第二篇：英語詩歌的類別

1.十四行詩(Sonnet)源于中世紀民間抒情短詩，十三、十四世紀流行于意大利，意大利彼特拉克（Petrarch）為代表人物，每行十一個音節，全詩一節八行，加一節六行，韻腳用abba, abba, cdcdcd(cdecde)。前八行提問，后六行回答。

后來，懷亞特（Thomas Wyatt,1503-1542）將十四行詩引人英國，五音步抑揚格，全詩三個四行一個二行,前三節提問，后二句結論。斯賓塞（Edmund Spenser,1552-1599）用韻腳 abab, bcbc,cdcd,ee。莎士比亞（William Shakespeare,1564-1616）用韻腳abab,cdcd,efef,gg，稱英國式或莎士比亞式。

2.打油詩（Limericks）

通常是小笑話甚至是胡謅，一般沒有標題也無作者姓名，含有幽默諷刺性，常運用雙關，內韻等手法。每首詩五個詩行，押韻為aabba，格律以抑揚格和抑抑揚格為主。

3.自由詩（Free Verse）

自由詩（Free Verse）:現代詩中常見的體式，長短不同的詩行存在于同一首詩中，不講究押韻與格律，只注重詩歌所表達的意象和傳遞的情感。美國詩人Walt Whitman的<<草葉集>>（Leaves of Grass）中，就采用此格式。

企業管理類別

企業管理類別又叫企業海關管理類別，是我國海關總署為了鼓勵企業守法自律，提高海關管理效能，保障進出口貿易的安全與便利，對在海關注冊登記的進出口貨物收發貨人、報關企業按照企業遵守法律、行政法規、海關規章、相關廉政規定和經營管理狀況，以及海關監管、統計記錄等，設置出的AA、A、B、C、D五個管理類別，對有關企業進行評估、分類，并對企業的管理類別予以公開。

一、什么是企業管理類別

企業管理類別：又叫企業海關管理類別[1]，是我國海關總署為了鼓勵企業守法自律，提高海關管理效能，保障進出口貿易的安全與便利，對在海關注冊登記的進出口貨物收發貨人、報關企業按照企業遵守法律、行政法規、海關規章、相關廉政規定和經營管理狀況，以及海關監管、統計記錄等，設置出的AA、A、B、C、D五個管理類別，對有關企業進行評估、分類，并對企業的管理類別予以公開。

