事由：為申請復議連續(xù)工齡一事

要求：提高補償安置標準和落實社會保障補償。

事實與理由：城郊鄉(xiāng)實施紫東項目遠離城區(qū)，在農業(yè)耕作區(qū)，200多畝上好的基本農田合理合法嗎？

改變改善劉馬洼村村民居住環(huán)境能實施嗎？ 村里還在原宅基地上蓋房，要他們搬可能嗎？ 占補復墾能實施嗎？土地綜合整治能落實嗎？

按4萬元/畝補償標準大部分未領，只有少部分是組干部代簽的，而且有些還未領，要實事求是的說問題，回家土地承包政策長遠有效，法律法規(guī)一再強調使征地農民生活水平有改善，長遠生計有保障，失地農民沒有了依賴生存的土地，沒有城鎮(zhèn)居民的社會保障在漫長的生活歲月里怎么辦。

把開發(fā)商的利益和后期的現(xiàn)價標準向失地農民的生活保障方可稍微傾斜一點使我們以后生計更多一點點保障不行嗎？

我們的這塊土地平整耕作層深，土質肥沃，排灌條件好，畝產收益是西大崗、上王崗的2倍，又沒有河灘地的洪水危害是高品質農田，我們人均地少（人均1畝）如果2畝那么情況則變了，還是實事既明顯又合法合理的要求，希望政府給予解決。

河南省區(qū)片綜合地價通知，我們不知道，但鄉(xiāng)領導給我們解釋我們是4萬，最高的是20萬/畝。

根據(jù)（國土資源部關于開展征地統(tǒng)一年產值標準和征地區(qū)片綜合地價工作的通知。

妥善處理征地補償標準的合法性、合理性、法定標準與農民的補償要求切實維護征地農民的合法權益，保證原有生活水平不下降長遠生計有保障要防止制訂和公布統(tǒng)一年產值的標準和區(qū)片綜合地價為由壓低補償標準，附件2中，修正因素主要考慮土地區(qū)位，人均耕地數(shù)量，土地供求關系，當?shù)亟洕l(fā)展水平和城鎮(zhèn)居民最低生活保障等因素。

3、對征地案例的比較修正應考慮區(qū)域因素，個別因素，時間因素。

另據(jù)2012年12月24日提請十一屆全國人大常委會三十次會議審議土地管理法修正草案，草案刪除了現(xiàn)行法47條中，按照被征地原用途補償，土地補償安置補助費的總和不得超過前三年平均年產質30倍的內容，已增加了社會保障補償根據(jù)土地承包期以前為30年和今后長遠有效這一實事，結合我們的實際，要求鄉(xiāng)政府將補償標準增至9萬，和社會保障補助。

行政復議申請書

申請人：錢嶺，男，1981年**月**日生，身份證號碼：32***************114，住江蘇省鎮(zhèn)江市潤州區(qū)常發(fā)廣場6號樓1309室，聯(lián)系電話：***。

被申請人：河南省鄭州市公安局交通警察支隊第二大隊，住所地：鄭州市花園路與三全路交叉口向西400米路北。申請請求：

撤銷鄭州市公安局交通警察支隊公安交通管理簡易程序處罰決定書（編號410102-1102251846）

事實與理由：

申請人因不服上述處罰決定書之內容，特申請復議，理由如下：

1、處罰事實不存在。根據(jù)處罰書所記載，申請人系違反《道路交通安全法實施條例》第44條第2款的規(guī)定，該條款的內容是“在道路同方向劃有2條以上機動車道的，變更車道的機動車不得影響相關車道內行駛的機動車的正常行駛”。而在事發(fā)時，申請人變更車道時，對本車道和被變更車道車輛均未有影響，所以處罰事實不存在。

2、處罰金額過高。根據(jù)《道路交通安全法》第90條的規(guī)定，罰款200元屬于最高幅度的處罰，就申請人的行為來說，即使有違章行為，也屬于及其輕微的違章行為，不應當

處罰200元。

3、處罰程序錯誤。首先，被申請人是屬于交警支隊的內設科室，不具備行政處罰主體資格，《行政處罰法》第十七條規(guī)定:“法律、法規(guī)授權的具有管理公共事務職能的組織可以在法定授權范圍內實施行政處罰”，《中華人民共和國道路安全法》第五條規(guī)定:“縣級以上地方各級人民政府公安機關交通管理部門負責本行政區(qū)域內的道路交通安全管理工作”，國務院《中華人民共和國道路安全法實施條例》第一百零九條規(guī)定：“對道路交通安全違法行為人處以罰款或者暫扣駕駛證處罰的，由違法行為發(fā)生地的縣級以上人民政府公安機關交通管理部門或者相當于同級的公安機關交通管理部門作出決定”。因此，應當是法定的公安機關交通管理部門，具有對道路交通安全違法行為人進行罰款處罰的行政執(zhí)法主體資格。而被申請人第二大隊作為支隊內設的科級單位，不具有行政執(zhí)法主體資格，沒有法律、法規(guī)授權實施行政處罰的權力。其次，根據(jù)《行政處罰法》第33條的規(guī)定“第違法事實確鑿并有法定依據(jù)，對公民處以五十元以下、對法人或者其他組織處以一千元以下罰款或者警告的行政處罰的，可以當場作出行政處罰決定。當事人應當依照本法第四十六條、第四十七條、第四十八條的規(guī)定履行行政處罰決定”。也就是說，按照簡易程序處理的違法行為，最多罰款不能超過50元，而被申請人被處罰200元違反法律規(guī)定。

第三，根據(jù)《行政處罰法》第39條第1款第5項的規(guī)定，“行政機關依照本法第三十八條的規(guī)定給予行政處罰，應當制作行政處罰決定書。行政處罰決定書應當載明下列事項：

（五）不服行政處罰決定，申請行政復議或者提起行政訴訟的途徑和期限”。應當在處罰決定書中注明若不服該處罰決定可在鄭州市哪個法院提起行政訴訟，但處罰決定書中該項為空白，這也違反了法律規(guī)定。

綜上所述，該處罰決定書依據(jù)事實不存在，處罰金額過高，處罰程序錯誤，應當予以撤銷，申請人特提起復議，請予支持復議請求。
