一、當事人應(yīng)當對自己提出的訴訟請求所依據(jù)的事實或者反駁對方訴訟請求所依據(jù)的事實承擔舉證責(zé)任。當事人沒有證據(jù)或者提出的證據(jù)不足以證明其事實主張的，由負有舉證責(zé)任的當事人承擔不利后果。1 you are responsible for producing evidences to prove the facts on which your claims are based or the facts on which the claims of the other party are rebutted.you shall undertake the adverse consequence, if you failed to submit evidence materials or submitted evidences is failure to the fact which you provide to the court.二、向人民法院提供證據(jù)，應(yīng)當提供原件或者原物，或經(jīng)人民法院核對無異的復(fù)制件或復(fù)制品。并應(yīng)對提交的證據(jù)材料逐一分類編號，對證據(jù)材料的來源、證明對象和內(nèi)容作簡要說明，依照對方當事人人數(shù)提出副本。ii evidences submitted by the parties to the people’s court shall be the originals, or copies or replicas checked and found in conformity with the originals by the people’s court.the submitted evidence materials shall be classified and numbered one by one.it is required to briefly describe the sources, facts to be proved and contents of the evidence materials.copies shall be provided according to the number of the parties of the opposing side.三、申請鑒定，增加、變更訴訟請求或者提出反訴，應(yīng)當在舉證期限屆滿前提出。iii where you intend to apply for authentication, increase or variation of the claims or file a counterclaim, you shall do the same prior to the expiration of the evidence producing term.四、你方申請證人作證，應(yīng)當在舉證期限屆滿的十日前向本院提出申請。如本案適用簡易程序?qū)徖恚暾堊C人作證的時間可以不受十日的限制。iv where you apply for appearance of a witness to testify，you shall file an application with this court ten(10)days before expiration of the evidence producing term.provided that the summary procedure is followed in this case, the time for applying witness to testify is not limited by 10 days.五、申請證據(jù)保全，應(yīng)當在舉證期限屆滿的七日前提出，本院可根據(jù)情況要求你方提供相應(yīng)的擔保。如本案適用簡易程序?qū)徖恚暾堊C據(jù)保全的時間可以不受七日的限制。v where you intend to apply for preservation of evidence, you shall file an application with this court seven(7)days before expiration of the evidence producing term.this court may require you to provide corresponding preservation as the circumstances may require.provided that the summary procedure is followed in this case, the time for preservation of evidence is not limited by 10 days.六、你方收到本通知后，可以與對方當事人協(xié)商確定舉證期限后，向本院申請認可。你方與對方當事人未能協(xié)商一致，或者未申請本院認可，或本院不予認可的，你方應(yīng)當于年月日前向本院提交證據(jù)。若舉證期限不足15日，則自收到通知之日起第15日為舉證期限屆滿之曰。逾期不提交證據(jù)的，視為放棄舉證權(quán)利。逾期提交的證據(jù)材料，本院審理時不組織質(zhì)證，裁判時不予采納。vi upon receipt of the notice, you may negotiate with the other party to determine the time limit for producing evidence and apply for approval of this court.provided that you and your other party fail to reach an agreement, or the agreement is unapproved or refused by this court, you shall submit the evidence materials to this court before th day after receiving the notice shall be as the expiration day of the evidence producing term.your failure to submit evidence materials within the evidence producing term shall be deemed as waiver of the right to produce evidences.for the evidence materials not submitted on time, the people’s court won’t arrange cross examination during trial, and the judge won’t accept it.七、你方在舉證期限內(nèi)提交證據(jù)材料確有困難的，可以依照最高人民法院《關(guān)于民事訴訟證據(jù)的若干規(guī)定》第三十六條的規(guī)定，向本院申請延期舉證。vii where it is really difficult for you to submit evidence materials within the evidence producing term, you may apply with this court for extension according to provisions in article 36 of several provisions of the supreme people’s court on evidences for civil actions of the supreme peoples court.八、你方在舉證期限屆滿后提交的證據(jù)不符合最高人民法院《關(guān)于民事訴訟證據(jù)的若干規(guī)定》第四十一條、第四十三條第二款、第四十四條規(guī)定的“新的證據(jù)”的規(guī)定的，視為你方放棄舉證權(quán)利。但對方當事人同意質(zhì)證的除外。viii where the evidence materials submitted by you at the expiration of the evidence producing term fail to meet “new evidence” provisions in article 41, paragraph 2 of article 43, and article 44 of several provisions of the supreme people’s court on evidences for civil actions of the supreme peoples court, you shall be deemed as waiver of the right to produce evidences, unless the other party agrees to cross examination.九、符合最高人民法院《關(guān)于民事訴訟證據(jù)的若干規(guī)定》第十七條規(guī)定條件之一的，你方可以在舉證期限屆滿的七日前書面申請
