第三篇：微信侵權投訴流程

1.流程

1.1 通知騰訊

若權利人認為第三方在微信公眾平臺提供的服務侵犯其合法權益，請按以下要求提交相關材料進行投訴，通知騰訊：

權利人應向騰訊提出書面通知書（書面通知書的內容請參考附錄：《微信公眾平臺侵權投訴通知書模板》)，通知書的內容應包括但不限于以下內容：（1）權利人主體信息和相關材料

權利人的姓名（名稱）、聯系方式、地址及營業執照（單位）、身份證（個人）、相關授權證明等證明權利人主體資格的材料； 權利人如委托他人代理投訴的，還需提供授權委托書，以及代理人姓名（名稱）、聯系方式、地址及營業執照（單位）、身份證（個人）、相關代理人職務身份證明（公司授權書、介紹信等證明代理人職務身份及公司授權代理人代表公司辦理相關投訴事務）等證明代理人主體資格的材料。（2）權利人要求

權利人投訴侵權的微信公眾帳號信息，以及相關投訴事項說明。（3）構成侵權的初步證明材料 該初步證明材料應包括：

I.權利人擁有權利的權屬證明材料：包括但不限于相關有權機構頒發的版權證書、商標權證書、專利權證書、作品首次公開發表或發行日期證明材料、創作手稿、經權威機構簽發的作品創作時間戳、作品備案證書等能證明權利人擁有相關權利的有效權屬證明；

II.被投訴方提供的服務構成侵權的證明材料：包括但不限于被投訴方提供的服務構成對權利人版權、商標權或專利權等權利侵權的有效證明材料等。（4）權利人保證

權利人應在通知書中明確保證：權利人在通知書中的陳述和提供的相關材料皆是真實、有效和合法的，并保證承擔和賠償騰訊因根據權利人的通知書對相關帳號的處理而給騰訊公司造成的任何損失，包括但不限于騰訊因向被投訴方或用戶賠償而產生的等損失及騰訊名譽、商譽損害等。

通知書及相關證明材料準備時需注意的事項以及投寄地址詳見下文注意事項中的說明。1.2 騰訊反饋

騰訊作為中立的平臺服務者，收到權利人符合本指引要求的通知書后，騰訊會盡快按照相關法律法規的規定進行處理，并會將權利人的通知書轉送給被投訴方。若被投訴方不認可權利人的投訴，騰訊會將被投訴方提供的相關材料轉送給權利人，若權利人對于被投訴方的意見及其提供的相關材料有異議的，騰訊建議權利人另行通過行政投訴、訴訟等方式直接和被投訴方解決相關問題。如果權利人有新的并可充分推翻被投訴方意見的證明材料的，也可向騰訊提供。2.注意事項

（1）本指引中的權利人，指擁有版權、商標權、專利權等合法權益的原始所有人，代理人是指經原始所有人合法授權的受托人，包括自然人、法人或其他組織等。

（2）本指引中的第三方，指在微信公眾平臺提供各類服務的微信公眾帳號運營方。

（3）為了確保權利人提供相關材料的真實性和有效性，權利人的書面通知書及相關證明材料，一般應提供原件，不能提供原件的，應提供復印件（在復印件上應有權利人的簽章），若材料涉外的，應按照法律的規定進行公證轉遞，并同時提供相應的公證轉遞材料。有兩種通知騰訊的方式：

I.將前述全部的紙質版本材料掃描后通過電子郵件發送至騰訊指定電子郵箱： notice-mp@qq.com

II.通過郵寄的方式將前述書面通知書及其他相關證明材料的紙質版本郵寄至騰訊指定的以下地點：

地址：中國廣東省深圳市南山區科技園科技中一路騰訊大廈 法務部 郵編：518057（4）本指引中權利人的書面通知書，均應包括通知書本身及相關的主體資格材料、權屬證明、侵權證明等材料。

（5）若權利人已經因為被投訴人提供的服務向相關政府部門或法院提起行政投訴或訴訟的，請在提交通知書時，將相關受理證明及提交政府部門或法院的證據材料一同提交給騰訊，這將有利于權利人的投訴的處理。

（6）按照相關法規、本指引的規定，若被投訴的服務應當在微信公眾平臺作終止運營處理的，騰訊終止相關服務的流程需要遵守相關法規規定的時限要求，比如，根據目前相關法規的規定，對于網絡游戲的終止運營，需要提前60日予以公告后方可終止運營。
