刑事訴訟中的拘留是公安機(jī)關(guān)、人民檢察院對直接受理的案件，在偵查過程中，遇到法定的緊急情況時(shí)，對于現(xiàn)行犯或者重大嫌疑分子所采取的臨時(shí)剝奪其人身自由的強(qiáng)制方法。

為規(guī)范刑事執(zhí)法，防止超期羈押的發(fā)生，現(xiàn)就刑事拘留期間計(jì)算中的幾個(gè)問題作一歸納。

一、延長刑事拘留的期限計(jì)算問題在延長刑事拘留的期限計(jì)算中常常出現(xiàn)的錯(cuò)誤是期限計(jì)算不準(zhǔn)確。辦案單位往往將刑事拘留的當(dāng)日計(jì)算在內(nèi)，導(dǎo)致對整個(gè)刑事拘留期間少計(jì)算1日的現(xiàn)象發(fā)生。

正確的計(jì)算方法是：刑事拘留是以日為計(jì)算單位而且期間開始之日不算在期間以內(nèi)，即從期間開始的次日計(jì)算。期間的 屆滿以法定期間日數(shù)的最后一日為止。例如，犯罪嫌疑人某某于4月1日被刑事拘留，從第2日開始計(jì)算，期限屆滿日期為4月4日;如果延長刑事拘留4日的，期 限屆滿日期為4月8日;如果延長刑事拘留至30日的(即從4月4日延長27日)，由于4月份只有30天，期限屆滿日期為5月1日。

二、路途時(shí)間是否從拘留期間扣除問題路途時(shí)間是否要計(jì)算在拘留期間內(nèi)存在一種錯(cuò)誤認(rèn)識，認(rèn)為押解途中的時(shí)間不應(yīng)算刑事拘留時(shí)間，其理由是《刑事訴訟法》第79條規(guī)定期間的時(shí)間不包括路途上的時(shí)間。

《刑事訴訟法》第79條第3款中的“法定期間不包括路途上的時(shí)間”是指，1、公安司法機(jī)關(guān)向當(dāng)事人郵寄送達(dá)訴訟 文書、當(dāng)事人向公安司法機(jī)關(guān)郵寄送達(dá)訴訟文書以及公安司法機(jī)關(guān)之間傳遞訴訟文書在法律咨詢s.yingle.com

路途上所占用的時(shí)間;

2、公安司法機(jī)關(guān)從異地拘留、逮捕犯罪嫌疑人歸案，訊問、通知等期間應(yīng)當(dāng)將路途中的時(shí)間扣除。另外，從立法的精神出發(fā)，拘留、逮捕本質(zhì)上是限制人身自由的行為，押解的過程也是限制人身自由的過程。因此，在 計(jì)算拘留、逮捕期間時(shí)，應(yīng)當(dāng)將押解路途時(shí)間包括在內(nèi)。

三、拘留期間屆滿之日是法定節(jié)假日是否應(yīng)當(dāng)順延問題根據(jù)六機(jī)關(guān)《關(guān)于刑事訴訟法實(shí)施中若干問題的規(guī)定》第29條的規(guī)定以及《最高人民法院關(guān)于執(zhí)行〈中華人民共和國刑事訴訟法〉若干問題的解釋》第103條的規(guī)定，對于被拘留的犯罪嫌疑人的期間，應(yīng)當(dāng)在拘留期間屆滿之日為止，不得因節(jié)假日而延長拘留期限。

三、在拘留期間，發(fā)現(xiàn)犯罪嫌疑人另有重要罪行的，是否重新計(jì)算偵查羈押期限問題根據(jù)《刑事訴訟法》第128條的規(guī)定，在偵查期間，發(fā)現(xiàn)犯罪嫌疑人另有重要罪行的，自發(fā)現(xiàn)之日起依照本法第 124條的規(guī)定重新計(jì)算偵查羈押期限。對于該條的適用，要把握一點(diǎn)：偵查的期限以“對犯罪嫌疑人逮捕后”開始計(jì)算，而不是“對犯罪嫌疑人拘留后”開始計(jì) 算。羈押期限的計(jì)算方法如下：公安機(jī)關(guān)偵查的案件，從收到人民檢察院批準(zhǔn)逮捕決定之日起到偵查終結(jié)移送人民檢察院審查起訴之日止。因此，犯罪嫌疑人被逮捕 后發(fā)現(xiàn)另有重要罪行的，自發(fā)現(xiàn)之日起，重新計(jì)算偵查羈押期限。但在拘留期間，發(fā)現(xiàn)犯罪嫌疑人另有重要罪行的，不能重新計(jì)算偵查羈押期限。

