六、受聘方的義務:

（一）遵守中國的法律、法規，不干預中國的內部事務。

（二）遵守聘方的工作制度和有關外國專家的管理規定，接受聘方的工作安排、業務指導、檢查和評估。未經聘方同意，不得兼任與聘方無關的其他勞務。

（三）按期完成工作任務，保證工作質量。

（四）尊重中國的宗教政策。不從事傳教等與專家身份不符的活動。

（五）尊重中國人民的道德規范和風俗習慣。

（六）無酗酒、吸毒、賭博等不良生活習慣。

七、合同的變更、解除和終止：

雙方應信守合同，未經雙方一致同意，任何一方不得擅自更改、解除和終止合同。．經當事人雙方協商同意后，可以變更、解除和終止合同。在未達成一致意見前，仍應當嚴格履行合同。

（一）聘方在下述情形中，有權與受聘方解除合同，但須提前30天以書面形式通知，30天后方可解除合同：

1、受聘方不能按合同約定條件（含附件所規定內容）履行合同，經聘方指出或調整后，仍無法達到聘方預期的；

2、根據醫生診斷，受聘方在病假連續30天后不能恢復正常工作的；

（二）聘方在下述情形中，可與受聘方解除合同，無須提前告知，無須支付經濟補償金：

1、受聘方在試用期間被證明不能達到聘方預期條件的；

2、受聘方以欺騙、脅迫的手段，使聘方在違背真實意愿的情況下簽訂或變更本合同的；

3、受聘方有賭博、酗酒等不良習慣，或其行為不符合中國的道德規范，且造成惡劣影響，經受聘方指出（須有當事人簽字的處理記錄）后仍不改正的；

4、受聘方有嚴重違法違紀行為，或因犯罪行為被警方拘留；

（三）聘方因其它原因要求無條件解除合同，應提前30天以書面形式通知，并須額外支付1-3個月工資作為經濟補償金；

（四）受聘方在試用期內解除本合同，須提前3天通知聘方，在試用期后因個人原因要求解除本合同，須提前30天以書面形式通知聘方。

（五）受聘方在下述情形中，可立即解除本合同：

1、聘方被證明未按合同約定提供受聘方必要的工作和生活條件；

2、聘方被證明未按本合同約定按時足額支付受聘方報酬；

3、聘方的規章制度違反中國法律、法規規定，損害受聘方權益的；

4、聘方以欺騙、脅迫的手段，使受聘方在違背其真實意愿的情況下簽訂和變更本合同的。

（六）在下述情形下，本合同自動終止：

1、本合同期滿，雙方不再續訂本合同；

2、聘方被宣布破產或解散，或被取締《聘用外國文教專家資格認可證書》；

3、受聘方死亡，或被人民法院宣告死亡或宣告失蹤的，或者適用法律、法規規定的其它任何情形。

八、續約

（一）聘用雙方若希望與對方續簽合同，必須在本合同期滿30天前向另一方提出，經雙方協商同意后簽訂新合同；

（二）聘方若無意與受聘方續簽合同，合同期滿即自行失效，無須提前告知受聘方。

九、違約

當事人一方不履行合同或者履行合同義務不符合約定條件，即違反合同時，應當向另一方支付800-3000美元，或相當于受聘方月工資3-10倍數額人民幣的違約金。

聘用雙方未經提前告知對方而無故解除合同，須向對方支付違約金。違約金的具體數額由聘用雙方協商決定。

十、不可抗力

不可抗力指不能預見其發生且對其后果不能防止和避免的任何事件、情形或情況。發生不可抗力事件，受事件影響的本合同項下的合同義務不可抗力作用期間內應中止履行，遭遇不可抗力影響的一方應及時通知另一方，并應在15日內出具證明。

受聘方因不可抗力事件要求解除合同，需出具有關機構證明，經聘方同意后，離華的費用自理；聘方因不可抗力事件要求解除合同，經受聘方同意后，須承擔受聘方離華費用，并額外支付受聘方一個月工資作為經濟補償金。

