(一)意見證據規則

一、凡是知道案件情況的單位和個人，都有義務出庭作證。有關單位的負責人應當支持證人作證。但是，不能正確表達意志的人，不能作為證人。

待證事實與其年齡、智力狀況或者精神健康狀況相適應的無民事行為能力人和限制民事行為能力人，可以作為證人。

二、當事人申請證人出庭作證，應當在舉證期限屆滿十日前提出，并經人民法院許可。

人民法院對當事人的申請予以準許的，應當在開庭審理前通知證人出庭作證，并告知其應當如實作證及作偽證的法律后果。

證人因出庭作證而支出的合理費用，由提供證人的一方當事人先行支付，由敗訴一方當事人承擔。
