納稅人申請減免稅(契稅)土地，房屋被縣級以上人民政府征用占用后，重新承受土地、房屋權屬的，其成交價格沒有超出土地，房屋補償費、安置補助費的部分，免征契稅)審批類

條件：

適用于符合文件規定的購房行為。

凡土地、房屋被縣級以上人民政府征用、占用后，重新購房的納稅人，需及時到新購房屋所在地的主管稅務所辦理契稅減、免稅申請審批手續，提交有關證明資料如下：

房屋拆遷貨幣補償(實物安置)協議;

購房合同、付款憑證;

納稅人個人合法性身份證明或法人稅務登記證、法人代表個人合法性身份證明。

購房人與被拆遷人不一致的，需提供戶口本或具有法律效力的直系親屬關系證明。屬夫妻關系提供結婚證。

拆遷補償金額超過100萬元(含)的，納稅人需向稅務機關提供購房人戶口本或原居住地管理機關開具的居住證明原件，稅務機關留存復印件。

標準：

窗口受理人員對納稅人報送減免稅申報資料齊全、符合受理條件的，將申報信息錄入契稅征管系統，打印《契稅納稅申報表》交納稅人確認并簽章，即時將全部資料移交窗口審核人員，轉入審核程序。

對沒有按照規定提供證明資料或提供資料不齊全的，不予受理，按照納稅人性質(單位或個人)出具《契稅涉稅資料提示單》一次性告知納稅人需補充的資料。

窗口審核人員對受理人員轉交的全部資料進行審核。

對符合減免稅政策規定的，出具《契稅核定通知書》(個人購買自用普通住宅暫減半征收的不填)，加蓋“契稅征收專用章”，并在《契稅核定通知書》右下角簽字表示確認，并告知或轉入稅款征收程序。