全國海關實行統一的企業分類標準、程序和管理措施并針對適用不同管理類別的企業，按照守法便利原則，制訂相應的差別管理措施予以分類管理。

二、關于企業管理類別的設定

第一節 進出口貨物收發貨人

第六條 AA類進出口貨物收發貨人，應當同時符合下列條件：

（一）已適用A類管理1年以上；

（二）上一進出口總值3000萬美元（中西部1000萬美元）以上；

（三）經海關驗證稽查，符合海關管理、企業經營管理和貿易安全的要求；

（四）每年報送《經營管理狀況報告》和會計師事務所出具的上一審計報告；每半年報送《進出口業務情況表》。

第七條 A類進出口貨物收發貨人，應當同時符合下列條件：

（一）已適用B類管理1年以上；

（二）連續1年無走私罪、走私行為、違反海關監管規定的行為；

（三）連續1年未因進出口侵犯知識產權貨物而被海關行政處罰；

（四）連續1年無拖欠應納稅款、應繳罰沒款項情事；

（五）上一進出口總值50萬美元以上；

（六）上一進出口報關差錯率3%以下；

（七）會計制度完善，業務記錄真實、完整；

（八）主動配合海關管理，及時辦理各項海關手續，向海關提供的單據、證件真實、齊全、有效；

（九）每年報送《經營管理狀況報告》；

（十）按照規定辦理《中華人民共和國海關進出口貨物收發貨人報關注冊登記證書》的換證手續和相關變更手續；

（十一）在商務、人民銀行、工商、稅務、質檢、外匯、監察等行政管理部門和機構無不良記錄。

第八條 進出口貨物收發貨人有下列情形之一的，適用C類管理：

（一）有走私行為的；

（二）1年內有3次以上違反海關監管規定行為，或者1年內因違反海關監管規定被處罰款累計總額人民幣50萬元以上的；

（三）1年內有2次因進出口侵犯知識產權貨物而被海關行政處罰的；

（四）拖欠應納稅款、應繳罰沒款項人民幣50萬元以下的。

第九條 進出口貨物收發貨人有下列情形之一的，適用D類管理：

（一）有走私罪的；

（二）1年內有2次以上走私行為的；

（三）1年內有3次以上因進出口侵犯知識產權貨物而被海關行政處罰的；

（四）拖欠應納稅款、應繳罰沒款項人民幣50萬元以上的。

第十條 進出口貨物收發貨人未發生本辦法第八條和第九條所列情形并符合下列條件之一的，適用B類管理：

（一）首次注冊登記的；

（二）首次注冊登記后，管理類別未發生調整的；

（三）AA類企業不符合原管理類別適用條件，并且不符合A類管理類別適用條件的；

（四）A類企業不符合原管理類別適用條件的。

第十一條 在海關登記的加工企業，按照進出口貨物收發貨人實施分類管理。

第二節 報關企業

第十二條 AA類報關企業，應當同時符合下列條件 ：

（一）已適用A類管理1年以上；

（二）上一代理申報的進出口報關單及進出境備案清單總量在2萬票（中西部5000票）以上；

（三）經海關驗證稽查，符合海關管理、企業經營管理和貿易安全的要求；

（四）每年報送《經營管理狀況報告》和會計師事務所出具的上一審計報告；每半年報送《報關代理業務情況表》。

第十三條 A類報關企業，應當同時符合下列條件：

（一）已適用B類管理1年以上；

（二）企業以及所屬執業報關員連續1年無走私罪、走私行為、違反海關監管規定的行為；

（三）連續1年代理報關的貨物未因侵犯知識產權而被海關沒收；

（四）連續1年無拖欠應納稅款、應繳罰沒款項情事；

（五）上一代理申報的進出口報關單及進出境備案清單等總量在3000票以上；

（六）上一代理申報的進出口報關差錯率在3%以下；

（七）依法建立賬簿和營業記錄，真實、正確、完整地記錄受委托辦理報關業務的所有活動；

（八）每年報送《經營管理狀況報告》；

（九）按照規定辦理注冊登記許可延續及《中華人民共和國海關報關企業報關注冊登記證書》的換證手續和相關變更手續；

（十）在商務、人民銀行、工商、稅務、質檢、外匯、監察等行政管理部門和機構無不良記錄。第十四條 報關企業有下列情形之一的，適用C類管理：

（一）有走私行為的；

（二）1年內有3次以上違反海關監管規定的行為，或者1年內因違反海關監管規定被處罰款累計總額人民幣50萬元以上的；

（三）1年內代理報關的貨物因侵犯知識產權而被海關沒收達3次的；

（四）上一代理申報的進出口報關差錯率在10%以上的；

（五）拖欠應納稅款、應繳罰沒款項人民幣50萬元以下的；

（六）代理報關的貨物涉嫌走私、違反海關監管規定拒不接受或者拒不協助海關進行調查的；

（七）被海關暫停從事報關業務的。

第十五條 報關企業有下列情形之一的，適用D類管理：

（一）有走私罪的；

（二）1年內有2次以上走私行為的；

（三）1年內代理報關的貨物因侵犯知識產權而被海關沒收達4次以上的；

（四）拖欠應納稅款、應繳罰沒款項人民幣50萬元以上的。

第十六條 報關企業未發生本辦法第十四條和第十五條所列情形，并符合下列條件之一的，適用B類管理：

（一）首次注冊登記的；

（二）首次注冊登記后，管理類別未發生調整的；

（三）AA類企業不符合原管理類別適用條件，并且不符合A類管理類別適用條件的;

（四）A類企業不符合原管理類別適用條件的。

第三節 管理類別的適用與調整

第十七條 企業符合本辦法第六條第（一）項、第（二）項或者第十二條第（一）項、第（二）項的規定，可以通過注冊地海關向直屬海關提出適用AA類管理申請，并提交下列材料：

（一）《適用AA類管理申請書》；

（二）《經營管理狀況報告》；

（三）會計師事務所出具的上一審計報告。

第十八條 企業符合本辦法第七條或者第十三條的規定，可以通過注冊地海關向直屬海關提出適用A類管理申請，并提交下列材料：

（一）《適用A類管理申請書》；

（二）《經營管理狀況報告》。

第十九條 注冊地海關接受企業適用AA類、A類管理申請后，經審核企業提交的材料齊全，符合法定形式的，應當當場制發《企業分類管理申請受理決定書》，并報直屬海關審定。

對申請AA類的，直屬海關應當自受理之日起6個月內作出適用或者不予適用決定。

對申請A類的，直屬海關應當自受理之日起3個月內作出適用或者不予適用決定。

第二十條 申請適用AA類、A類管理的企業有下列情形之一的，直屬海關對其申請予以退回，并作出不予適用的決定：

（一）申請時不符合本辦法所規定的條件的；

（二）審核期間不符合本辦法所規定的條件的；

（三）審核期間有涉嫌走私或者違反海關監管規定以及侵犯知識產權的行為尚在偵查或者調查中的。第二十一條 C類企業自海關作出類別調整決定之日起滿1年未再發生本辦法第八條或者第十四條所列情形的，經企業申請，海關將其調整為B類。

