中華人民共和國海關進出境郵遞物品監管辦法

（征求意見稿）

第一條 為了規范海關對進出境郵遞物品的監管，促進郵政業務的健康發展，根據《中華人民共和國海關法》（以下簡稱《海關法》）及有關法律、行政法規的規定，制定本辦法。

第二條 海關對進出境郵遞物品、國際郵袋、郵件集裝箱、郵件總包等進行監管，適用本辦法。

法律、行政法規、海關規章對貨物通過郵政渠道進出境監管有規定的，從其規定。法律、行政法規、海關規章未作規定的事項，參照本辦法進行監管。

第三條 進境郵遞物品、國際郵袋、郵件集裝箱、郵件總包自進境起到辦結海關手續止，出境郵遞物品、國際郵袋、郵件集裝箱、郵件總包自向海關申報起到出境止，應當接受海關監管并存放于海關監管場所內。

未經海關許可，任何單位及個人不得擅自開拆、分揀、封發、運輸、投遞進出境郵遞物品、國際郵袋、郵件集裝箱、郵件總包或者對進出境郵遞物品、國際郵袋、郵件集裝箱、郵件總包進行其他處臵。

第四條 進境郵遞物品的收件人、出境郵遞物品的寄件人應當按照海關規定如實申報姓名、住址、身份證件種類及號碼等身份信息以及所收寄物品的相關情況，并辦理相關手續。除另有規定外，收寄件人可以委托郵政企業或者其他代理人辦理海關手續。

收寄件人委托郵政企業或者其他代理人辦理海關手續的，應當向郵政企業或者其他代理人提供所收寄物品和收寄人身份信息的真實情況；郵政企業或者其他接受收寄件人委托代為辦理海關手續的代理人，應當對委托人所提供情況的真實性進行合理審查，遵守相關規定并承擔責任。

第五條 進出境個人郵遞物品有下列情形之一的，收件人、寄件人應當主動向海關提交《中華人民共和國海關進出境個人郵遞物品申報單》和有關單證，辦理申報納稅等海關手續：

（一）超過海關規定數量、金額，但是仍在合理數量內的；

（二）需要提交許可證件或者證明的；

（三）按照海關總署規定應當申報的其他情形。

第六條 進境郵遞物品的收件人經海關同意，可以在申報前查看物品。

第七條 個人郵寄物品進境，海關依法征收進口稅。

進境個人郵遞物品在海關規定數量及金額內的，免征進口稅。

進境個人郵遞物品超過海關規定數量、金額，但仍在合理數量內的，由進境個人郵遞物品的收寄件人在物品放行前按照規定繳納進口稅。

本辦法第五條、第六條規定中的“海關規定數量、金額”由海關總署另行制定并公布。第八條 同一收寄件人郵寄進出境的個人物品，經同一郵件總包郵遞進出境的，應當合并計算其數量、價值。

第九條 進出境郵遞物品的收寄件人和郵政企業，應當遵守國家關于貨物、物品進出境及寄遞的禁止性、限制性規定。

郵政企業應當依法對收寄的郵遞物品進行驗視，對國家禁止出境的物品應當拒絕收寄。郵政企業在已收寄的進出境郵遞物品中發現禁止或限制進出境物品的，應當立即通知海關并協助調查、處理。

第十條 侵犯受法律和行政法規保護的知識產權的進出境郵遞物品，由海關依照《中華人民共和國知識產權海關保護條例》及相關規定處理。

第十一條 進出境郵遞物品有下列情形之一的，郵政企業應當交由海關依法處理：

（一）進境郵遞物品無法投遞又無法退回的；

（二）在海關規定期限內未辦理海關手續或者無人認領，并且無法退回的；

（三）進出境郵遞物品所有人聲明放棄的；

（四）屬于本辦法第九條、第十條規定情形的；

（五）其他應當交海關處理的。

第十二條 除法律、行政法規另有規定外，進出境郵遞物品辦結海關手續前，收件人、寄件人依法申請退運的，經海關審核同意后，交郵政企業辦理退運。第十三條 超出合理數量、規定金額的個人郵遞物品應當按照貨物相關規定辦理手續。收寄件人選擇退運的，按照本辦法第十二條規定辦理。

