、設備的歸屬、補償問題等，雙方也應有明確約定，以防在出現爭議后相互扯皮的現象。

首先要簽定租賃合同，簽合同時應注意事項：

1、查看出租人的房產證明和有效身份證明

2、簽訂租房合同時，應問清房租包含的內容，水、電、暖、煤氣（天然氣）和物業管理費由誰承擔。

3、要求出租人在房屋出租前結清水、電、暖、煤氣（天然氣）和其它費用。

4、明確租期、房租的付款時間和付款方式。

5、問清屋內家具、電器、其他設施的使用是否額外收費，由誰來承擔維修費用。

6、應對能否轉租做出約定。

7、要明確違約責任和違約的補償標準。

8、入住前檢查屋內家具、電器、其他設施的好損情況。其次，根據規定，租賃合同簽定后要去房產管理部門辦理登記備案手續。不過，出租方一般不太愿意辦理，因為要交納一些費用。

房屋租賃合同是指房屋出租人將房屋提供給承租人使用，承租人定期給付約定租金，并于合同終止時將房屋完好地歸還出租人的協議。房屋租賃合同內容主要包括房屋地址、居室間數、使用面積、房屋家具電器、層次布局、裝飾設施、月租金額、租金繳納日期和方法、租賃雙方的權利義務、租約等。

承租人的權利在承租期內占有、使用房屋。租期屆滿后，原承租人優先繼租。承租人的義務正當使用承租的房屋，按合同規定交付租金，在租期屆滿時將原房完好返還出租人。

出租人的權利是監督合理使用房屋，按合同收取租金，在租期屆滿后收回出租的房屋。其義務是將出租的房屋按合同規定交付承租人使用，并定期對房屋及設施進行檢查、維修，保證承租人使用。出租人和承租人就房屋出租的租金、期限、違約責任等條款達成一致意見后，租賃合同就成立了。成立后的房屋租賃合同有無法律效力，主要從下面四個方面進行審查。

(一)合同主體是否符合規定，即出租人與承租人是否具備有效民事行為的構成要件。如是否為無民事行為能力人或限制民事行為能力人，或出租人是否為房屋所有人或合法使用權人等。

(二)房屋是否為法律法規禁止出租。只要法律法規不禁止出租的房屋，都可以依法出租。根據規定，有下列情形之一的房屋不得出租：(1)未依法取得房屋所有權證的；(2)司法機關和行政機關依法裁定、決定查封或者以其他形式限制房地產權利的；(3)共有房屋未取得共有人同意的；(4)權屬有爭議的；(5)屬于違法建筑的；(6)不符合安全標準的；(7)已抵押，未經抵押權人同意的；(8)不符合公安、環保、衛生等主管部門有關規定的；(9)有關法律、法規規定禁止出租的其他情形。

(三)房屋租賃合同的內容是否合法。在實踐中，有些房屋租賃合同約定房客逾期支付租金、水電費等的滯納金按每日2%計算。從法律來說，這種約定因滯納金過高有失公平，屬于可撤銷條款。還有一種常見的情形是，有人用租來的房屋進行違法犯罪活動，若屬實，則在出租人明知或應當知道的情況下，這樣的租賃合同均是無效的，不受國家法律保護，租金依法沒收。

(四)是否進行過登記備案。《城市房地產管理法》、《城市房屋租賃管理辦法》及本市的租賃法規均規定，租賃當事人應向房產管理部門辦理登記備案手續。在實踐中，對未登記備案的租賃合同是否有效有兩種觀點，一種認為合同是無效的，另一種認為租賃合同仍然有效，但不具有對抗第三人的效力。出租人：（簡稱甲方）身份證號碼：

7、租賃期間，甲方要收回房屋，必須提前壹個月書面通知乙方，并雙倍返還乙方租房押金；如乙方需退房，必須提前壹個月書面通知甲方，經甲方同意所交押金退回。未經甲方同意，乙方提前解除合同，甲方有權沒收押金。
