第一章 考生違紀作弊情節認定及處理辦法

第一條 考生不遵守考場紀律，不服從考試工作人員的安排與要求，有下列行為之一的，應當認定為考試違紀。考試違紀，取消該科目的考試成績。

（一）攜帶規定以外的物品進入考場或者未放在指定位置的；

（二）未經批準在規定的座位以外參加考試的；

（三）考試開始信號發出前答題或者考試結束信號發出后繼續答題的；

（四）在考試過程中旁窺、交頭接耳、互打暗號或者手勢的，體育測試中故意犯規者；

（五）在考場或者教育考試機構禁止的范圍內，喧嘩、吸煙或者實施其它影響考場秩序的行為的；

（六）未經考試工作人員同意在考試過程中擅自離開考場的；

（七）將試卷、答卷（含答題卡、答題紙等，下同）、草稿紙等考試用紙帶出考場的；

（八）用規定以外的筆或者紙答題或者在試卷規定以外的地方書寫姓名、考號或者以其它方式在答卷上標記信息的；

（九）其它違反考場規則但尚未構成作弊的行為。

第二條 考生違背考試公平、公正原則，以不正當手段獲得或者試圖獲得試題答案、考試成績，有下列行為之一的，應當認定為考試作弊。考試作弊，其當次報名參加考試的各科成績無效。

（一）攜帶與考試內容相關的文字材料或者存儲有與考試內容相關資料的電子設備參加考試的；

（二）抄襲或者協助他人抄襲試題答案或者與考試內容相關的資料的；

（三）搶奪、竊取他人試卷、答卷或者強迫他人為自己抄襲提供方便的；

（四）在考試過程中使用通訊設備的；

（五）由他人冒名代替參加考試的；

（六）故意銷毀試卷、答卷或者考試材料的；

（七）在答卷上填寫與本人身份不符的姓名、考號等信息的；

（八）傳、接物品或者交換試卷、答卷、草稿紙的；

（九）其它作弊行為。

第三條 考生不服從考試工作人員的管理，擾亂考場及考試工作場所秩序，有下所列行為之一的，應當終止其繼續參加本科目考試，其當次報名參加考試的各科成績無效；考生及其它人員的行為違反《治安管理處罰條例》的，由公安機關進行處理；構成犯罪的，由司法機關依法追究刑事責任。

（一）故意擾亂考點、考場、評卷場所等考試工作場所秩序經教育無效者；

（二）拒絕、妨礙考試工作人員履行管理職責經教育無效者；

（三）威脅、侮辱、誹謗、誣陷考試工作人員或其它考生；

（四）其它擾亂考試管理秩序的行為。

第四條 教育考試機構、考試工作人員在考試過程中或者在考試結束后發現下列行為之一的，應當認定相關的考生實施了考試作弊行為，其當次報名參加考試的各科成績無效。

（一）通過偽造證件、證明、檔案及其它材料獲得考試資格和考試成績的；

（二）評卷過程中被發現同一科目同一考場有兩份以上（含兩份）答卷答案雷同的；

（三）考場紀律混亂、考試秩序失控，出現大面積考試作弊現象的；

（四）考試工作人員協助實施作弊行為，事后查實的；

（五）其它應認定為作弊的行為。

第五條 代替他人或由他人代替參加學業考試，由市學業考試管理機構取消其考籍。是在校生的，由所在學校按有關規定嚴肅處理；其它人員，由考試管理機構建議其所在單位給予行政處分，直至開除或解聘。

第二章 考試工作人員違紀作弊情節及處理辦法

第六條 學業考試工作人員應當認真履行工作職責，在考試管理、組織及評卷等工作過程中，有下列行為之一的，應當停止其參加本次、當年及下一的學業考試工作，并由考試管理機構或者建議其所在單位視情節輕重分別給予相應的行政處分：

（一）應回避考試工作卻隱瞞不報的；

（二）擅自變更考試時間、地點或者考試安排的；

（三）提示、暗示或協助考生答題的；

（四）在監場過程中有擅離職守、為考生通風報信、睡覺、看書、談話、攜帶通訊工具等行為之一的；

（五）擅自將試題、答卷或者有關內容帶出考場或者傳遞給他人的；

（六）在評卷、統分中嚴重失職，造成明顯的錯評、漏評或者積分誤差的；

（七）在評卷中擅自更改評分細則或者不按評分細則進行評卷的；

（八）因未認真履行職責，造成所負責考場出現雷同卷的；

（九）擅自泄露評卷、統分等應予保密的情況的；

（十）其它違反監考、評卷等管理規定的行為。

第七條 考試工作人員有下列作弊行為之一的，應當停止其參加學業考試工作，由學業考試管理機構或者其所在單位視情節輕重分別給予相應的行政處分，并調離考試工作崗位；情節嚴重，構成犯罪的，由司法機關依法追究刑事責任：

（一）為不具備參加學業考試條件的人員提供假證明、證件、檔案，使其取得考試資格或者考試工作人員資格的；

（二）因玩忽職守，致使考生未能如期參加考試的或者使考試工作遭受重大損失的；

（三）利用監考或者從事考試工作之便，為考生作弊提供條件的；

（四）偽造、變造考生檔案（含電子檔案）的；

（五）在場外組織答卷、為考生提供答案的；

（六）指使、縱容或者伙同他人作弊的；

（七）偷換、涂改考生答卷、考試成績或者考場原始記錄材料的；

（八）擅自更改或者編造、虛報考試數據、信息的；

（九）利用考試工作便利，索賄、受賄、以權徇私的；

（十）誣陷、打擊報復考生的。

第八條 因管理混亂、考試工作人員玩忽職守，造成考點或者考場紀律混亂，作弊現象嚴重；或者同一考點同一時間的考試有五分之一（含五分之一）以上考場存在雷同卷的，由教育行政部門取消該考點當年及下一承辦學業考試的資格。