常駐機構公用物品、非居民長期旅客自用物品和外國駐中國使（領）館及其人員公用和自用物品、音像制品及印刷品等，按照海關有關規定辦理手續。

第十四條 郵遞物品、國際郵袋、郵件集裝箱、郵件總包進境、出境、過境、轉運、轉關的，郵政企業應當采用電子數據、紙質單證等形式向海關如實申報。

第十五條 郵政企業開展進出境郵遞物品、國際郵袋、郵件集裝箱、郵件總包運輸、報關、監管場所經營等業務，應當符合海關對進出境運輸工具負責人、報關企業及監管場所經營企業等管理規定的要求。

第十六條 郵政企業辦理進出境國際郵袋、郵件集裝箱、郵件總包等進境、出境、過境、轉運、轉關等手續以及進行裝卸、開拆和封發等作業，應當在設有海關的地點進行，并接受海關監管和檢查。

第十七條 進出境郵遞物品應當接受海關查驗。

海關查驗進出境郵遞物品時，郵政企業工作人員應當到場協助，負責物品的搬移、開拆和重新包（封）裝，并作為見證人或者受委托的代理人，在《中華人民共和國海關進出境郵遞物品查驗記錄單》等有關法律文書上簽章。海關認為必要時，也可以通知進出境郵遞物品收寄件人到場協助查驗，并由其負責物品的搬移、開拆和重新包（封）裝。

進出境郵遞物品收寄件人不在場的，海關應當在查驗結束時將《中華人民共和國海關查驗告知單》放入被查驗郵件內并施加海關封志。

未辦結海關手續的進出境郵遞物品，未經海關同意，任何單位和個人不得開拆、破壞海關封志。

第十八條 進出境郵遞物品經查驗需要辦理申報、納稅等海關手續的，海關應當制發《中華人民共和國海關辦理進出境郵遞物品海關手續通知書》，交由郵政企業送達收寄件人。

進出境郵遞物品經海關查驗放行的，直接交郵政企業投遞。

第十九條 國際郵件互換局、國際郵件交換站（以下統稱國際郵件互換局、交換站）是海關監管場所。

郵政企業設立、變更、申請注銷國際郵件互換局、交換站等海關監管場所的，應當向海關總署提出申請。

第二十條 郵政企業應當在國際郵件互換局、交換站直接對外封發、接收及交換郵件總包，并接受國際郵件互換局、交換站所在地海關監管。

郵政企業不得在未設立國際郵件互換局、交換站的地區直接對外封發、接收及交換郵件總包。自未設立國際郵件互換局、交換站的地區郵遞進出境的郵件應當由境內其他地區的國際郵件互換局辦理郵遞手續，國際郵件互換局所在地主管海關對有關進出境郵袋和郵件實施監管。

第二十一條 郵政企業承運進出境（含過境、轉運、通運）郵件總包的，應當填寫《中華人民共和國海關進出境郵件總包（郵袋）郵運路線及郵運方式備案表》，將進出境郵件總包（郵袋）在境內的郵運路線（以下簡稱郵路）及郵運方式向所在地主管海關備案，并按照海關規定辦理相關手續。

郵政企業可以委托其他企業承運進出境（含過境、轉運）郵件總包，但應當按照本辦法規定履行申報、協助查驗等義務。

因特殊原因，郵路或者郵運方式需要臨時調整的，郵政企業應當事先報告所在地主管海關及調整后的相關海關，所在地海關及相關海關均同意后方可調整。調整原因消除后，應當立即報告所在地主管海關及相關海關，并繼續按照原備案郵路及郵運方式郵遞物品。

第二十二條 郵政企業應當按照向海關備案的郵路和郵運方式，將進出境郵件總包、國際郵袋和郵件集裝箱完整、及時地運抵指定的監管場所，并確保封志完好無損。

第二十三條 進出境郵件總包在一個設關地點未辦結全部海關手續，需轉至另一設關地點繼續辦理的，應當辦理海關轉關監管手續。

辦理進出境郵件總包轉出手續的海關為轉出地海關，辦理進出境郵件總包轉入手續的海關為轉入地海關。

第二十四條 郵政企業辦理轉關手續時，應當向轉出地海關提交電子、紙質《中華人民共和國海關進出境郵件總包轉關申報單》、進出境郵件總包路單、封發清單，轉出地海關據以驗核進出境郵件總包（郵袋）封志、數量及號碼，并制作關封交郵政企業。

