在這個(gè)網(wǎng)絡(luò)發(fā)達(dá)、微信朋友圈橫行的時(shí)代，如果你有做美容產(chǎn)品的微商朋友話，他們會(huì)抓住女性朋友對(duì)V字臉和嬰兒肌的向外心理，時(shí)常會(huì)在朋友圈發(fā)出“玻尿酸原液、肉毒素瘦臉、水光針”的圖文內(nèi)容，或向微信好友發(fā)送的推銷廣告。如果微商是你很好的朋友空也磨不過(guò)情面會(huì)幫其在朋友圈發(fā)布相關(guān)產(chǎn)品的廣告。美白也讓很多女性朋友變得沖動(dòng)，對(duì)玻尿酸、肉毒素、水光針這類見(jiàn)效快的微整形藥品不問(wèn)來(lái)源、不計(jì)后果的接受，所以才導(dǎo)致類似案件屢禁不止。

依據(jù)我國(guó)《刑法》第一百四十一條的規(guī)定“生產(chǎn)、銷售假藥的，處三年以下有期徒刑或者拘役，并處罰金；對(duì)人體健康造成嚴(yán)重危害或者有其他嚴(yán)重情節(jié)的，處三年以上十年以下有期徒刑，并處罰金；致人死亡或者有其他特別嚴(yán)重情節(jié)的，處十年以上有期徒刑、無(wú)期徒刑或者死刑，并處罰金或者沒(méi)收財(cái)產(chǎn)”，該法條所稱的假藥，是指依照《藥品管理法》的規(guī)定屬于假藥和按假藥處理的藥品、非藥品。我國(guó)《藥品管理法》第48條明確規(guī)定，未經(jīng)批準(zhǔn)生產(chǎn)、進(jìn)口的藥品，均案假藥論處。《醫(yī)療美容服務(wù)管理辦法》規(guī)定，醫(yī)療美容屬于醫(yī)療行為，必須在開(kāi)設(shè)美容醫(yī)療機(jī)構(gòu)和設(shè)置醫(yī)療美容科的醫(yī)療機(jī)構(gòu)進(jìn)行，且需要持有《醫(yī)療機(jī)構(gòu)執(zhí)業(yè)許可證》方可開(kāi)展醫(yī)療美容活動(dòng)，注射肉毒素等毒性藥品須在醫(yī)療機(jī)構(gòu)使用。在沒(méi)有資質(zhì)的美容機(jī)構(gòu)使用假藥進(jìn)行微整形不僅極易造成醫(yī)療事故，出現(xiàn)問(wèn)題后也很難得到法律保障。【案例索引】（2016）浙0103刑初407號(hào)

2015年12月至2016年1月間，被告人杜某通過(guò)微信聯(lián)系，以網(wǎng)購(gòu)方式向他人購(gòu)得韓國(guó)產(chǎn)A型肉毒毒素針、溶脂針、水光針等注射劑以及外用麻藥等非法藥品用于出售。

期間，被告人杜某在微信朋友圈、百度貼吧發(fā)布微整形美容廣告招徠生意，以為人做微整形的方式，向多人非法銷售上述藥品，并從中非法獲利。具體犯罪事實(shí)如下: 1.2015年12月25日，被告人杜某在杭州市江干區(qū)機(jī)場(chǎng)路里街機(jī)神公寓3幢3單元602室，為朱某注射韓國(guó)產(chǎn)A型肉毒毒素（NABOTA?BOTULINUMTOXINTYPEA）1支，收費(fèi)人民幣1200元。

2.2015年12月26日，被告人杜某在杭州市江干區(qū)機(jī)場(chǎng)路里街機(jī)神公寓3幢3單元602室，為鄒某注射韓國(guó)產(chǎn)A型肉毒毒素1支，收費(fèi)人民幣1200元。

3.2016年1月2日，被告人杜某在上海一家賓館為一個(gè)微信名為“jade”的女子注射韓國(guó)產(chǎn)A型肉毒毒素1支，收費(fèi)人民幣1600元。

4.2016年1月12日，被告人杜某在杭州市江干區(qū)石橋路克拉公寓4幢910室，為潘某注射韓國(guó)產(chǎn)A型肉毒毒素1支，收費(fèi)人民幣1300元。

5.2016年1月15日，被告人杜某在下城區(qū)野風(fēng)現(xiàn)代中心南樓1419房間，以1700元的價(jià)格向孔某出售3針?biāo)忉槪n國(guó)產(chǎn)Hyaron?prefilledinj），當(dāng)日注射1針并收費(fèi)人民幣1200元。6.2015年1月16日，被告人杜某在杭州市拱墅區(qū)湖墅南路與文暉路交叉口的布丁酒店205房間，以2000元的價(jià)格向張某出售4針?biāo)忉槪?dāng)日注射1針并收費(fèi)人民幣1000元。7.2016年1月16日，被告人杜某在杭州市西湖區(qū)五蓮西苑249號(hào)，以人民幣2000元的價(jià)格向鄧某出售3針韓國(guó)產(chǎn)Vlin溶脂針（Vline-AsolutionLIPOLYSIS），當(dāng)日注射1針并收費(fèi)人民幣2000元。

8.2016年1月17日，被告人杜某在杭州市臨平和合財(cái)富中心1821房間，為李某注射韓國(guó)產(chǎn)A型肉毒毒素1針，收費(fèi)人民幣1000元。

杜某犯銷售假藥罪，判處有期徒刑十個(gè)月，緩刑一年六個(gè)月，并處罰金人民幣50000元。愛(ài)美之心人皆有之，筆者建議愛(ài)美女性們，若卻需要使用藥品進(jìn)行整形美容時(shí)，必須到有資質(zhì)的醫(yī)院進(jìn)行整形美容，如果遇上朋友圈的不良藥商，從維護(hù)自身及公眾合法權(quán)益的角度，建議立即向公安機(jī)關(guān)報(bào)警處理。
