對于登記結婚之后給付的彩禮，《解釋

（二）》中并未對此作出明確規定，從彩禮的法律關系分析，屬于一般的贈與，但其贈與目的的現實性仍是希望男女之間建立穩定的婚姻關系。

結婚彩禮是否是夫妻共同財產分為以下兩種情況：

1、彩禮由一方個人接收或購置結婚物品的，應根據我國《婚姻法》規定，夫妻關系存續期間一方受贈的財物無特殊約定，應為夫妻共同財產。

二是在審理中將女方的嫁妝藏起來，或稱女方已經取走了，要求女方舉證證實嫁妝在男方處，有的甚至毀損嫁妝，無形中增加了審理和調解的難度；

三是即使判決嫁妝返還后，進入執行階段后就把嫁妝隱藏到親友處，謊稱嫁妝丟了、被盜或根本就沒有，執行人員采取搜查等措施成效也不大，加大了執行的難度，這樣都不同程度地激化了雙方當事人原有的矛盾，審判和執行人員對嫁妝的返還問題深感頭疼。
