環保部通報環境監測數據弄虛作假案例：多名責任人被拘

人民網北京6月12日電 據環境保護部網站消息，為貫徹落實新環保法，打擊篡改、偽造監測數據弄虛作假的行為，環境保護部近期組織各地污染源自動監控管理部門加大對污染源自動監控設施運行管理情況的監督檢查，對發現的數據弄虛作假等違法行為進行了嚴肅查處，通報了一批典型案例。

環境保護部環境監察局局長鄒首民具體通報了這些案例的造假事實：

1、建滔（河北）焦化有限公司主營搗固焦、粗苯、焦油等產品，是邢臺市重要化工企業之一。4月22日，邢臺市環保局與市公安局環保支隊混合編隊，對該公司污染物排放情況進行了全面檢查。檢查發現，該公司部分高濃度焦化生產廢水未經任何處理，直接用于熄焦，屬典型的惡意偷排偷放。此外，該公司一期工程150t/h燃煤鍋爐自動監控設備段二氧化硫值為35-90mg/m3之間，煙塵為45mg/m3，環保局現場手工監測二氧化硫值為166-172 mg/m3之間，煙塵為194 mg/m3；二期工程75t/h燃煤鍋爐自動監控設備煙塵值為66 mg/m3，環保局現場手工監測二氧化硫值為煙塵為163 mg/m3，存在焦爐超標排放、燃煤鍋爐在線監測數據造假、煙塵超標排放等問題。邢臺市環保局依法作出處罰決定，對該公司處以145萬元罰款并沒收違法保證金100萬元；因該公司肆意修改在線監控數據，其主管環保的經理張某某、儀表部經理胡某被依法行政拘留7日。

2、河南省環境監控中心通過調閱歷史監控數據，發現信陽豫信軋鋼實業有限公司焦爐煙囪二氧化硫自動監控數據長期穩定在20mg/m3。4月17日組織赴現場人工監測發現數據為100mg/m3-200mg/m3，檢查前后自動監控數據差距較大。經調查證實，該企業擅自拔出部分二氧化硫測量探頭，使采樣孔漏氣，稀釋排放污染物，人為干擾采樣裝置、降低測量數據，造成監控數據失真。針對信陽豫信軋鋼實業有限公司的違法行為，信陽市環保局依法對企業下達了處罰決定書，對企業存在的超標排放、干擾自動監控數據行為，分別給予6萬元、3萬元處罰，追繳2015年第一季度焦爐煙囪二氧化硫排污費，啟動按日計罰程序。信陽市公安局對涉嫌違法的主管人員李某某和其他直接責任人王某某作出了行政拘留十日的行政處罰。

3、群眾投訴中國水泥廠有限公司涉嫌排放廢氣超標、污染環境，但環保局監控平臺上企業各項污染物排放指標全部達標。南京市環境監察支隊到企業現場調查取證發現，該企業二號窯二氧化硫分析儀顯示數據是210毫克/立方米，超標5%，但傳至環保局的數據只有23.27毫克/立方米；氮氧化物分析儀數據是881毫克/立方，但上傳環保局的是300毫克/立方米。檢查人員打開監控設備發現，負責數據采樣的分析儀和數據傳輸的工控機之間接入了幾根導線，并連接該公司辦公室，可隨意篡改監測數據。近日，南京市環境監察支隊對這家企業處以20萬元行政罰款，并要求其補交排污費近260萬元。同時，企業相關環保責任人楊某，因篡改、偽造監測數據，被處以行政拘留5天。

4、山東省環境監控中心近期多次通過數據審核發現，龍口礦業集團熱電有限公司夜間煙氣溫度為87℃（濕法脫硫），白天為58℃，懷疑該企業夜間停運脫硫設施。3月18日，山東省環境監控中心對該公司開展獨立調查。調查發現，該企業排放口SO2濃度數據為1915mg/m3,超標8.6倍，NOx濃度為301mg/m3,超標0.5倍。然而，該公司自動監測設備顯示SO2濃度為100mg/m3，NOx為67mg/m3,與現場監測數據不一致，初步判斷存在數據造假問題。檢查人員對采樣管路、工控機參數等進行排查，發現監測站房隔壁的房間內有礦泉水桶和氮氣鋼瓶，分別用于吸收和稀釋采樣煙氣中的SO2和NOX，干擾了自動監測設備正常運行。據悉，這是新《環保法》實施以來首例利用兩種方式進行數據造假的行為。3月19日，龍口市環保局對其就污染物超標排放和自動監測設備弄虛作假分別予以5萬元和10萬元的頂格罰款，并限產三個月。同時，龍口市公安局對涉案企業環保部主任王某行政拘留10天。5、3月5日，山東省環保廳執法人員在對安丘市盛源熱電進行獨立調查時，發現安裝在2號煙囪的自動監測設備含氧量急劇下降，S02濃度也大幅降低，檢查人員初步判斷存在干擾采樣問題，于是對采樣管路進行排查，發現企業在兩臺自動監測設備采樣管路上均接有氮氣稀釋裝置，干擾了自動監測設備正常運行，導致監測數據降低。排除干擾后的監測顯示，2號煙囪外排煙氣S02濃度為1236mg/m3，超標5.2倍。濰坊市環保局對該企業實施了頂格處罰，責令限期達標排放。同時，公安部門對涉案企業環保部主任孫某拘留10天，對具體實施者鄭某拘留5天。安丘市紀委給予企業法人和分管副總黨內嚴重警告處分。

6、山東省監控中心通過數據審核，發現萊蕪市汶源熱電有限公司S02數據夜間明顯低于白天，并且較長時間數據保持不變，懷疑存在弄虛作假行為。2月5日，省監控中心對該企業進行獨立調查，發現在調查人員進廠后S02數據大幅升高，排放濃度為550mg/m3，超標1.75倍。調閱工控機參數記錄，發現在調查人員進站房前一分鐘，S02量程剛由300 mg/m3修改為正常值（1000 mg/m3），致使S02數據突變。進一步檢查發現，在此之前有多次修改量程記錄，企業通過設定量程上限，干擾了自動監測設備的正常運行。調查組現場責令企業立即改正監測參數，并要求限期清除自動監測設備造假功能；省環保廳按照對企業罰款5萬，并要求在確保居民供暖的前提下最大限度降低生產負荷，確保達標排放。按環保廳、公安廳聯勤聯動工作機制，調查組現場向萊蕪公安局移交了相關證據，公安機關對企業環保主任實施了行政拘留10天的處罰。

7、山東省環境監控中心在東營華泰化工集團有限公司現場檢查時發現，該企業存在大氣污染源自動監控設施數據造假問題，現場SO2自動監測分析儀排放濃度數據為66mg/m3，但人工監測數據為1180mg/m3，超標4.9倍，兩者相差約18倍。檢查組經調查取證后，現場向公安機關移交了相關調查證據。后經公安機關進一步調查，依法對該企業兩名責任人實施治安行政拘留。
