女生留學 翻譯出錯怒訴公證處并將其告上法庭 時間： 2014-01-06 09:06 中國法院網訊(李媛潔)家住廣西欽州市一藺姓女大學生，本懷揣一顆出國深造的夢想，興沖沖跑去公證處辦理出國留學手續，豈料，因為公證處翻譯出了差錯讓她痛失了出國留學的機會，該女學生一怒之下將公證處告上了法庭。近日，廣西欽州市欽南區人民法院審理了此案。

原告小藺稱自己本想要前往韓國留學，辭去了原來穩定的工作，并事前已經積極聯系好了韓國的大學。一家韓國大學經審理原告的資料后同意接受原告的留學申請，于是原告按學校的要求實際繳納了留學學費，等韓國大使館辦理完畢留學簽證后即可出國留學。韓國大使館經審查原告資料后，告知原告需提供親屬關系公證證明書及公證書的中英文對照版本后才即可辦理留學簽證。于是原告前往被告處辦理親屬關系公證書，并要求被告提供中英文對照公證書。被告受理原告相關公證申請后，于2013年1月10日作出公證書，對原告申請辦理的親屬關系證明以及中英文對照版本作出了相應公證證明。原告拿到被告提供的公證書后，前往韓國大使館辦理相關出國留學簽證，但是，韓國大使館最后拒絕了原告的出國留學簽證申請，理由為原告提供的親屬關系公證證明錯誤，懷疑原告提供虛假證明材料。至此，原告才知道被告提供的公證書中的英文翻譯存在多處明顯錯誤，這讓大使館嚴重懷疑原告的誠信，韓國學校將原告的學費退回，導致原告出國留學的夢想破滅，原告的人生軌跡發生了重大變化，對原告及原告家人帶來了巨大的傷害。

原告小藺庭審時稱，被告作為一家專業性的、專門的司法證明機構，依法應對提供證明材料的真實性、合法性予以保障，但由于被告的嚴重不負責任，提供的具有法律效力的證書存在多處明顯錯誤，使得原告在辦理出國留學簽證被認定為提供虛假證明材料，直接導致原告未能出國留學，對原告精神造成了巨大傷害。同時，原告因辦理出國留學事宜，前期已花費了大量的人力財力，包括但不限于公證費用、畢業證認證費用、體檢費用、材料復印郵遞費用及相關差旅費用。被告公證處辯稱，原告沒有提供證據證實其申請出國簽證及不能辦理簽證手續的原因是因為公證文書的錯誤所致使，也沒有提供證據證實其經濟損失情況，因此，原告的訴訟沒有事實和法律依據。

綜合全案證據，法院確認以下法律事實：2013年1月10日，原告前往被告處辦理親屬關系公證書，被告根據原告提供的材料作出公證書，對原告申請辦理的親屬關系證明以及中英文對照版本作出了相應的公證證明，但在英文翻譯版本中，筆誤譯錯了“關系人related(譯錯為relatted)”、“申請人applicant(譯錯為applicantuo)”及“公證員 notary(譯錯為notay)”三處。原告據此向法院起訴，認為韓國大使館因為原告提供的親屬關系公證書中的英文翻譯存在多處明顯錯誤、懷疑原告提供虛假證明材料，最后拒絕了原告的出國留學簽證申請，韓國學校將原告的學費退回，導致原告出國留學的夢想破滅，原告的人生軌跡發生了重大變化，對原告及原告家人帶來了巨大的傷害，要求被告賠償公證費用、畢業證認證費用、體檢費用、材料復印郵遞費用及相關差旅費用等合計人民幣2000元及精神損失費人民幣10萬元。

一般來說，公證書翻譯為“notary certificate”。要注意，切忌將公證書翻譯成“notarial certification”。

在結尾方面，中國公證書一般為“特此證明”，翻譯為“it is hereby certified”。

而外國公證書結尾一般為一段宣誓這類的語句，如“in faith and testimony whereof i have hereunto set may hand and affixed my seal of office this10th december 2008”。這段公證詞翻譯成中文比較費解，一般來說采用意譯更符合中國國情，翻譯成“我宣誓，上述公證屬實??”。特別注意，英文公證詞結尾在描述日期上不使用“on”這個詞。