D類企業自海關作出類別調整決定之日起滿1年未再發生本辦法第九條或者第十五條所列情形的，經企業申請，海關將其調整為C類。

第二十二條 C類、D類企業申請調整為B類、C類的，應當通過注冊地海關向直屬海關提交《企業管理類別調整申請書》。注冊地海關經審核，企業提交的材料齊全，符合法定形式的，應當當場制發《企業分類管理申請受理決定書》，并報直屬海關審定。

直屬海關應當自受理之日起1個月內作出決定。

第二十三條 企業有下列應當降低類別情形之一的，海關發現后根據本辦法第二章的規定，重新決定其適用的管理類別:

（一）AA類、A類企業不符合原管理類別適用條件的；

（二）B類企業有 C類、D類管理類別情形之一的；

（三）C類企業有D類管理類別情形之一的。

第二十四條 經直屬海關決定調整或者不予調整企業管理類別的，由企業注冊地海關在決定作出之日起10個工作日內將相關決定送達企業。

自海關作出調整決定之日起，海關按照調整后的管理類別對企業實施相應的管理措施。

第二十五條 AA類或者A類企業涉嫌走私被立案偵查或者調查的，海關暫停其與管理類別相應的管理措施；暫停期內，按照B類企業的管理措施實施管理。

第二十六條 企業僅名稱或者海關注冊編碼發生變化的，其管理類別可以繼續適用，但是有下列情形之一的，按照下列方式調整：

（一）企業發生存續分立，分立后的存續企業承繼分立前企業的主要權利義務或者債權債務關系的，其管理類別適用分立前企業的管理類別，其余的分立企業視為首次注冊企業；

（二）企業發生解散分立，分立企業視為首次注冊企業；

（三）企業發生吸收合并，合并企業管理類別適用合并后存續企業的管理類別；

（四）企業發生新設合并，合并企業視為首次注冊企業。

三、海關如何按企業管理類別實施分類管理？

為鼓勵企業守法自律，《中華人民共和國海關企業分類管理辦法》[2]規定“海關總署按照守法便利原則，對適用不同管理類別的企業，制訂相應的差別管理措施，其中AA類和A類企業適用相應的通關便利措施，B類企業適用常規管理措施，C類和D類企業適用嚴密監管措施。”

對A類企業，海關將實施“屬地報關、口岸驗放”，優先派員到企業結合生產或裝卸環節實施查驗，業務現場優先辦理貨物申報、查驗、放行手續，在進口貨物起運后抵港前或出口貨物運入海關監管場所前提前辦理報關手續，優先安排在非工作時間和節假日辦理加急通關手續，按規定實行銀行保證金臺帳“空轉”或不實行銀行保證金臺帳制度，優先辦理加工貿易備案、變更、報核等手續，優先辦理報關注冊登記手續，優先組織對報關員的報關業務培訓和崗位考核等一系列通關便利措施。

對AA類企業，除享受A類通關便利措施外，海關還將實行信任放行，指派專人負責協調解決企業辦理海關事務的疑難問題，報關單電子數據經電子審核后直接進入現場驗放環節辦理復核、驗放手續，對進出口貨物一般不予開箱查驗等通關便利措施。

對B類企業適用常規管理措施，而對C、D類企業，海關則要在審單、查驗、核查等通關、加工貿易業務開展和后續管理環節實行嚴密的監管措施。

四、企業管理類別是如何調整的？

企業類別的調整分為上調和下調管理類別。

對于企業類別上調的，必須由企業向注冊地海關提出申請，按規定提交申請書及相關材料。注冊地海關經審核后，認為企業所提交的材料齊全并符合法定形式的，當場制發《企業分類管理申請受理決定書》，然后報直屬海關審定。對于不符合形式審核要求的申請，注冊地海關予以退回，并一次性告知企業需要補正的內容和材料。

對申請AA類的，海關應當自受理之日起6個月內作出適用或著不予適用的決定；對申請A類的，海關應當自受理之日起3個月內作出適用或者不予的決定。對于申請C、D類調整為B、C類的，海關應當自受理之日起1個月內作出調整或不予調整的決定。

海關發現企業有應當降低管理類別情形的，將按照規定下調其所適用的管理類別并制發《企業類別調整決定書》。

經海關決定調整企業管理類別的，自作出決定之日起，海關按照調整后的管理類別對企業實施相應的管理措施，企業注冊地海關在決定作出之日起10日內將決定書送達企業。

五、企業海關管理類別如何查詢?

企業管理類別分為AA、A、B、C類，企業可以到當地海關查詢企業的管理類別，也可以自行到電子口岸政務咨詢平臺上查詢。