五、關(guān)于刑事拘留時(shí)間與治安拘留時(shí)間的折抵問題對于刑事拘留時(shí)間與治安拘留時(shí)間是否可以相互折抵問題，應(yīng)當(dāng)根據(jù)不同情形分別處理。

對于治安案件轉(zhuǎn)為刑事案件的情況，根據(jù)《公安部法制局關(guān)于行政案件轉(zhuǎn)為刑事案件辦理后原行政案件如何處理的電話 答復(fù)》的規(guī)定，公安機(jī)關(guān)在辦理行政案件過程中，發(fā)現(xiàn)同一違法行為涉嫌犯罪的，如果行政案件已經(jīng)作出處罰決定，應(yīng)當(dāng)先行撤銷行政處罰，再轉(zhuǎn)為刑事案件辦理。對符合《刑事訴訟法》第61條規(guī)定的刑事拘留條件的，可以對犯罪嫌疑人采取刑事拘留措施。治安拘留和刑事拘留性質(zhì)不同，治安拘留是對違反治安管理處罰條例的人采取的一種行政處罰措施，而刑事拘留是根據(jù)刑事 訴訟法的規(guī)定，為保證刑事訴訟活動的順利進(jìn)行，防止犯罪嫌疑人繼續(xù)危害社會，對犯罪嫌疑人采取的一種刑事強(qiáng)制措施。治安拘留時(shí)間不能折抵刑事拘留時(shí)間。

對于刑事案件轉(zhuǎn)為治安案件的情況，根據(jù)《公安部關(guān)于對刑事拘留時(shí)間可否折抵治安拘留時(shí)間有關(guān)問題的批復(fù)》的規(guī) 定，如果行為人依法被刑事拘留的行為與被治安拘留的行為系同一行為，其被刑事拘留的時(shí)間應(yīng)當(dāng)折抵治安拘留時(shí)間。但如果被刑事拘留的時(shí)間已超過治安拘留期限的，不再給予治安拘留處罰。

為規(guī)范刑事執(zhí)法，防止超期羈押的發(fā)生，現(xiàn)就刑事拘留期間計(jì)算中的幾個(gè)問題作一歸納。

一、延長刑事拘留的期限計(jì)算問題在延長刑事拘留的期限計(jì)算中常常出現(xiàn)的錯(cuò)誤是期限計(jì)算不準(zhǔn)確。辦案單位往往將刑事拘留的當(dāng)日計(jì)算在內(nèi)，導(dǎo)致對整個(gè)刑事拘留期間少計(jì)算1日的現(xiàn)象發(fā)生。

正確的計(jì)算方法是：刑事拘留是以日為計(jì)算單位而且期間開始之日不算在期間以內(nèi)，即從期間開始的次日計(jì)算。期間的 屆滿以法定期間日數(shù)的最后一日為止。例如，犯罪嫌疑人某某于4月1日被刑事拘留，從第2日開始計(jì)算，期限屆滿日期為4月4日;如果延長刑事拘留4日的，期 限屆滿日期為4月8日;如果延長刑事拘留至30日的(即從4月4日延長27日)，由于4月份只有30天，期限屆滿日期為5月1日。

二、路途時(shí)間是否從拘留期間扣除問題路途時(shí)間是否要計(jì)算在拘留期間內(nèi)存在一種錯(cuò)誤認(rèn)識，認(rèn)為押解途中的時(shí)間不應(yīng)算刑事拘留時(shí)間，其理由是《刑事訴訟法》第79條規(guī)定期間的時(shí)間不包括路途上的時(shí)間。