對出現大規模作弊情況的考場、考點的相關責任人、負責人及所屬考區的負責人，有關部門應當分別給予相應的行政處分；情節嚴重，構成犯罪的，由司法機關依法追究刑事責任。

第九條 違反保密規定，造成學業考試的試題、答案及評分參考（包括副題及其答案及評分參考，下同）丟失、泄密，密封時丟失考生答題紙和答題卡或者使考生答卷在保密期限內發生重大事故的，由有關部門視情節輕重，分別給予責任人和有關負責人行政處分；構成犯罪的，由司法機關依法追究刑事責任。

盜竊、損毀、傳播在保密期限內的學業考試試題、答案及評分參考、考生答卷、考試成績的，由有關部門依法追究有關人員的責任；構成犯罪的，由司法機關依法追究刑事責任。

第十條 在職人員及其它人員有下列行為之一的，由學業考試管理機構建議其所在單位給予行政處分或者由有關部門處理；構成犯罪的，由司法機關依法追究刑事責任：

（一）指使、縱容、授意考試工作人員放松考試紀律，致使考場秩序混亂、作弊嚴重的；

（二）代替他人參加學業考試的；

（三）參與或者組織他人進行考試作弊的；

（四）利用職權，包庇、掩蓋作弊行為或者脅迫他人作弊的；

（五）以打擊、報復、誣陷、威脅等手段侵犯考試工作人員、考生人身權利的；

（六）向考試工作人員行賄的；

（七）故意損壞考試設施的；

（八）擾亂、妨害考場、評卷點及有關考試工作場所秩序后果嚴重的。

第三章 違規行為認定與處理程序

第十一條 考試工作人員在考試過程中發現考生實施本辦法第一條、第二條所列考試違紀、作弊行為的，應當及時予以糾正并如實記錄；對考生用于作弊的材料、工具等，應予暫扣。

考生違規記錄作為認定考生違規事實的依據，應當由兩名以上（含兩名）監考員或者考場巡視員、檢查員簽字確認。考試工作人員應當向違紀考生告知違規記錄的內容，對暫扣的考生物品應填寫收據。

第十二條 學業考試管理機構發現本辦法第三條、第四條所列行為的，應當由兩名以上（含兩名）工作人員進行事實調查，收集、保存相應的證據材料，并在調查事實和證據的基礎上，對所涉及考生的違規行為進行認定。

第十三條 考點匯總考生違規記錄，匯總情況經考點主考簽字認定后，報送縣級學業考試管理機構，由市級學業考試管理機構依據本辦法的規定進行處理。

第十四條 教育行政部門和其它有關部門在考點、考場出現大面積作弊情況或者需要對教育考試機構實施監督的情況下，應當直接介入調查和處理。

第十五條 學業考試管理機構在對考試違規的個人或者單位做出處理決定前，應當復核違規事實和相關證據，告知被處理人或者單位做出處理決定的理由和依據；被處理人或者單位對所認定的違規事實認定存在異議的，應當給予其陳述和申辯的機會。被處理人受到停考、取消考籍處理的，可以要求舉行聽證。

第十六條 被處理人因受到停考、取消考籍處理要求舉行聽證的，參照執行《國家教育考試違規處理辦法》（中華人民共和國主席令第18號）。

附件4

學業考試考生守則

1.考生憑準考證按規定時間到指定考場參加考試。

2.每科開考30分鐘（英語考試開考前15分鐘）后不得入場；考試終了信號發出后方可離開考場。

3.考生入場，除考試必須的文具如2B鉛筆、書寫用0.5mm黑色簽字筆、直尺、圓規、三角板、橡皮外，其他任何物品不準帶入考場。

4.考生要對號入座，將準考證等證件放在課桌左上角。只能在答題紙、答題卡規定的地方填寫或涂黑自己的姓名、考試號、座位序號、考試科目、卷型等，不得在答題紙、答題卡其它地方做任何標記。

5.開考信號發出后才能開始答題。

6.考生在答題卡和答題紙規定地方作答，否則，一律無效。卷一要求用2B鉛筆按要求填涂，卷二要求用0.5mm黑色簽字筆答卷。考生要注意保護答題卡和答題紙，不得污損、折皺、粘連。

7.考試期間因病或上廁所需暫離考場的，應先舉手請示，經監考員批準后，由備用監考人員陪同前往。

8.考生在考場內須保持安靜，不準吸煙，不準喧嘩。

9.考試中，不準交頭接耳、左顧右盼、打手勢、做暗號，不準夾帶、偷看、抄襲或有意讓他人抄襲，不準傳抄答案或交換答題紙、答題卡。如遇試卷字跡不清、卷面缺損、污染等問題，可舉手詢問。10.考試終了信號發出后，考生須立即停止答卷，將答題紙、答題卡按監考員要求放好，待監考員將答題紙、答題卡、草稿紙等收齊后，起立、依次退出考場，不準在考場、考區逗留、喧嘩。不準將試題、答題紙、草稿紙帶出考場。
