2010年整個試卷的分值是600分，估計及格線按照慣例也是360分。由于2010年司考大綱的結構小幅調(diào)整，具體科目的分值則有一些變化：2010年各個學科的具體分布如下：卷一整體上保持穩(wěn)定，個別學科有小幅的調(diào)整，最大的突出特點還是在開篇五題考察了“社會主義法治理念”，共考察5分。法理學依然強勢，仍然是23分，憲法學和2009年持平，考察了23分，與法理學相當。法制史10分不變，司法制度和法律職業(yè)道德總體分值與往年持平，考察了10分。經(jīng)濟法由于《證券法》從卷一移到了卷三，故減少了五分，自2004年以來的40分降為35分。三國法部分，國際公法、國際私法和國際經(jīng)濟法在分值上保持不變，分別是12分、15分和17分，總共44分。卷三的科目每年都會有大的調(diào)整，2010年的突出特點是商法的回升，一共考查了56分，商法開始回暖。民法依然保持穩(wěn)定，考察了90分。相比之下，民事訴訟法、仲裁法在2010年司法考試中的分值有所回落，考查了66分，相比去年分值有大幅度下降，已經(jīng)接近歷年司法考試中的低谷。卷四的分值分布依然和2010年保持一致，傳說中司法文書依然沒有出現(xiàn)，同時，加大了商法案例題繼的考察。在論述題上，按慣例，卷四第一題綜合考查政治時事題，考點依然是“社會主義法治理念”，20分。第二題依然是刑法案例，22分。第三題是刑訴法案例題，21分。第四題是民法案例，22分。第五題是民訴案例，20分。第六題考查商法案例，分數(shù)多達22分。最后一題是論述題，按照2008年是刑法、2009年是民法，到2010年回歸到行政法的套路，分值25分。卷二中三個學科的分值多年保持不變，三科分值分別是：刑法58分、刑訴52分、行政法40分。2010年延續(xù)三個學科的“刑法——刑訴——行政法”排列方式。綜上，理論法學的分值彈性很大，如果加上卷四的兩道論述題的話，分值高達106分，完全是一個重量級學科。司法制度部分由于社會主義法治理念的加入，分值保持不變。刑法部分今年有所下調(diào)，但是依然是接近民法的超級大國地位。刑訴73分保持了傳統(tǒng)地位，但是民訴有所下滑。民法部分的總分值高達90分，依然是超級大國。行政法部分，今年加上最后一天的論述題，雖然案例題不予考察，總分數(shù)保持了2009年的勢頭。商經(jīng)法繼續(xù)回升，到了91分，預計2011年會繼續(xù)保持穩(wěn)定。2010年試題從總體上看，應該說是“重者恒重”的。傳統(tǒng)的重點突出學科，如民法、民訴、刑法、刑訴，其命題重點都非常突出，考查生僻知識點的題目很少出現(xiàn)。如理論法學部分，包括法理學、法制史、憲法學、司法制度和法律職業(yè)道德，整體上看內(nèi)容瑣碎，但就每一個學科而言，重點還是比較突出的，法|律教育網(wǎng)整理法理學和憲法學尤其如此。今年變化最大是商經(jīng)部分。商法試題都是考查重要考點，沒有偏題。經(jīng)濟法試題，就具體考點來看應該說也不算偏門，同時，2009年各個小法之間的分值分布合乎邏輯，對重點問題進行了集中的考查。但是，商法案例的橫空出世，也為2011年分值分布帶來了一絲訊息。新增考點和社會熱點理所當然地屬于司法考試的考查熱點，今年表現(xiàn)地更為突出。“新增必考”，涉及新增法律法規(guī)和大綱中新增的理論考點，在2010年試題中得到了全面證明。從理論法學中唯一增加的“法律規(guī)則與語言”到法制史中唯一的“謀殺和故殺”，到讓人大跌眼鏡，號稱本年司法考試最簡單一題的司法制度中檢察官的要求中把“嚴明”改為“文明”，這些理論考點的考查力度都很大。至于新增法規(guī)，如經(jīng)濟法的《城鄉(xiāng)規(guī)劃法》、《辦理利用互聯(lián)網(wǎng)、移動通訊終端、聲訊臺制作、復制、出版、販賣、傳播淫穢電子信息刑事案件具體應用法律若干問題的解釋
