一、監護人證明書的格式

監護人證明書

(1)若被監護人未滿十八周歲的：

茲證明_______，男/女，于___年__月__日出生，_______的生父是_______(現健在/已故)。_______生母是_______(現健在/已故)。的法定監護人是(父母健在的，可任選父母其中一人)。

(2)若被監護人為無民事行為能力或者限制民事行為能力的精神病人的：

茲證明_______，男/女，于___年__月__日出生，_______的生父是_______(現健在/已故)。_______生母是_______(現健在/已故)。______的配偶是 ______(針對已婚的情況)。

二、監護人證明書辦理：

前一順序有監護資格的人無監護能力或者對被監護人明顯不利的，人民法院可以根據對被監護人有利的原則，從后一順序有監護資格的人中擇優確定。被監護人有識別能力的，應視情況征求被監護人的意見。監護人可以是一人，也可以是同一順序中的數人。被指定人對指定不服提起訴訟的，人民法院應當根據上述規定，作出維持或者撤銷指定監護人的判決。如果判決是撤銷原指定的，可以同時另行指定監護人。此類案件，比照民事訴訟法規定的特別程序進行審理。在人民法院作出判決前的監護責任，一般應當按照指定監護人的順序，由有監護資格的人承擔。

有監護資格的人之間協議確定監護人的，應當由協議確定的監護人對被監護人承擔監護責任。對于擔任監護人有爭議的，應當按照民法通則的以下規定，由有關組織予以指定。未經指定而向人民法院起訴的，人民法院不予受理：沒有上述規定的監護人的，由未成年人的父、母的所在單位或者未成年人住所地的居民委員會、村民委員會或者民政部門擔任監護人。對擔任監護人有爭議的，由精神病人的所在單位或者住所地的居民委員會、村民委員會在近親屬中指定。對指定不服提起訴訟的，由人民法院裁決。

有關組織依照民法通則規定指定監護人，以書面或者口頭通知了被指定人的，應當認定指定成立。被指定人不服的，應當在接到通知的次日起三十日內向人民法院起訴。逾期起訴的，按變更監護關系處理。監護人被指定后，不得自行變更。擅自變更的，由原被指定的監護人和變更后的監護人承擔監護責任。
