行政訴訟原告或第三人申請調取證據的條件

在行政訴訟中，由于作為行政法律關系當事人的行政機關與行政相對人之間的客觀不對等狀態的存在，使行政相對人有時不能自行收集證據甚至無法取得證據。這時，如果具備下列條件，當事人就可向法院申請調取證據：

(1)申請人是原告或第三人及其訴訟代理人。一般情況下，被告因實施具體行政行為時受“先取證、后裁決”原則的約束而不被包含在申請人之內。不過，如果出現被告確因特殊原因無法獲取證據而法院可獲取證據等情形，被告可否申請調取證據，法律法規及司法解釋對此并未正面禁止，在行政審判中可視具體情況而定。

(2)原告或第三人確因客觀原因不能自行收集證據。在這里，原告或第三人并非主觀不愿或怠于收集證據，而是由于主觀 以外的客觀原因使其不能自行收集證據，只有這 樣，原告或第三人才可以向法院提出調取證據申 請。

(3)原告或第三人能夠提供證據的確切線索，如關于證人的基本情況、有關證據材料的保存機關等，只有這樣，法院的證據調取活動才不會無的放矢。上述三個條件相輔相成，缺一不可，構成了原告或第三人申請調取證據的實質性要件。應當注意的是，當被告雖能提供證據的確切線索卻無法自行收集時，或者由于原告或第三人的自身主觀過錯不能自行收集證據時，或者原告或第三人無法自行收集證據又無法提供證據的確切線索時，或者證據雖有確切線索但原告或第三人能自行收集時，都無權向法院申請調取證據。行政審判實踐中，法院應依據相關法律規定及上述規定對原告或第三人的調取證據申請進行審查。

原告或者第三人不能自行收集，但能夠提供確切線索的，可以申請人民法院調取下列證據材料：

(一)由國家有關部門保存而須由人民法院調取的證據材料；

(二)涉及國家秘密、商業秘密、個人隱私的證據材料：

(三)確因客觀原因不能自行收集的其他證據材料。

人民法院不得為證明被訴具體行政行為的合法性，調取被告在作出具體行政行為時未收集的證據。

第二十九條