郵件總包運抵轉入地海關監管場所后，郵政企業應當立即通知轉入地海關并提交關封。轉入地海關審核轉關電子數據，驗核關封、郵件總包（郵袋）封志、數量及號碼，辦理轉關核銷手續。

因郵政企業運力安排等原因導致海關無法正常核銷轉關的，郵政企業應當及時向轉出地海關提交《中華人民共和國海關進出境郵件總包轉關申報單修改申請表》，并辦理相關手續。

第二十五條 郵政企業辦理郵件總包過境、轉運手續，應當向進境地海關提交郵件總包路單。轉運郵件總包進境、出境不在同一地點的，進境地海關驗核后制作關封，出境地海關憑關封辦理出境手續。

第二十六條 郵政企業開拆及封發進出境郵袋前，應當及時通知海關，并在海關監管下進行作業。

進境郵袋開拆前及出境郵袋封發前，郵政企業應當向海關提交相關郵遞物品電子信息

第二十七條 郵政企業接收進出境郵遞物品、國際郵袋、郵件集裝箱、郵件總包發生誤卸、損毀等事故時，應當及時通知所在地主管海關，并辦理相關補充或者變更申報手續。

第二十八條 本辦法中下列單證的標準樣式及有關事項，由海關總署另行規定：

（一）中華人民共和國海關進出境個人郵遞物品申報單；

（二）中華人民共和國海關進出境郵遞物品查驗記錄單；

（三）中華人民共和國海關查驗告知單；

（四）中華人民共和國海關辦理進出境郵遞物品海關手續通知書；

（五）中華人民共和國海關進出境郵遞物品退運申請書；

（六）郵政企業設立、變更、注銷國際郵件監管場所注冊登記申請書；

（七）中華人民共和國海關進出境郵件總包轉關申報單；

（八）中華人民共和國海關進出境郵件總包（郵袋）郵運路線及郵運方式備案表；

（九）中華人民共和國海關進出境郵件總包轉關申報單修改申請表；

（十）海關對進出境個人郵遞物品規定的數量、金額、進口稅起征點。

第二十九條 進出境郵遞物品有關單證應當自制發之日起留存18個月。依法由海關留存的，海關按照有關規定保存。

第三十條 進境郵遞物品收件人、出境郵遞物品寄件人、郵政企業違反本辦法，構成走私行為、違反海關監管規定行為或者其他違反海關法行為的，由海關依照《海關法》、《中華人民共和國海關行政處罰實施條例》及其它有關法律、行政法規的規定予以處理；構成犯罪的，依法追究刑事責任。第三十一條 本辦法下列用語的含義: 進出境郵遞物品，是指郵政企業通過郵政網絡承攬、承運進出境的個人物品及其他物品，包括印刷品、小包、包裹等郵政普遍服務的郵件和郵政速遞郵件。