十一、本合同（協議）必須在受聘方入境身體檢查合格，并獲得政府有關部門簽發的來華工作許可和居留許可后才生效，體檢及簽證所需費用均由聘用方承擔，受聘方需積極配合以獲得有效簽證和許可。聘用方在合同生效前與受聘方已發生的實際聘用行為，所有責任和由此引發的費用由聘方承擔。合同期滿即自行失效。受聘方合同期滿后，在華逗留期間的一切費用自理。

十二、棄權

若合同的任何一方放棄行使合同中的任何一項權利，將不影響合同的效力；并且不妨礙對該合同其他權利的行使。

十三、爭議解決

當事人雙方發生合同糾紛時，盡可能通過協商解決。若協商無法達到一致意見，可在爭議產生后60天內向人事或勞動仲裁部門申請仲裁。如發生糾紛的任何一方對仲裁結果不服，可直接向地方法院提起訴訟，由法院按規定程序判決。

一．工作任務

二、工資待遇

1.直接報酬。貨幣工資每月人民幣_______元。工資以人民幣支付。工資自到職之日起到期滿之日止，按月發給。

4.受聘方應按照《中華人民共和國個人所得稅法》依法交納個人所得稅。

三、住宿及交通

1．聘方向受聘方免費提供一套帶衛生間和廚房的住房，住房內附設家具、臥具、電話、電視機、電冰箱、空調、洗衣機。水電費、電話費、網絡費、煤氣費，受聘方自理。如只能提供

四、工作時間和休息、節日

1.受聘方每日工作時間為8小時，每周工作時間為5天。2.受聘方在中國所有法定公共節假日享受帶薪假期。

五、病假、事假、遲到和早退

1.受聘方請病假，須憑聘方指定的醫院醫生證明，并須得到主管領導批準。受聘方在一個合同期內，累計病假不滿7天，工資按照100％發給；超過7天不滿30天，工資將按70％發給，30天后，聘方將停發工資，并有權解除聘用合同。

2.受聘方請事假須經聘方同意，聘方將按日扣發工資，在合同期內事假累計不得超過10天,一次不得連續超過3天。

3.未經批準曠職1天，扣發3天工資,超過10天或未經聘方同意而擅離職守的，均被視為違反合約，聘方有權解除合同，并追究受聘方的違約責任。4.受聘方遲到或早退一次將受到警告，兩次將扣發一天工資，若達5次以上，除扣發相應工資外，聘方有權與受聘方解除勞動合同。

本附件與標準聘用合同具有同等效力，是合同不可分割的一部分。

聘用合同附件各項條款的確定和變更均須由當事人雙方協商，并以書面形式做出約定，任何口頭協議均視為無效。

1.Both parties should abide by the contract and should refrain from revising, canceling, or terminating the contract without mutual consent.2.The contract can be revised, canceled, or terminated with mutual consent.Before both parties have reached an agreement, the contract should be strictly observed.3.party A has the right to cancel the contract with a written notice to party B under the following conditions;

(1)party B does not fulfill the contract or does not fulfill the contract obligations according to the terms stipulated, and has failed to amend after party A has pointed it out.(2)According to the doctor's diagnosis, party B cannot resume normal work after a continued 30 day sick leave.4.party B has the right to cancel the contract with a written notice to party A under the following conditions:

(1)party A has not provided party B with necessary working and living conditions as stipulated in the contract.(2)party A has not paid party B as scheduled.Ⅷ Breach penalty

When either of the two parties fails to fulfill the contract or fails to fulfill the contract obligations according to the terms stipulated, that is, breaks the contract, it must pay a breach penalty of US$500 to 2,000(or the equivalent in RMB).If party B asks to cancel the contract due to events beyond control, it should produce certifications by the department concerned, obtain party A's consent, and pay its own return expenses;If party B cancels the contract without valid reason, it should pay its own return expenses and pay breach penalty to party A.If party A asks to cancel the contract due to events beyond control, with the consent of party B, it should pay party B's return expenses;if party A cancels the contract without valid reason, it should pay party B's return expenses and pay a breach penalty to party B.Ⅸ The appendix of this contract is an inseparable part of the contract and has equal effect
