第一章 行政機關公文

這是全書的重點章之一。

一、要了解法定公文的廣義和狹義概念：

廣義的公文是指機關中所有的可稱為“文件”的東西，包括計劃、總結等。

狹義的公文指的是法定公文，凡行政機關公文，指按《國務院辦公廳關于國家行政機關公文處理辦法》（本復習中簡稱為“辦法”）列出的公文文種；凡黨的機關公文，又指按《中國共產黨黨的各級領導機關文件處理條例》中規定的文件。

教材中提到的是2000年修訂的《國家行政機關公文處理辦法》，共有十三種公文，現在使用的是國務院修訂的新《辦法》，又增加了新文種“意見”，同時廢止了“指示”。

二、*要牢牢掌握公文的特點：

法定性、政策性、實用性、時效性、規范性

三、公文的基本功用： 頒布法規、傳達指示，反映情況、請示工作，聯系工作、商洽公務，宣傳教育，依據憑證。

四、*公文的分類：

1.按行文方向和行文關系劃分：上行文、平行文和下行文；

2.按有無緊急程度分：緊急公文和普通公文。

3.其中緊急公文：特急件和急件。

4.按有無保密要求分為：普通文件和保密文件。

其中保密文件可分為：絕密、機密、秘密三種。

五、*公文的格式：

要求會畫出正式文件的規范格式，包括每種公文的格式項目及位置都要準確（如有無簽發人，如有，位置在哪里等）。

（一）文頭部分有：

版頭、文號、簽發人、秘密等級、緊急程度等；

行政下行文不應有簽發人；

文號的組成包括機關代字、年份和文件順序號。

（二）行文部分（也叫中間部分）：

包括標題、主送機關、正文、習慣用語、發文機關、年月日、印章、主題詞、附件等。

標題示例：

北京市人民政府

關于撤銷大興縣設立大興區的通知

北京市人民政府辦公廳

關于《北京市加快城市危舊房改造實施辦法（試行）》 執行中有關問題的通知

不同的公文有不同的習慣用語，熟知常用公文的習慣用語，可以幫助我們正確地判斷文種。

發文機關要寫全稱，一般不能簡稱為“廠部辦公室”。

年月日要用漢字書寫，并且用全稱。

正式公文的主題詞設計，要查國務院的《主題詞手冊》。一般地說，主題詞是能夠概括文件內容的幾個詞（或詞組），最后一個詞一定是文種，如“綠化、美化、通知”或“加強、思想政治工作、通知”等。

（三）文尾部分：

有抄報、抄送、抄發和發文機關的辦文機構、印文年月日等。國家質量技術監督局1999年發布《國家機關公文格式》，在實際工作中辦理 3 文件的同志請注意新要求。

本次考試以教材為準。

六 *公文寫作的基本要求：

熟悉黨和國家的方針政策及有關法規和規定，要了解實際情況，要遵循行文的各項規則。

七、公文寫作示例：

對下述重點文種說明不同的要求：

1.命令（令）：

主要掌握行政令、發布令的區別。

發布令是用以發布各種法規范和規章的。

行政令是用于采取重大強制性行政措施時使用的。

2*議案：

關鍵是掌握概念：它適用于各級人民政府按照法律程序向同級人民代表大會或人大常委會提請審議事項。

3.*公告與通告：

要掌握兩個文種在認識和使用上的區別，主要表現為：公告是“向國內外”宣布重要事項和法定事項的，而通告則是用在“在一定范圍”。

* 4.通知：

這是本章中最重要的文種。除掌握相關知識和寫作技巧外，主要是要求會起草正式文件通知。

“因鍋爐壞了，洗澡堂停用二天”不在此列。

（1）、要研究通知的類別：

第一種類型的通知________關于頒布法規和規章的：

如《北京廣播電視大學大學生守則》，通知是以學校的名義發給“各區、縣電大分校，各工作站”的，將《守則》隨文下發，《守則》成為附件。

第二類通知_________批轉下級耒文的：

“批轉”中的“批”字可見是上對下，并且是先有下級對上報文。

例：

北京廣播電視大學貫徹“改革人才培養模式”，以學生學習為中心的經驗很好，學校就有關問題的創新和實踐工作，給市教委的有關部門寫了一份報告。

市教委認為很有創意，很具典型性，于是擬定一份通知，將北京電大的報告隨文下發，這就是批轉下級來文的通知。

北京電大的報告在這里成為“附件”。

第三種通知_______轉發上級來文的。

按照我國的行政管理層級，最高的是國務院，下邊是各級政府及同級機構。

每一份上級政府的下發文如“通知”，都要逐級轉發，這也叫“上邊一根針，底下千條線。”