進出境個人郵遞物品，是指收件人（自然人）本人或者本人家庭自用、寄件人（自然人）饋贈親友，且屬于海關規定的個人物品數量、金額內的日常生活用物品。

收件人，是指進境郵遞物品的境內收取人（包括自然人、法人和其他組織）。

寄件人，是指出境郵遞物品的境內交寄人（包括自然人、法人和其他組織）。

郵遞物品申報單證，是指由萬國郵聯、世界海關組織等確定用于進出境郵遞物品的相關單證，以及中國海關要求的申報單證。

郵件路單，是指載有郵件總包號碼、原寄局及寄達局、內含件數及重量、承載的運輸工具等郵路信息的萬國郵聯規定單證。

進出境郵件總包，是指境內外國際郵件互換局每次向對方互換局封發的郵件集合，總包可以由一袋、若干袋或者不裝袋的外走郵件組成，盛裝容器可以為郵袋、集裝箱等。

第三十二條 本辦法由海關總署負責解釋。

第三十三條 本辦法自2012年 月 日起施行。1958年對外貿易部海關總署發布的《海關對國際郵袋裝卸轉運監管辦法》（?58?關行字第570號）同時廢止。

5.所在機構名稱及海關代碼：境內所在機構的規范中文全稱及海關十位數代碼。

8.居留證件號碼：有效期一年期以上居留許可證號碼或華僑、港澳同胞暫住證號碼或臺灣居民居留簽注號碼等。

9.身份證件號碼：外國（地區）企業常駐代表機構工作證、外國人就業證、外國專家證等證件的號碼（中國駐外使領館館員填寫駐外使領館人員身份證明號碼）。

10.物品批文號：填寫相關部門批準進出境禁限物品的批準文號，無禁限物品的免填。

11.聯系電話：境內聯系電話。以下內容按提貨單填寫

12.進/出境：進境、出境、其他（寫明原因，如報廢等）。13.進出境口岸：物品實際進出我國關境口岸海關的名稱。

14.啟運/運抵國（地區）：啟運國（地區）指進口貨物直接運抵我國的起始發出的國家（地區）；運抵國（地區）指出口貨物離開我國關境直接運抵的國家。

無實際進出境的，本欄目填報中國。請按海關規定的《國別（地區）代碼表》選擇填報相應的起運/運抵國（地區）的中文名稱。

15.裝貨/指運港：裝貨港指進口物品在運抵我國關境前的最后一個境外裝運港；指運港指出口物品運往境外的最終目的港。無實際進出境的，本欄目填報“中國境內”。請按海關規定的《港口航線代碼表》選擇填報相應的港口中文名稱。

16.運輸方式：水路運輸；鐵路運輸；汽車運輸；航空運輸；郵政運輸； 其它運輸（須注明具體方式）。

注：非郵政方式進出口的快遞物品，按實際運輸方式填報，如航空運輸；進出境旅客隨身攜帶的自用物品，應填報其它運輸。

17.運輸工具名稱：水路運輸填報船舶編號或船舶英文名稱；鐵路運輸填報車廂編號或交接單號；汽車運輸填報該跨境運輸車輛的國內行駛車牌號；航空運輸免予填報；郵政運輸填報郵政包裹單號；其它運輸填報具體運輸方式名稱。

18.航次(班)號：水路運輸填報船舶的航次號；鐵路運輸填報進出境日期；汽車運輸填報該跨境運輸車輛的進出境日期（8位）；航空運輸免予填報；郵政運輸填報進出境日期；其他各類運輸方式免予填報。

19.提運單號：水路運輸填報進出口提運單號，如有分提運單的，填報進出口提運單號+“*”+分提運單號；鐵路運輸填報運單號；汽車運輸免予填報；航空運輸填報總運單號+“_”(下劃線)+分運單號,無分運單的填報總運單號；郵政運輸填報郵運包裹單號；其他各類運輸方式免予填報。

20.件數：按提貨單或場站收據填寫。

21.毛重(千克)：按提貨單或場站收據填寫。計量單位為千克，不足1千克的填報為“1”。

22.備注：需向海關說明的其它情況。（中國駐外使領館館員在此欄填報離任回國證明書號、境外購車日期、發票號碼）

23.申請人身份類別：選擇以下一種身份填寫。

常駐人員；非居民長期旅客；來華定居旅客；中國駐外使領館館員；其他人員。

24.進/出境日期：運輸工具進/出境的日期，無實際進出境的填申報日期。25.包裝種類：選擇以下一種內包裝填報。木箱；紙箱；桶裝；散裝；托盤；包； 其它。

26.體積：按提貨單或場站收據填寫，計量單位為立方米。

27.標箱數：標準集裝箱數量（散貨填報為“0”，1個20呎集裝箱填報為“1”，1個40呎集裝箱填報為“2”，以此類推）。

28.內包裝件數：內包裝箱（如紙板箱）件數。

29.受托方名稱及海關代碼（身份證件號碼）：委托代理公司申請的，填報代理公司名稱及海關代碼；委托他人申請的，填報受托人姓名和身份證件號碼。以下內容按裝箱清單、發票填寫： 30.項號：物品序列號。

31.物品稅號：按《入境旅客行李物品和個人郵遞物品進口稅稅則歸類表》歸類填寫。

32.物品名稱：物品規范的中文商品名稱。汽車申報為：車輛牌名（如捷達、佳美等）+排氣量（以“CC”為單位）+車型（如越野車、小轎車等）+車駕號，舊車應在車輛牌名前加“舊”字，新車不加。

