河南省農村〈獨生子女父母光榮證〉發放管理規定

核心提示：

第一條 為了保障公民實行計劃生育的合法權益，進一步規范全省《獨生子女父母光榮證》（以下簡稱《光榮證》）的發放管理工作，根據國家《人口與計劃生育法》、《河南省人口與計劃生育》（以下簡稱《條例》）等法

第一條 為了保障公民實行計劃生育的合法權益，進一步規范全省?獨生子女父母光榮證?（以下簡稱?光榮證?）的發放管理工作，根據國家?人口與計劃生育法?、?河南省人口與計劃生育?（以下簡稱?條例?）等法律、法規，制定本規定。

第二條縣級以上人口和計劃生育行政部門負責?光榮證?發放管理的監督指導工作。

鄉、鎮人民政府和街道辦事處負責轄區內?光榮證?的發放、建檔和日常管理工作。

第三條本省戶籍公民，未違反生育政策規定生育、未違法收養子女，夫妻的生子女、養子女、繼子女合計只有一個（依法收養的殘疾兒童、孤兒不計），不再生育的，可以申領?光榮證?。

第四條夫妻均系本省戶籍，經雙方單位（村（居）民委員會）核實，向女方戶籍所在地鄉鎮人民政府或街道辦事處申領?光榮證?。

一方為本省戶籍，一方為外省、自治區、直轄市戶籍的夫妻，由符合條件的本省戶籍一方向本人戶籍地的鄉、鎮人民政府或街道辦事處申領?光榮證?。

居住在本省的外省、自治區、直轄市戶籍公民，按國家和其戶籍所在地有關規定申領?光榮證?。

第五條?光榮證?丟失的，向原發證機關申請補辦。戶籍地變化的，憑原發證單位出具的證明，到現戶籍地的鄉、鎮人民政府或街道國企申請補發?光榮證?。

第六條夫妻雙方申請領取?光榮證?，應填寫?獨生子女父母光榮證申請表?。申請從的在村（居）民委員會應將申請人名單張榜公布 3日。無異議者，申請人的在村（居）民委員會將材料上報鄉、鎮人民政府或街道辦事處。

鄉、鎮人民政府或街道辦事處，對村（居）民委員會出具意見的?獨生子女父母光榮證申請表?進行審核，對符合條件的，發給?光榮證?；對有異議或不符合條件的，應當在 5個工作日內調查核實完畢，書面通知申請人，并說明理由。

對材料不齊全或不符合程序的申請，鄉、鎮人民政府或街道辦事處應當告知申請人需要補正的全部內容。

第七條申請領取?光榮證?的公民，應提供下列材料：

（一）身份證明；

（二）夫妻及子女戶籍證明；

（三）婚姻狀況證明；

（四）子女的出生證明或合法收養子女的證明。

第八條有下列情況之一的，?光榮證?無效，持證人應將?光榮證?繳回所在地鄉（鎮）人民政府、街道辦事處：

（一）申請生育第二個子女的，從申請之日起無效；

（二）違反規定生育子女的，自生育行為發生之日起無效；

（三）收養子女的，自收養關系確立之日起無效（依法收養殘疾兒童、孤兒的除外）；

（四）再婚夫妻雙方的子女存活數合計在 2個或 2個以上（包括自己撫養或離婚時叛隨對方、托人撫養、送人的存活子女）的；

（五）申請領取?光榮證?時，提供的申請材料不真實的，自始無效。發現當事人所持?光榮證?無效的，鄉、鎮人民政府或街道辦事處應當通告當事人所在單位，停止其獨生子女父母待遇；通知當事人退回?光榮證?和已享受的獨生子女父母獎勵費、其他計劃生育獎勵。

第九條對領取?光榮證?后，又生育第二個子女的夫妻，行政村負責上報名單，發證機關填寫?河南省退回?獨生子女父母光榮證?家庭追繳、終止獎勵費登記表?。對已收繳?光榮證?的，名單張榜公布 3日，鄉、村計生工作人員在獨生子女父母光榮證檔卡 “備注 ”欄內注明?光榮證?收回日期，并及時變更鄉級 “優先優惠政策信息庫 ”戶資料。

第十條鄉、鎮人民政府和街道辦事處應對本轄區?光榮證?發放、變更等情況建檔立卡、統計上報，發放?光榮證?名單報縣（市、區）人口和計劃生育行政機關備案。

省轄市人口和計劃生育委員會對本轄區?光榮證?發放、管理情況，按照省人口計生委要求，定期上報。

第十一條 縣（市、區）人口和計劃生育行政機關應加強對?光榮證?的發放管理工作的監督檢查，對無故拖延發證、弄虛作假的，要追究經辦人的責任和有關領導責任。

第十二條?光榮證?證件編號由各地自行規定；證件發放夫妻雙方合持一證，特殊情況獨生子女父母要求各持一證的，可分別辦理。

第十三條?光榮證?全省統一樣式，定點負責制，免費發放。

第十四條 本規定自文件下發之日起施行。凡農業人口此前持有效?光榮證?的，鄉、鎮人民政府和街道辦事處需在 2006年 3月底前統一換發完畢。