“上邊”一級的通知總是被做為附件下發的，因為這是工作的根本依據。

例：

《海南省人民政府辦公廳轉發“國務院辦公廳關于嚴格控制新聞發布會和周年紀念活動的通知”的通知》

第四種類型通知________是不帶附件的：

相對帶有附件的通知而言，它更帶有一定的“主動”色彩。

（2）、通知的內容：

A、帶有附件的通知：

一是不加按語，即“照批照轉”。只明確要求下級執行。

寫法上多為“現將《??》發給你們，希遵照執行。”

二是加按語的。

所謂“按語”，是發文機關對所發附件的相關說明，如結合本地區、本行業、本部門的實際情況，做一些補充說明或提出其他要求，有的還可對附件尤其是上級來文做出評價。注意三個問題：

在什么情況下加按語？

加什么按語？

按語寫作要注意什么？

·吃透“附件”精神

·強調的是針對性

·“附件”內容和要求，讓下級理解得更充分和準確

按語的類別：評價、要求、說明等，一般要具體情況具體分析。

如教材中，“海南省政府辦公廳的通知”按語部分分為：

第一個自然段：強調海南的特殊現狀

第二自然段：結合海南本地區的情況制定了更為具體的規定。

* 加什么做為按語？

不是重復附件內容而是必須要寫出特色

檢驗的是發文機關辦文人員的政策、業務素質和寫作水平。

有責任心、有水平的干部要研究問題，寫出有針對性、有特色的“按語”，說到底還是干部素質問題。

B沒有附件的通知：

在正文中要寫好緣由和事項兩部分

a 緣由：目的、意義、現狀等（為什么通知）

b事項：工作原則、組織安排、活動布置、檢查評比等（通知什么）

教材中“沒有附件”的通知：

《關于開展國家公務員普通話培訓的通知》、《國務院關于成立國務院三峽工程建設委員會的通知》、《關于召開全國高新技術產業開發區工作會議的通知》

根據當前的形勢、任務，我們確定以下內容為思考重點：

a關于加強社會主義精神文明建設工作的；

5、通報：

通報是適用于表彰先進、批評錯誤、傳達重要精神或者情況的常用公文。

無論是表彰性的還是批評性的通報，都要明確表揚或批評的對象，不論是單位還是個人，都要首先明確指出。其次是說明事由，這也是表彰或批評的直接理由。

* 寫表彰通報：

A說明對象、光榮事跡、精神品質、號召學習和表彰辦法等。

B寫好這種時代精神非常強的文件，關鍵是我們要站在時代的高度，用發展的眼光來審視人或組織的行為。

6報告：《國家行政機關公文處理辦法》規定：報告適用于向上級機關匯報工作，反映情況，提出意見或者建議，答復上級機關的詢問。

A 按其性質不同，可將其分為綜合報告和專題報告；

B 按其具體內容和用途，又可分為情況報告、建議報告等。

C 一般地說，一份報告都會同時分別隸屬于至少兩種類型，如一份“北京電大關于加強對大學生進行思想政治工作的報告”，既可能是專題報告，又可能同時隸屬于建議報告。

7請示：

掌握請示的寫法和注意事項；

特別要注意請示與報告的區別，因為現在工作中仍有一些單位在寫

1、應用文為什么經常使用序數？序數的層次？

序數的使用，既使應用文各部分內容的連接、轉折顯得簡單、明確，又使應用文的層次、段落的劃分安排變得更加清楚和有條理。這有利于受文者理解和把握應用文的內容。

依照《國家行政機關應用文處理辦法》第五章第二十五條的規定，序數的層次順序如下：
