贏了網s.yingle.com 2017年6月12日，被告李某將其所有的按揭車輛轉讓變賣給原告高某，約定車價款為 65000元，原告實際支付61000元。后因未辦理過戶手續，原告將該車退還被告，被告李某未退還原告購車款，而是于2017年7月3日出具借款 61000元的借條，約定同年8月3日一次性付清。由被告袁某提供擔保。

此后，被告李某僅歸還部分購車款，雙方為此產生糾紛，經公安機關處理，被告李某將剩余未歸還的購車款30000元又出具欠條予原告，但原借條未撤回，款項也至今未歸還。

法院認為，原、被告間系買賣關系，原告高某將所購車輛退還被告李某，其應將購車款歸還。高某與李某對所欠購車款另行協議變更，未取得擔保人袁某的書面同意，故袁某不再承擔保證責任。根據相關法律規定，依法判決被告李某歸還原告高某剩余購車款30000元;被告袁某不承擔保證責任。

我國《擔保法》第十三條規定：保證人與債權人應當以書面形式訂立保證合同。最高院《中華人民共和國擔保法若干問題的解釋》第二十二條第二款還規定：主合同中雖然沒有保證條款，但是，保證人在主合同上以保證人的身份簽字或者蓋章的，保證合同成立。本案中，被

贏了網s.yingle.com 告袁某在借條上以保證人的身份簽字，根據上述規定，袁某最初提供的擔保是成立的。且根據《擔保法》第十九條：當事人對保證方式沒有約定或者約定不明確的，按照連帶責任保證承擔保證責任。袁某可就要承擔連帶還款責任了。后，原告高某與被告李某在擔保人袁某不知的情況下，經公安機關調處，雙方對所欠的買賣車輛款，重新進行了確認，變更，事后，也未取得擔保人袁某對重新出具借條的簽字確認，符合《擔保法》第二十四條規定：債權人與債務人協議變更主合同的應當取得保證人書面同意，未經保證人書面同意的，保證人不再承擔保證責任。所以被告袁某對上述欠款不承擔保證責任。