33.規格/型號：如普通電視機應申報熒幕尺寸，冰箱應申報容積數，汽車申報型號，如E320、750I等。

34.數量：按申請物品的實際數量填寫。如電腦主機1臺、CD片20片、家具5件。

35.單位：按法定計量單位填寫。36.幣制：按發票幣制填寫。37.總價：該項物品的總價。

38.申請人簽名：由申請人本人按進出境有效證件簽字樣式簽名。39.機構簽章:申請人所在機構公章。40.申請日期：向海關呈交申請表的日期。41.附頁數：附頁總頁數（無附頁的填“0”）。

11.提運單號：水路運輸填報進出口提運單號，如有分提運單的，填報進出口提運單號+“*”+分提運單號；鐵路運輸填報運單號；汽車運輸免予填報；航空運輸填報總運單號+“_”(下劃線)+分運單號,無分運單的填報總運單號；郵政運輸填報郵運包裹單號；其他各類運輸方式免予填報。

12.件數：按提貨單或場站收據填寫。

13.毛重（千克）：按提貨單或場站收據填寫。計量單位為千克，不足1千克的填報為“1”。

14.備注：需向海關說明的其它情況。

15.進/出境日期：運輸工具進/出境的日期。無實際進出境的填申報日期。16.包裝種類：請選擇以下一種包裝填報。木箱；紙箱；桶裝；散裝；托盤；包；其它。

第一章 總 則

第一條 依照《中華人民共和國海關法》，制定本辦法。

第二條 進出境旅客行李物品，必須通過設立海關的地點進境或者出境。

第三條 進出境旅客必須將所帶的全部行李物品交海關查驗。在交驗前，應填寫“旅客行李申報單”或海關規定的其他申報單證向海關申報；或按海關規定的申報方式如實向海關申報。

旅客經由實施“紅綠通道”驗放制度的海關進出境，應按照海關公布的選擇“紅綠通道”的規定，選擇通道，辦理行李物品進境或出境手續。

第四條 查驗進出境旅客行李物品的時間和場所，由海關指定。海關查驗行李物品時，物品所有人應當到場并負責搬移物品，開拆和重封物品的包裝。海關認為必要時，可以單獨進行查驗。海關對進出境行李物品加施的封志，任何人不得擅自開啟或者損毀。

第五條 進出境旅客可以自行辦理報關納稅手續，也可以委托他人辦理報關納稅手續；接受委托辦理報關納稅手續的代理人應當按照本辦法對其委托人的各項規定辦理海關手續，承擔各項義務和責任。

第六條 旅客行李物品，應以自用合理數量為限，超出自用合理數量范圍的，不準進境或出境。旅客行李物品，經海關審核，按本辦法附件《旅客進出境行李物品分類表》（以下簡稱《分類表》）規定的范圍驗放。進出境物品的合理數量和準許各類旅客進出境物品的具體限值、限量及征免稅規定，另行制定。

第七條 旅客攜運《中華人民共和國禁止進出境物品表》所列的物品進出境，在海關檢查以前主動報明的，分別予以沒收或者責令退回，并可酌情處以罰款。藏匿不報的，按照《中華人民共和國海關法》第四十七條、第四十八條的規定處罰。

旅客攜運《中華人民共和國限制進出境物品表》所列物品和中華人民共和國政府特別管制的物品進出境，海關按國家有關法規辦理。第八條 旅客以分離運輸方式運進行李物品，應當在進境時向海關申報。經海關核準后，自旅客進境之日起6個月內（含6個月，下同）運進。海關辦理驗放手續時，連同已經放行的行李物品合并計算。以分離運輸方式運出的行李物品，應由物品所有人持有效的出境證

件在出境前辦妥海關手續。

第九條 經海關核準暫時進出境的旅行自用物品，在旅客行李物品監管時限內，由旅客復帶出境或進境。海關依照規定憑擔保準予暫時免稅放行的其他物品，應由旅客在規定期限內，辦結進出境手續或將原物復帶出境或進境。

