一、延長刑事拘留的期限計算問題在延長刑事拘留的期限計算中常常出現的錯誤是期限計算不準確。辦案單位往往將刑事拘留的當日計算在內，導致對整個刑事拘留期間少計算1日的現象發生。

正確的計算方法是：刑事拘留是以日為計算單位而且期間開始之日不算在期間以內，即從期間開始的次日計算。期間的 屆滿以法定期間日數的最后一日為止。例如，犯罪嫌疑人某某于4月1日被刑事拘留，從第2日開始計算，期限屆滿日期為4月4日;如果延長刑事拘留4日的，期 限屆滿日期為4月8日;如果延長刑事拘留至30日的(即從4月4日延長27日)，由于4月份只有30天，期限屆滿日期為5月1日。

五、關于刑事拘留時間與治安拘留時間的折抵問題對于刑事拘留時間與治安拘留時間是否可以相互折抵問題，應當根據不同情形分別處理。

在司法實踐中,常常出現鑒定機構鑒定認為當事人誤工時間超過當事人受傷到該鑒定機構評定傷殘的時間,那么此時誤工時間是簡單的計算至定殘日前一天還是根據鑒定機構鑒定認為的實際誤工時間?

如由于鑒定機構作出的鑒定認為原告受傷后誤工時間為傷后4個月，但原告受傷至鑒定傷殘的時間只有3個月，因此被告(包括保險公司)均認為原告的誤工時間只能計算至定殘日前一天（即3個月），定殘日后的損失應為殘疾賠償金的賠償范圍，而不應計算在誤工費的損失之內。

但本人認為被告(包括保險公司)對司法解釋以及誤工費和殘疾賠償金的區別和定性的理解是錯誤和片面的，原告的誤工時間應為4個月，而不應計算至定殘日前一天：

首先，最高人民法院的司法解釋規定的是可以計算至定殘日前一天，而并非必須計算至定殘日前一天，其主要目的之一也在于防止鑒定機構作出鑒定誤工的時間和作出鑒定的時間相沖突。另外，在最高人民法院民事審判第一庭編著的《最高人民法院人身損害賠償司法解釋的理解與適用》一書第287頁也對計算誤工時間作出了解釋，其解釋為“受害人因傷致殘或者死亡的，誤工時間應當計算至定殘之日的前一日或者按照實際誤工時間計算”。最高人民法院民一庭對上述解釋是具有指導作用的，并且也認為誤工時間應根據實際誤工時間計算；

其次，殘疾賠償金與誤工費計算的理論基礎不同。《解釋》第25條第1款規定：“殘疾賠償金根據受害人喪失勞動能力程度或者傷殘等級，按照受訴法院所在地上一城鎮居民人均可支配收入或者農村居民人均純收入標準，自定殘之日起按二十年計算。但六十歲以上的，年齡每增加一歲減少一年；七十五周歲以上的，按五年計算。”這一規則實質上是以定額化賠償或定型化賠償為理論基礎制定的。所謂定額化賠償，即所有構成相同殘疾等級的人，在同一類別內（目前區分城鄉居民），不論其性別、就業狀況、收入差距都享受同樣的計賠標準。采取定額化計算時，不再考慮個體區別，其實質是根據勞動能力喪失程度抽象確定統一的標準。《解釋》第20條第3款規定：“受害人有固定收入的，誤工費

按照實際減少的收入計算。受害人無固定收入的，按照其最近三年的平均收入計算；受害人不能舉證證明其最近三年的平均收入狀況的，可以參照受訴法院所在地相同或者相近行業上一職工的平均工資計算。”這一規則是在差額化賠償理論與定額化賠償理論相結合的基礎上制定的，并且以差額化為主。所謂差額賠償，就是以被害人的財產狀況于損害事故發生與損害事故不發生兩種情形下的差額為根據確定賠償數額，體現全部賠償實際損失的原則。此種賠償方法充分考慮受害個體實際收入的差別，其根據受害人的具體情況和特點主觀量化計算利益損失。上述規定中，有固定收入的人和無固定收入但能舉證證明最近三年平均收入狀況的人，實質上都采用的差額化賠償；而無固定收入又無法舉證證明最近三年平均收入狀況的人，才采用定額化賠償。因此，由于定額賠償與差額賠償存在區別，殘疾賠償金與誤工費計算的理論基礎不同。該理論基礎也是得到了最高人民法院的支持的。（參見《最高人民法院人身損害賠償司法解釋的理解與適用》一書第288—291，317—318，437—

再次，評殘日作為誤工計算界限日缺乏科學性。根據目前的評殘規則，評定傷殘的時限主要有兩個：常規在臨床治療終結后進行；涉及功能障礙的一般在受傷6個月至9個月后方可進行。因此，對絕對大多數案件的受害人而言，何為臨床治療終結就顯得十分重要。法醫學上一般認為，所謂“臨床治療終結”是指受害者經過一定時間治療后，臨床醫學一般原則確定已治愈，或有一定后遺癥，但客觀檢查無陽性特征，或雖有癥狀和病理改變，臨床認為不需要處理或目前醫療手段無法處理的醫療時間。由此可見，法醫學上醫療終結概念既帶有較強的醫學知識，又非常抽象，伸縮空間很大，非常難以把握，并在司法實踐中產生嚴重分歧。有的認為，醫療終結日應為受害方第一次出院日；有的則認為，應為其在提起訴訟前最后一次治療日；還有的則認為，應為受害方申請評殘鑒定日。這一分歧，本應通過法律或司法解釋的強制性規定來加以彌合和縮小，遺憾的是我國有關法律和司法解釋并沒有對如何判斷醫療終結作出規定，進一步造成了仁者見仁、智者見智的狀況。顯然，計算至定殘日前一天的規則，建立在爭議很大、認識極不統一又無法律規制的“臨床治療終結”上，缺乏科學性；

最后，現行計算規則為當事人恣意規避法律提供了巨大空間。任何一項法律或司法解釋規則的制定，都應當最大限度地考慮合理性和最大限度地保障社會公平，如果讓當事人規避法律、恣意行事的空間過大，就會違反公平原則，有悖規則制定的初衷。正如上述第三點所述，由于“臨床治療終結”本身難以確定，誤

工時間計算至定殘前一天的規則，就給了當事人很大的自由操作的空間，甚至恣意規避法律。

綜上所述，無論是司法解釋的立法本意還是最高人民法院的理解或是誤工費和傷殘賠償金的理論差異，均認為誤工時間應計算至實際誤工之日，而不應計算至定殘之日。因此，原告的誤工時間應根據鑒定機構確定的誤工時間加以確定（參見《最高人民法院人身損害賠償司法解釋的理解與適用》一書第288—291，317—318，437—