《刑事訴訟法》第79條第3款中的“法定期間不包括路途上的時(shí)間”是指，1、公安司法機(jī)關(guān)向當(dāng)事人郵寄送達(dá)訴訟 文書、當(dāng)事人向公安司法機(jī)關(guān)郵寄送達(dá)訴訟文書以及公安司法機(jī)關(guān)之間傳遞訴訟文書在法律咨詢s.yingle.com

2、公安司法機(jī)關(guān)從異地拘留、逮捕犯罪嫌疑人歸案，訊問、通知等期間應(yīng)當(dāng)將路途中的時(shí)間扣除。另外，從立法的精神出發(fā)，拘留、逮捕本質(zhì)上是限制人身自由的行為，押解的過程也是限制人身自由的過程。因此，在 計(jì)算拘留、逮捕期間時(shí)，應(yīng)當(dāng)將押解路途時(shí)間包括在內(nèi)。

三、拘留期間屆滿之日是法定節(jié)假日是否應(yīng)當(dāng)順延問題根據(jù)六機(jī)關(guān)《關(guān)于刑事訴訟法實(shí)施中若干問題的規(guī)定》第29條的規(guī)定以及《最高人民法院關(guān)于執(zhí)行〈中華人民共和國刑事訴訟法〉若干問題的解釋》第103條的規(guī)定，對于被拘留的犯罪嫌疑人的期間，應(yīng)當(dāng)在拘留期間屆滿之日為止，不得因節(jié)假日而延長拘留期限。

三、在拘留期間，發(fā)現(xiàn)犯罪嫌疑人另有重要罪行的，是否重新計(jì)算偵查羈押期限問題根據(jù)《刑事訴訟法》第128條的規(guī)定，在偵查期間，發(fā)現(xiàn)犯罪嫌疑人另有重要罪行的，自發(fā)現(xiàn)之日起依照本法第 124條的規(guī)定重新計(jì)算偵查羈押期限。對于該條的適用，要把握一點(diǎn)：偵查的期限以“對犯罪嫌疑人逮捕后”開始計(jì)算，而不是“對犯罪嫌疑人拘留后”開始計(jì) 算。羈押期限的計(jì)算方法如下：公安機(jī)關(guān)偵查的案件，從收到人民檢察院批準(zhǔn)逮捕決定之日起到偵查終結(jié)移送人民檢察院審查起訴之日止。因此，犯罪嫌疑人被逮捕 后發(fā)現(xiàn)另有重要罪行的，自發(fā)現(xiàn)之日起，重新計(jì)算偵查羈押期限。但在拘留期間，發(fā)現(xiàn)犯罪嫌疑人另有重要罪行的，不能重新計(jì)算偵查羈押期限。

五、關(guān)于刑事拘留時(shí)間與治安拘留時(shí)間的折抵問題對于刑事拘留時(shí)間與治安拘留時(shí)間是否可以相互折抵問題，應(yīng)當(dāng)根據(jù)不同情形分別處理。

對于治安案件轉(zhuǎn)為刑事案件的情況，根據(jù)《公安部法制局關(guān)于行政案件轉(zhuǎn)為刑事案件辦理后原行政案件如何處理的電話 答復(fù)》的規(guī)定，公安機(jī)關(guān)在辦理行政案件過程中，發(fā)現(xiàn)同一違法行為涉嫌犯罪的，如果行政案件已經(jīng)作出處罰決定，應(yīng)當(dāng)先行撤銷行政處罰，再轉(zhuǎn)為刑事案件辦理。對符合《刑事訴訟法》第61條規(guī)定的刑事拘留條件的，可以對犯罪嫌疑人采取刑事拘留措施。治安拘留和刑事拘留性質(zhì)不同，治安拘留是對違反治安管理處罰條例的人采取的一種行政處罰措施，而刑事拘留是根據(jù)刑事 訴訟法的規(guī)定，為保證刑事訴訟活動的順利進(jìn)行，防止犯罪嫌疑人繼續(xù)危害社會，對犯罪嫌疑人采取的一種刑事強(qiáng)制措施。治安拘留時(shí)間不能折抵刑事拘留時(shí)間。