第十條 進出境物品所有人聲明放棄的物品和自運輸工具申報進境之日起逾期3個月（易腐及易失效的物品可提前處理，下同）未辦理海關手續的物品，以及在海關監管區內逾期3個月無人認領的物品，均由海關按照《中華人民共和國海關法》第三十三條的規定處理。第十一條 旅客攜運屬下列情形的物品，海關不予放行，予以退運或由旅客存入海關指定的倉庫。物品所有人應當在3個月內辦理退運、結案手續。逾期不辦的，由海關依照本辦法第十條 的規定處理。

（一）不屬自用的；

（二）超出合理數量范圍的；

（三）超出海關規定的物品品種、規格、限量、限值的；

（四）未辦理海關手續的；

（五）未按章繳稅的；

（六）根據規定不能放行的其他物品。

第十二條 旅客應在旅客行李物品監管時限內，依照本辦法和根據本辦法制定的其他管理規定，辦結物品進出境的海關手續。

第十三條 海關依照本辦法和根據本辦法制定的其他管理規定免稅放行的物品，自物品進境之日起2年內，出售、轉讓、出租或移作他用的，應向海關申請批準并按規定補稅。按規定免稅或征稅進境的汽車，不得出售、轉讓、出租或移作他用。在汽車運進使用2年后，因特殊原因需要轉讓的，必須報經海關批準；其中免稅運進的，應按規定補稅。

第十四條 進境旅客攜帶“境外售券、境內提貨”單據進境，應向海關申報，海關辦理物品驗放手續時，連同其隨身攜帶的實物合并計入有關征免稅限量。

第十五條 涉及特定地區、特定旅客和特定物品進出境的管理規定，由中華人民共和國海關總署授權有關海關依照本辦法的原則制定，經海關總署批準后，予以公告實施。

第十六條 進出境旅客未按本辦法或根據本辦法制定的其他管理規定辦理進出境物品的申請、報關、納稅以及其他有關手續的，有關物品不準進境或出境。對違反本辦法并構成走私或違反海關監管規定行為的，海關依照《中華人民共和國海關法》和《中華人民共和國海關法行政處罰實施細則》給予處罰。

第二章 短期旅客

第十七條 短期旅客攜帶進出境的行李物品應以旅行需用物品為限。

短期旅客中的居民和非居民中的中國籍人攜帶進境屬于《分類表》第三、四、五類物品，海關按照規定的限值、限量予以征稅或免稅放行（注）。短期旅客中的其他非居民攜帶進境屬于《分類表》第三、四、五類物品，海關按本辦法第九條規定辦理。

經常進出境的邊境居民，邊境郵政、運輸機構工作人員和邊境運輸工具服務人員，以及其他經常進出境的人員，攜帶進出境的物品，除另有規定者外，應以旅途必須應用的物品為限。未經海關批準，不準帶進屬于《分類表》第三、四、五類物品。

持特殊通行證件來往香港、澳門地區的短期旅客進出境行李物品的管理規定，海關依據本辦法另行制定的規定辦理。

第三章 長期旅客

第十八條 長期旅客中的非居民進境后，在規定期限內報運進境其居留期間自用物品或安家物品，應事先向主管海關提出書面申請，海關憑中華人民共和國政府主管部門簽發的長期居留證件（或常駐戶口登記證件）、其他批準文件和身份證件，辦理審批驗放手續。上述人員在辦妥上述手續前進出境或在境內居留期間臨時出、進境攜帶的物品，海關依照本辦法第十七條規定辦理。

第十九條 長期旅客中的居民進出境行李物品的管理規定，根據本辦法另行制定。

第四章 定居旅客

第二十條 獲準進境定居的旅客在規定期限內報運進境安家物品，應事先向主管海關提出書面申請，并向海關交驗中華人民共和國政府主管部門簽發的定居證明或批準文件辦理審批手續。經核準，其在境外擁有并使用過的數量合理的自用物品，準予免稅進境；自用小汽車準予每戶征稅進境一輛。旅客持主管海關的書面通知，到物品進境地海關辦理驗放手續。

進境定居旅客自進境之日起，居留時間不滿2年，再次出境定居的，其免稅攜運進境的安家物品應復運出境，或向海關補稅。第二十一條 獲準出境定居的旅客攜運出境的安家物品，除國家禁止或限制出境的物品需按有關規定辦理外，均可予以放行。

