依勞動法辭退員工之十種情形
辭退員工,以勞動法的專業術語來講,叫做“用人單位單方解除勞動合同”。辭退員工,不論對企業還是對員工,都是一個沉重的話題。對于大多數企業來講,辭退員工處理不當,很容易引發勞動糾紛甚至對簿公堂,對企業的正常營運產生深遠影響。因此,企業辭退員工如何在勞動法的框架范圍內進行,尤其顯得重要。
根據《勞動合同法》及相關規定,北京沈斌倜勞動法律師服務將企業在勞動法的框架內辭退員工分為以下十種情況,并將逐一進行講解,拋磚引玉。
勞動法下的辭退之一:試用期辭退
試用期辭退的法律依據為《勞動合同法》第39條,具體表現為:
首先,依據勞動法在試用期聶要辭退員工前提是雙方簽訂有勞動合同,且勞動合同中關于試用期的約定合法,即符合《勞動合同法》第19條的規定,勞動合同期限三個月以上不滿一年的,試用期不得超過一個月;勞動合同期限一年以上不滿三年的,試用期不得超過二個月;三年以上固定期限和無固定期限的勞動合同,試用期不得超過六個月。同一用人單位與同一勞動者只能約定一次試用期。以完成一定工作任務為期限的勞動合同或者勞動合同期限不滿三個月的,不得約定試用期。試用期包含在勞動合同期限內。勞動合同僅約定試用期的,試用期不成立,該期限為勞動合同期限。企業如違反上述規定與員工約定試用期的,由勞動行政部門責令改正;違法約定的試用期已經履行的,由企業以員工試用期滿月工資為標準,按已經履行的超過法定試用期的期間向員工支付賠償金。
其次,依據勞動法在試用期內辭退員工,須證明員工不符合錄用條件。企業要證明:有明確的錄用條件;錄用條件已向員工書面明確;員工不符合錄用條件;在試用期內作出辭退決定。這四個方面均具備了,才能保證在試用期辭退員工不會出現法律風險或將法律風險降低到最小。
我們認為,對于具體錄用條件的制定,特別是禁忌性條件,除了應當不違反法律的強制性規定,還應當具有合理性。合理性的標準會因崗位和行業不同而有差異,建議企業在設置錄用條件條款時,可以考慮通用與特別的分別規定,如將違紀、工作態度、工作能力等規定在通用條款中,將性別、健康狀況、技能證書等規定在特別條款中,且說明這樣特別規定的原因。這樣做的好處,既可以避免違反法律,出現歧視性條款,也可以讓員工明白錄用條件的合理性,消除未被錄用者的不滿心理,避免勞動爭議的出現。制定了可靠的錄用條件,只是成功運用它的 第一步,還需要制定在操作上的

這是情事變更原則在勞動合同中的體現。何為“客觀情況”,勞動法對此沒有做出明確規定。根據勞動部關于《中華人民共和國勞動法》若干條文的說明第26條,“客觀情況發生重大變化”是指:發生不可抗力或者出現致使勞動合同全部或者部分條款無法履行的情況,如企業兼并、遷移、資產轉移等,并且排除勞動法第27條所列的清況。從審判實踐看,一般是指因不可抗力或者企業條件發生變化等無法避免的情況,如自然條件、企業遷移、被兼并、分立、企業資產轉移、生產結構重大調整;轉產等,但絕不限于或等同于以上情況。新情況會不斷出現,尚有待在審判實踐中去摸索總結。
律師提醒:符合以上之七至之九其中任何一種情形的,企業可以單方通知解除勞動合同,但需提前30天書面通知員工(或支付相應的代通知金代替),并向員工支付解除勞動合同經濟補償金,標準為:按員工在本企業工作的年限,每滿一年支付一個月工資的標準向員工支付。六個月以上不滿一年的,按一年計算;不滿六個月的,向員工支付半個月工資的經濟補償。

歡樂的日子就要到盡頭了,面前的只有死亡,而面對的不僅僅是死亡,還有對這世界的不舍,對朋友的擔心,對死亡的恐懼。
風一吹,樹葉就紛紛落下,像淚,凄冷婉轉。樹枝有些已經干枯變型,好像一碰就得折掉。心情已經大不如前,有時煩躁,有時傷心,無力的在森林深處哭泣。本應毫無牽掛,但是樹枝上還有一顆顆新的種子,新的生命,新的希望。在我倒下時,我應該保護這一個個新的生命,不受傷害,盡情享受陽光的沐浴,雨滴的滋潤,還有我的懷抱。這就像我當年,在大樹中的情景一樣,我是他的希望?,F在他們是我的希望,我一定要將希望之種撒下大地。
又是一天過去了,種子還在慢慢成長,而我也越來越虛弱。我還在想象,這些種子一定會在大地上發芽成長的。