對于刑事案件轉(zhuǎn)為治安案件的情況，根據(jù)《公安部關(guān)于對刑事拘留時(shí)間可否折抵治安拘留時(shí)間有關(guān)問題的批復(fù)》的規(guī) 定，如果行為人依法被刑事拘留的行為與被治安拘留的行為系同一行為，其被刑事拘留的時(shí)間應(yīng)當(dāng)折抵治安拘留時(shí)間。但如果被刑事拘留的時(shí)間已超過治安拘留期限的，不再給予治安拘留處罰。

一、賠付對象

快件賠付的對象應(yīng)為寄件人或寄件人指定的受益人。

二、賠償條件

在寄遞過程中，發(fā)生延誤、丟失、損毀、內(nèi)件不符時(shí)，快遞服務(wù)組織應(yīng)予以賠償。

屬于下列情況的，快遞服務(wù)組織可不負(fù)賠償責(zé)任： a)所寄物品本身的自然性質(zhì)或者合理損耗造成快件損失的；

b)由于不可抗力的原因造成損失的（保價(jià)快件除外）； c)寄件人、收件人的過錯(cuò)造成損失的。

三、賠償原則

1、快遞服務(wù)組織與用戶之間有約定的應(yīng)從約定，沒有約定的可按以下原則執(zhí)行。

2、快件延誤。延誤的賠償應(yīng)為免除本次服務(wù)費(fèi)用（不含保價(jià)等附加費(fèi)用）。

由于延誤導(dǎo)致內(nèi)件直接價(jià)值喪失，應(yīng)按照快件丟失或損毀進(jìn)行賠償。

3、快件丟失。快件發(fā)生丟失時(shí)，應(yīng)免除本次服務(wù)費(fèi)用（不含保價(jià)等附加費(fèi)用），此外，還應(yīng)：

a)對于購買保價(jià)的快件，快遞服務(wù)組織應(yīng)按照被保價(jià)金額進(jìn)行賠償；

b)對于沒有購買保價(jià)的快件，按照《中華人民共和國郵政法》、《中華人民共和國合同法》等相關(guān)法律規(guī)定賠償； c)造成用戶其他損失的，按照相關(guān)民事法律法規(guī)賠償。

4、快件損毀

快件損毀賠償應(yīng)主要包括：

a)完全損毀，指快件價(jià)值完全喪失，參照快件丟失賠償?shù)囊?guī)定執(zhí)行；

b)部分損毀，指快件價(jià)值部分喪失，依據(jù)快件喪失價(jià)值占總價(jià)值的比例，按照快件丟失賠償額度的相同比例進(jìn)行賠償。

5、內(nèi)件不符

內(nèi)件不符賠償應(yīng)主要包括：

a)內(nèi)件品名與寄件人填寫品名不符，按照完全損毀賠償； b)內(nèi)件品名相同，數(shù)量和重量不符，按照部分損毀賠償。

四、索賠程序

1、索賠申告

寄件人在快件發(fā)生延誤、丟失、損毀、內(nèi)件不符時(shí)，可以依據(jù)賠償規(guī)定向快遞服務(wù)組織提出索賠申告。快遞服務(wù)組織應(yīng)提供索賠申告單給寄件人，寄件人填寫后遞交給快遞服務(wù)組織。

2、索賠受理

快遞服務(wù)組織應(yīng)在收到寄件人的索賠申告單24h內(nèi)答復(fù)寄件人，并告知寄件人索賠處理時(shí)限。

3、索賠處理時(shí)限

快遞服務(wù)組織除了與寄件人有特殊約定外，索賠處理時(shí)限應(yīng)不超過：

a)同城和國內(nèi)異地快件為30個(gè)日歷天； b)港澳臺快件為30個(gè)日歷天； c)國際快件為60個(gè)日歷天。4賠金支付

快遞服務(wù)組織與寄件人就賠償事宜達(dá)成一致后，應(yīng)在7個(gè)工作日內(nèi)向寄件人或寄件人指定的受益人支付賠金，與用戶有約定的除外。

五、索賠爭議的解決 寄件人與快遞服務(wù)組織就是否賠償、賠償金額或賠金支付等問題可先行協(xié)商，協(xié)商不一致的，可依相關(guān)規(guī)定選擇投訴、申訴、仲裁、訴訟等方式，如選擇仲裁，應(yīng)在收寄時(shí)約定仲裁地點(diǎn)和仲裁機(jī)構(gòu)。