第五章 過境旅客

第二十二條 過境旅客未經海關批準，不得將物品留在境內。

第二十三條 進境后不離開海關監管下的交通工具或海關監管區直接出境的旅客，海關一般不對其行李物品進行查驗，但必要時，海關可以查驗。

第二十四條 過境旅客獲準離開海關監管區，轉換交通工具出境的，海關依照本辦法第十七條規定辦理。

第六章 附 則

第二十五條 享有外交特權和豁免的人員攜運進出境的行李物品，另按中華人民共和國海關總署制定的有關規定辦理。

第二十六條 本辦法的附件，由中華人民共和國海關總署根據具體情況修訂發布實行。

第二十七條 本辦法下列用語含義：

“非居民”指進境居留后仍回到境外其通常定居地者。

“居民”指出境居留后仍回到境內其通常定居地者。

“旅客”指進出境的居民或非居民。

“短期旅客”指獲準進境或出境暫時居留不超過1年的旅客。

“長期旅客”指獲準進境或出境連續居留時間在1年以上（含1年）的旅客。

“定居旅客”指取得中華人民共和國主管部門簽發的進境或出境定居證明或批準文件，移居境內或境外的旅客。

“過境旅客”指持有效過境簽證，從境外某地，通過境內，前往境外另一地的旅客。

“行李物品”指旅客為其進出境旅行或者居留的需要而攜運進出境的物品。

“自用”指旅客本人自用、饋贈親友而非為出售或出租。

“合理數量”指海關根據旅客旅行目的和居留時間所規定的正常數量。

“旅客行李物品監管時限”指非居民本次進境之日始至最近一次出境之日止，或居民本次出境之日始至最近一次進境之日止的時間。“分離運輸行李”指旅客在其進境后或出境前的規定期限內以托運方式運進或運出的本人行李物品。

“征免稅”指征收或減免進出口關稅（即進口旅客行李物品和個人郵遞物品稅）。

“擔?！敝敢韵蚝ｊP繳納保證金或提交保證函的方式，保證在規定期限內履行其承諾的義務的法律行為。

第二十八條 本辦法由中華人民共和國海關總署解釋。

第二十九條 本辦法自1989年12月1日起實施。

原對外貿易部1958年9月29日（58）關行林字第985號命令發布的《海關對進出境旅客行李物品監管辦法》同時廢止。

JG41填表說明：

1.申請人姓名（中英文）：按進出境有效證件填寫。2.性別：按進出境有效證件填寫。

3.國籍：按進出境有效證件填寫（中國駐外使領館館員不填寫國籍，填寫原駐在國及駐在城市）。4.出生年月：按進出境有效證件填寫。

5.所在機構名稱及海關代碼：境內所在機構的規范中文全稱及海關十位數代碼。6.住址：境內住址。

7.護照或通行證號碼：進出境有效證件的號碼。

8.居留證件號碼：有效期一年期以上居留許可證號碼或華僑、港澳同胞暫住證號碼或臺灣居民居留簽注號碼等。

9.身份證件號碼：外國（地區）企業常駐代表機構工作證、外國人就業證、外國專家證等證件的號碼（中國駐外使領館館員填寫駐外使領館人員身份證明號碼）。

10.物品批文號：填寫相關部門批準進出境禁限物品的批準文號，無禁限物品的免填。11.聯系電話：境內聯系電話。

以下內容按提貨單填寫

12.進/出境：進境、出境、其他（寫明原因，如報廢等）。13.進出境口岸：物品實際進出我國關境口岸海關的名稱。14.啟運/運抵國（地區）：啟運國（地區）指進口貨物直接運抵我國的起始發出的國家（地區）；運抵國（地區）指出口貨物離開我國關境直接運抵的國家。無實際進出境的，本欄目填報中國。請按海關規定的《國別（地區）代碼表》選擇填報相應的起運/運抵國（地區）的中文名稱。

15.裝貨/指運港：裝貨港指進口物品在運抵我國關境前的最后一個境外裝運港；指運港指出口物品運往境外的最終目的港。無實際進出境的，本欄目填報“中國境內”。請按海關規定的《港口航線代碼表》選擇填報相應的港口中文名稱。16.運輸方式：水路運輸；鐵路運輸；汽車運輸；航空運輸；郵政運輸； 其它運輸（須注明具體方式）。
